Manufactured Housing Institute ‘Housing Alert’ ‘Supreme Court Case Challenges CFPB Funding’ MHI Backstory, Implications Explored – Legal Contingency Champions Wanted; plus MHVille Stocks Update


On 2.27.2023 the following emailed message from the Manufactured Housing Institute (MHI) was forwarded to MHProNews as a news tip. The MHI message to members and followers in an MHI “Housing Alert” which has the headline: “Supreme Court to Take Case Challenging CFPB’s Funding.” In an era in America where apparent hypocrisy, paltering, posturing, “deception and misdirection” are regrettably common, they are also often an apparent example of one finger pointing outward while three more are pointing back at the accuser. The case has been fashioned in agreement and disagreement with the challenge to the Supreme Court on the funding for the CFPB is a legitimate legal debate. Those arguments are what “the Supremes” will consider and decide. MHI’s take on that will be Part I of this article. Part II explores additional information with more MHProNews expert analysis and commentary. Part of that commentary will ask the simple question: every time MHI raises a legal question, such as this one, why isn’t the obvious follow up question being asked? Why is MHI itself not robustly, sincerely, and effectively applying their own implied logic by pursuing litigation to get the manufactured home industry’s rights under federal law fully and properly enforced? Put differently, why is MHI inconsistent between their words and their behaviors? Another aspect of Part II will briefly be a call to action for successful and resourceful contingency attorney ‘champions’ to step forward and sue often deep pocketed organizations, who often operate in the MHI orbit, for their failure to perform their fiduciary and other duties to shareholders and members? Potentially hundreds of billions of dollars could arguably be up for grabs. Part III of today’s report will be the Daily Business News on MHProNews’ recap of the data and graphics on dozens of manufactured housing connected equities plus a left-right ‘market moving’ headlines from CNN (left) and Newsmax (right).

Part I

On 2.27.2023 the Manufactured Housing Institute (MHI: a.k.a. satirically known as the Manufactured Hypocrisy Institute, the Monopolistic Housing Institute, the Machiavellian Housing Institute, et al) sent out the following message to members and industry readers.  “Subject: Supreme Court to Take Case Challenging CFPB’s Funding.” Note that quoting MHI should not be construed as an endorsement of that trade group.  Under their oversized logo was the following.



The Supreme Court has announced it will hear arguments in a case challenging the constitutionality of Congress’ decision to use the Federal Reserve to fund the Consumer Financial Protection Bureau (CFPB). To make sure the CFPB would be independent, Congress put the agency outside the appropriations process and instead gave it automatic funding from the Federal Reserve. This action by the Supreme Court follows a ruling in October by the U.S. Court of Appeals for the 5th Circuit which said that mechanism violated the Constitution and that the funding instead should be appropriated by Congress from the U.S. Treasury. The Biden administration appealed this lower court ruling asking the Supreme Court to hear the case. The Supreme Court will hear oral arguments and decide the case during the next term, which starts in October.

The Supreme Court previously ruled on the structure of the CFPB in a 2020 case, when it found the Congress violated the separation of powers when it put a single director in charge of enforcing consumer protection laws while the president could only fire that director for cause.

If the Supreme Court rules Federal Reserve funding for the CFPB is unconstitutional, this would probably have to go back to Congress, which could then impose changes on CFPB authority and practices if it decides to substitute a different funding source. The Supreme Court will also have to resolve the legality of prior actions the CFPB has taken if the Court finds they were taken during the period the Bureau was unconstitutionally funded. MHI will be monitoring this case closely.

Part II Additional Information with More MHProNews Analysis and Commentary

One must keep in mind that some of the wealthiest and most connected conglomerates on earth have members that are connected with MHI. Additionally, MHI has several multi-billion dollars in market value corporate members.  If MHI seriously wants to get something done in Washington, D.C., they certainly have the resources and connections to do so.

That said, the CFPB was a key issue for MHI since shortly after Dodd-Frank was enacted and the Consumer Financial Protection Bureau (CFPB) was created.

This report is not, per se, a commentary on the CFPB or its funding.  The question of the constitutionality of the funding for the CFPB has obviously made it to the docket of the highest court in the land.

What will be the focus of what follows is the apparent dichotomy between MHI’s statements and behaviors over the past decade plus years.

That said, and to set the stage properly, some background and disclosures are warranted. It is difficult not to ‘go gonzo’ for part of this next portion of the report, because MHProNews and this writer were interwoven into what unfolded for a dozen or so years.

As a disclosure, for some 7 years, this publication’s parent company was an MHI member. MHI routinely provided their content to MHProNews directly, as did the Manufactured Housing Association for Regulatory Reform (MHARR). Additionally, for years, MHI’s leaders would respond to inquiries by MHProNews directly and routinely in a timely manner.  That said, much of that began to change as MHProNews experienced a type of epiphany about MHI. As a result of a tip from an executive at what is still believed to be an MHI member firm, that executive drew attention to a CSPAN video that MHI was using as part of their promotion for passage of legislation they were supporting that was known as the Preserving Access to Manufactured Housing Act. “Preserving Access” was supposed to be a do or die issue, as the following remark by Tim Williams, President and CEO of Berkshire Hathaway owned 21st Mortgage Corporation said. Williams led 21st Mortgage is a sister brand for Clayton Homes, which is also owned by publicly traded Berkshire Hathaway (BRK). For years, as a pro-growth, pro-consumer, pro-manufactured housing trade publication, MHProNews zealously supported the enactment of MHI backed Preserving Access. A look back at articles from previous years while Preserving Access was in play will reflect those statements.


