Some definitions will help explain how outrageous the latest iteration of the “Excellence in Manufactured Housing” Awards for 2023 are, shockingly given by the Manufactured Housing Institute (MHI) to two member firms that have D- ratings by the Better Business Bureau (BBB) evaluations (rating) system. MHI member Flagship Communities and Cavco Industries (CVCO) each had a D- rating with the BBB on the day the linked report, analysis and expert opinion commentaries were written. Besides what may arguably be disgraceful behavior worthy of mocking is the potential element for a deceptive or unfair trade practices claim (see further below, Federal Reserve on the Federal Trade Commission Act). Giving “Excellence” Awards to member companies with a D- rating by a consumer advocacy organization…you simply can’t make this stuff up. Is it any surprise why a law professor recommended in March of 2023 the need for manufactured housing to establish a trade organization to fight for manufactured housing industry rights legally, legislatively, etc..? Dear MHI leaders and attorneys – can you spell, Ouch? Does giving excellence awards to firms with a poor (D-) consumer rating with the BBB cause anyone at MHI any embarrassment? Does having a law professor argue about the need for a trade group that does what MHI claims they do cause MHI board members or staff leadership any embarrassment?

Cavco’s Inaugural Environmental, Social and Governance (ESG) Report Examined – ‘Ask Questions-Raise Concerns if They Exist’ – BBB Rating, Corp History, Other Factual Insights and Evidence Explored


Oxford Languages defines satire as: “the use of humor, irony, exaggeration, or ridicule to expose and criticize people’s stupidity or vices, particularly in the context of contemporary politics and other topical issues.” The bold was added by MHProNews for emphasis.

An Op-Ed, per Cambridge University Press and Assessment, “a page or section of a newspaper with signed articles expressing personal opinions, usually opposite the page of editorials (= statements of the newspaper’s opinions).”

MHI outside attorney David Goch said this about defending the organization’s reputation. It seems that someone can correctly criticize the trade group, right? How hard must it be to find something that is “wrongfully” disparaging MHI?

Goch is a paid mouthpiece for MHI. This pull quote from a letter from Goch is fascinating. On the one hand, Goch says that MHI is working for the interests of all and wants all points of view. Hah! Then, Goch threatens in writing a then MHI member who dared question the association. They cannot have it both ways. Part of the irony is that in hindsight, as the evidence mounts, it becomes obvious that MHI has postured efforts for almost 20 years, since the start of the Berkshire era of manufactured housing began. Coincidence? Pardon me, David. What reputation of MHI’s are you referring to, please?

  • Is it the reputation for saying one thing, but doing another, as with your so-called Code of Ethical Conduct?
  • Have you guys and gals involved in MHI leadership looked in the mirror lately?




This article will mention below some of the 2023 MHI award winners, stated in their email on 5.10.2023. An email uses what is called “the wires.” “The wires” is a possible element in a RICO case. Before proceeding to some of those MHI ‘excellence award winners’ some context and definitions are useful.

“The [RICO] statutes proscribe (1) causing the use of the mail or wire communications, including email; (2) in conjunction with a scheme to intentionally defraud another of money or property; (3) by means of a material deception. The offenses, along with attempts or conspiracies to commit them, carry a term of imprisonment of up to 30 years in some cases, followed by a term of supervised release. Offenders also face the prospect of fines, orders to make restitution, and forfeiture of their property.” That’s per everyCRSreport.com, which said: “Among the crimes for which mail or wire fraud may serve as an element, RICO (Racketeer Influenced and Corrupt Organizations Act) outlaws employing the patterned commission of predicate offenses to conduct the affairs of an enterprise that impacts commerce.” That’s in a post dated 2019 with the title: “Mail and Wire Fraud: A Brief Overview of Federal Criminal Law.” Could billable hours for outside attorneys working for MHI, corporate and staff leadership, and their awards committee be going up in the foreseeable future?