Tim Williams, MHI’s former Chairman, made it sound like the industry would utterly collapse if the Preserving Access to Manufactured Housing Act didn’t get enacted into law. But the Preserving Access to Manufactured Housing Act bill supported by MHI NEVER passed. It is now rarely if ever mentioned by MHI. 

But when it became apparent that MHI had selectively chosen information from a Senate hearing on Preserving Access, and had effectively made an effort to mislead their own members, MHProNews publicly and editorially called for the resignation or termination of then president and CEO Richard “Dick” Jennison and then senior vice president Lesli Gooch, who were apparently responsible for those arguably misleading communications to MHI members. MHProNews issued evidence-based reports with commentary that spotlighted that initial and then subsequent disconnects between what MHI’s top staffers were saying and doing.  Following the ‘aha moment’ of realization that MHI was apparently paltering and deceptively posturing efforts for a bill that they should have known would not pass during the Obama-Biden Administration. Why was the legislation doomed? While some Democrats had signed onto supporting the bill, the majority did not support changing a law that Democrats had championed. Furthermore, then President Obama said if the bill would ever somehow manage to reach his desk he would veto it.

This quotation graphic created by MHProNews which cited the remarks by Jason Boehlert, who was previously an MHI senior vice president for governmental affairs, was uploaded on 11.28.2017, but it first appeared in 2012 in the article linked below. MHI’s VP Boehlert provided the remarks as part of an op-ed to MHProNews that is found at this link here: That post included the quoted then MHI VP Boehlert remarks. When that article is carefully considered, in hindsight, it is logically inconsistent. Given President Obama’s reelection and Democratic gains in the Senate, as Boehlert then pointed out, it was not expected that Democrats would budge on Preserving Access.  Nevertheless, MHI continued to press that legislation for some 5 more years.


As it became apparent that there were several such logical inconsistencies, MHProNews – which had during that era MHI members and MHI itself as periodic sponsors – did what sincere and credible trade media is supposed to do. We provided the updated understanding of the realities as opposed to the previously errant understandings as the evidence began to emerge.  Here is how the Society for Professional Journalists (SPJ) Code of Ethics frames the duties for journalists who realize that they have goofed in a prior report(s).

As MHProNews’ parent company leadership began to grasp that MHI was apparently being used as a tool for misinformation, a series of discoveries came into focus. For instance, MHI’s prior chairman and longtime board member, Tim Williams – who was and remains the CEO of Berkshire owned 21st Mortgage – provided MHProNews with a PowerPoint he showed to members during an MHI meeting. That PowerPoint included this frame. The arrows, comments and boxes highlighting parts of the text are by MHProNews, but the base image about “Threats and Challenges” to manufactured housing were by Williams, whose photo was added by MHProNews to the collage below.


A slide in a presentation by Williams to MHI. It was provided by Williams to MHProNews. The opposition to the “progressive ideology,” in hindsight, is contradicted by Buffett partner’s Charlie Munger’s law firm bragging about how progressive they are. Buffett and Munger share such views.
This quote was posted on the Munger, Tolles & Olson (MTO) website. Munger and Olson both serve Warren Buffett led Berkshire Hathaway.
In hindsight, it should have been obvious that Preserving Access would never pass. Warren Buffett said he was in favor of Dodd-Frank. Buffett supported Barack Obama twice. Buffett’s grandson served in the Obama White House. Obama said he would veto Preserving Access if it hit his desk. Restated, there was no apparent chance for the Preserving Access bill to pass given those and other known dynamics. That raises the question – were MHI leaders merely naïve? Or were they acting on behalf of consolidators interested in wearing down the industry’s independents through a long and protracted battle that was never won and seemingly not intended to be successful? When the known facts are examined, none of the options look good for top MHI staff and its corporate board leaders. Is it any wonder that Jason Boehlert left MHI – after letting the ‘cat out of the bag’ in the remarks above? After Boehlert left, Lesli Gooch, Ph.D., took his place. She is now the organization’s CEO, despite her own documented conflicts of interest in apparently working for conventional builders while drawing a salary from MHI. See the tip below.
Note: An MHI VP, with no ties to MHARR, told MHProNews that this apparent documented conflict-of-interest behavior by Gooch was known among the staff at MHI’s office in Arlington, VA. That VP indicated that MHI’s key board members must have known and approved of her conflicted behavior. That begs its own series of inquiries.
Before MHProNews began pulling back the veil on the apparent disconnects, paltering, and conflicts of interest occurring with respect to MHI, Williams provided a ringing endorsement of MHProNews and our MHLivingNews sister site. The remarks above are part of several messages for publication by Tim Williams to MHProNews.