Per the Federal Reserve in a document linked here, the: Section 5(a) of the Federal Trade Commission Act (FTC Act) (15 USC §45) prohibits “unfair or deceptive acts or practices in or affecting commerce.” This prohibition applies to all persons engaged in commerce…” Humans are not the only “persons.” “A corporation is a legal person in the eyes of the law,” states the Foundation Group. Per Venable Law: “Although the FTC’s authority under Section 5 of the Federal Trade Commission Act (FTCA) generally does not reach the activities of many 501(c)(3) nonprofit organizations, it does apply to trade associations, many professional societies, and industry groups and their constituents (1.23.2023).

That noted, that Federal Reserve document defines unfair and deceptive trade practices as follows.

It is apparent that MHI ‘excellence’ award winners routinely use their ‘award’ for ‘excellence’ to convey certain impressions to consumers. MHI “excellence” awards may be deployed online, in ads, at a location(s), in press releases, mentioned by a sales or leasing agent, and so on. What ‘benefits’ are there for consumers when an MHI “excellence” award is essentially used to persuade a shopper to pick an award winner over some competitor?




Now, it may be that there are some truly excellent places, organizations, or things worthy of recognition among those that happen to be MHI members. But one apparent problem is this. If you or your firm are truly “excellent,” and are getting an award from MHI, how would you feel about getting such an award when D- rated by the BBB organizations or locations got an excellence award too? Or if your firm or location (etc.) didn’t get an “excellence” award, and your firm has an authentically good reputation and relationship with your customers/residents, but you didn’t win, and the winner has a D- rating with the BBB, how would that make you feel?

  • Do you see the logical problems?
  • Do you see why this is a great subject for a Saturday Satire? Just lay out the facts, claims, and evidence – often provided by MHI – and then add a healthy dose of free speech protected opinion, and viola! You have satire and parody! No wonder the manufactured housing industry is in month 6 of a downturn during an affordable housing crisis!

MHI’s Attorneys, Defamation, Libel, and Deceptive or Unfair Trade Practices

MHI is arguably the gift that keeps on giving to manufactured housing industry consolidators and purported black hat brands that are looking for a veneer of ethical cover. MHI is like a Ron Popeil pitch, “But wait! There’s more!!” By the way, as Easy Reader News reminds us: “Ron Popeil died…You may not know the name, but you do know the lines “But wait, there’s more,” and “Set it and forget it.” “As Seen on TV,” was a Popeil invention.” As a site with its fair share of typos, shouldn’t that be were Popeil inventions? Hmmm…

Andrew Justus, J.D., Niskanen Center Housing Policy Analyst, Asks and Answers – “What’s Holding Back Manufactured Homes?” Good question! That will be specifically explored in our Sunday Weekly Headlines Recap on MHProNews. But the question itself suggests that manufactured housing is being held back.

While MHI is announcing via email on Wednesday, May 10, 2023 handing out “excellence” awards to firms, the manufactured home industry is in a documented downturn.




Defamation and libel are legally actionable. “Defamation is a believable false statement of fact that causes material harm,” but Kelly Warner Law explains the difference between satire and legal defamation like this. “In other words: defamation is a malicious lie passed off as truth; satire is a humorous skewering of a cultural or political event – regardless of whether or not you agree with the viewpoint.” Defamation is legally actionable, but satire routinely is not. Furthermore, that source explains that: “Over the years, U.S. courts have made it abundantly clear: parody and satire are not defamatory.“

Parody is defined by Kelly Warner Law as “Parody involves the manipulation of extant works, usually for comedic effect. Similarly (but not exactly), satire is an exaggerated commentary on an irritating or hypocritical issue.” So, look at the various original MHI images and logos and decide for yourself.

That same MHI email fails to mention that downturn, despite it having a subheading of “Manufactured Housing Headlines” under their subject: “Newsletter.” It also says: “MHI News & Updates is a bi-weekly publication with important updates on federal legislative and regulatory activities, association accomplishments, industry events and other items important to our membership.”