These are apparent examples of the truth hiding in plain sight.  No one at MHI is known to have raised some of these issues in the fashion that this writer and MHProNews did. After years of praise by Williams and MHI leaders of MHProNews as an objective and reliable source of information for manufactured housing, MHProNews’ parent company was suddenly booted from membership via an unsigned letter and a refund for that year (not previous years) membership dues.  There was no allegation made in that letter that MHProNews had violated any rule. Their unsigned letter simply claimed that there was no membership category for MHProNews, which appears to be a spurious claim, as others who did publishing and consulting remained on as MHI members.  Note that in the waning months of MHProNews’ membership at MHI meetings, the following sign was posted at MHI meetings. It was an inside joke at the time that the sign was no-so-subtly aimed at chasing MHProNews away without directly saying so.

Nevertheless, at industry events, this writer was a popular presenter. Our publication was and remains the largest and most read trade media, despite apparent efforts by MHI connected individuals to undermine us in the wake of our revelations to the manufactured housing industry’s professionals of the apparent disconnects and lack of effectiveness between MHI’s remarks and behavior.

As another former MHI VP, who became the founding president and CEO of the Manufactured Housing Association for Regulatory Reform (MHARR), told MHProNews recently, there are several apparent disconnects between what MHI says and what they do.

Nor is it only this publication and MHARR that expressed such concerns about MHI. A former MHI award winner, and two former MHI state affiliates broke ranks with the national MHI association over their questionable patterns of behavior.   Note that in the case of MHI award winner Marty Lavin, after years of his periodic and public critiques of the organization and some of their prominent member’s behavior, has apparently been scrubbed from the public side of the MHI website.  It seems that MHI does not like being critiqued. An MHI outside attorney has said as much.

Goch is a paid mouthpiece for MHI. This pull quote above is from a letter from Goch is fascinating. On the one hand, Goch said that MHI is working for the interests of all and wants all points of view. But then, Goch threatens in writing a then MHI member who dared question the association. They cannot have it both ways. Part of the irony is that in hindsight, as the evidence mounts, it becomes obvious that MHI has postured efforts for almost 20 years, since the start of the Berkshire era of manufactured housing began. Coincidence? Or is it just part of a broader plan that has benefited a few larger consolidators at great cost and harm to the many industry independents?


Given repeated opportunities for MHI, or their attorneys, to respond to such evidence-based allegations, MHI and their attorneys decline comment.


MHI has been ducking accountability for years, as these documented examples reflect.


MHI’s dominating brands are often the ones that have been accused by residents, consumers, and public officials – among others – of unethical and predatory behavior.





Part II b. Gaslighting and Charades

The case can be made that if not for an intrepid few among MHI members who are willing to keep MHProNews informed about the trade association’s seemingly self-contradictory claims and behavior, or the stalwart efforts of MHARR and their members, the gaslighting and manipulative tactics could well be even more effective than it has been in the past.  But thanks to occasional or routine tipsters, combined with the open efforts of MHARR, the motivations and apparent charade and gaslighting occurring in MHVille has been steadily exposed.

When reports by Bloomberg and the Washington Post, or Pew Research, or the Urban Institute – among others – are carefully unpacked, it is difficult for objective thinkers willing to explore the facts and evidence are hard pressed not to see what MHProNews eventually stumbled upon.

Namely, that MHI was deftly coopted some years ago by consolidators but continues to claim and posture that they work for all segments of the manufactured housing industry.



As noted, it isn’t just those named herein that have made such claims. There are others from across the left-right spectrum that have accused the few insiders of manipulating the system in a manner that benefits MHI insiders/consolidators.  A look at publicly traded company statements, firms that are MHI members, illustrates the disconnects between MHI’s claims and MHI’s behavior.

There are individual corporate members of the Manufactured Housing Institute that merit scrutiny for antitrust, RICO, Hobbs Act, and other possible legal violations. But the association has its own unique status. MHI as a trade group must be held up to its own claims. When the association’s claims are examined in the light of contradicting facts and evidence, that should trigger federal and/or state investigations. When months of public pressure by MHARR and MHProNews reports and commentary apparently caused MHI to finally pivot and do what they ought to have done circa June of 2022, namely, file suit against the Department of Energy (DOE) energy rule, MHI then opened themselves up to the obviously related questions. For MHI to effectively pretend that MHARR, or MHProNews/MHLivingNews don’t exist is part of their apparent effort to create an echo chamber that focuses on their narrative as opposed to positions, people, or organizations that see matters differently.

The Need for Public Officials to Investigate 

MHARR has publicly called for investigation by Congress of the failure of key agencies from implementing manufactured housing industry supportive legislation that were enacted by widely bipartisan bills in Congress some 15 and 22+ years ago.





That noted, it should be said that state officials could probe these same issues.  Just as several state attorneys general and/or other state officials, have been probing concerns over ESG and big business, something similar could be done to probe how affordable manufactured housing is being manipulated by some of those same conglomerates.

The bottom line for today is simple. The manufactured housing industry ought to be soaring during an affordable housing crisis. MHI leaders and members have said the same. Which begs the question, why is the industry then struggling?  One finger points out, while three point back at several of MHI’s key players.