Isn’t a downturn during an affordable housing crisis important to MHI’s membership?

Oh! Pardon us! For consolidating MHI members, a downturn can be an opportunity in disguise! Just look at what prominent MHI member ELS’ report linked below revealed.

Again, there may be some MHI award winners that deserve some recognition. But the case can be made that some are absolutely outrageous.

MHI members such as Flagship, Cavco, Clayton Homes, and 21st Mortgage are just some of the firms that have been given MHI “excellence” awards. Clayton and 21st have been credibly accused of being engaged in violations of antitrust law and other legal issues. So are other MHI ‘award’ winners.

MHI’s website states on this date the following about their purpose.

In what sense is MHI “expanding” “attainable homeownership” when the industry’s sales are demonstrably in decline? Isn’t that paltering at best, or a deceptive claim at worst?

Notice that the MHI image with those remarks does not actually use the term “manufactured housing.” Why is that so?

MHI and their attorneys have been asked repeatedly to address the kinds of concerns raised in this column and the crosslinked posts. While in years gone by, MHI corporate and staff leaders replied promptly, in more recent years, they have been silent.

Not so many years ago, MHI’s attorneys (inside, outside) threatened this publication and writer. But after posting this linked item, those threats stopped. Coincidence?




Beyond Goch’s remark cited above, MHProNews has numbers of pieces of evidence that demonstrate the MHI leaders routinely check our reports. Apparently, they must not think we have said something untrue, or that we have done so within the proper understanding of the law.

Defenses to Defamation

Truth – To be defamatory, a statement must be false. Truth is an absolute defense to a defamation claim.

Opinion – Only statements of fact can be defamatory. Statements of opinion are not.


The industry is demonstrably underperforming during an affordable housing crisis. MHI apparently hides the data behind a members only login. They often don’t put such reports in their own emails. Unlike the Manufactured Housing Association for Regulatory Reform (MHARR) emails, which routinely post their emails on their website, MHI often DOES NOT post their emails on their website. Fortunately, MHARR provides manufactured housing national production and top shipment states data publicly.




MHARR and their leaders have brought forward evidence-based claims that ought to trouble public officials, affordable housing advocates/seekers, investors, taxpayers, and others. While these may be good points useful for barbs launched against MHI, these are not apparent victimless ‘crimes’ or wrongdoing.



It isn’t just MHARR, or MHProNews, that have exposed MHI. Some MHI members have raised concerns too.

We often have editorially sharp, but still expert, opinions. It is up to investors, individual manufactured home industry professionals, and others to sort out the available evidence and see if MHI is engaged in a sly scheme designed to consolidate the industry. That may not be funny, but it is a topic worthy of exploration. Because the laws that seem to be violated by MHI and some of their key members do appear to violate potentially several federal and/or state laws.


If you know the facts, then you are unlikely to have the chutzpah to make up MHI’s claims.




When an industry has such a problematic example of a “post-production” trade association, it may be useful to laugh from time to time at MHI’s behavior and claims. Laughing and mocking could be therapeutic relief for some of those stressed by the harms caused to untold numbers of consumers and honorable independent manufactured home businesses that have to compete against “excellence” award winners. It is an often Topsy Turvey world in MHVille. No publications make cautionary tale clearer for insiders or outsiders looking in than MHProNews and MHLivingNews.

MHI gets a win, MHI gives their ‘excellence award winners’ an image boost with anyone that doesn’t go beyond the surface of such a claim. That’s vexing, but there it is.

This multiyear pattern of such Machiavellian ‘rope a dope’ machinations are hiding in plain sight. No motivated, seasoned professional can be this inept for so many years. It should be increasingly obvious that while the industry goes through troubling contractions after MHI declared ‘momentum.’ You just can’t make this stuff up. Laugh, cry, wonder quietly (or out loud…) how MHI, their dominating brands, and their state affiliates can get away with this pattern for so long, or contact your public official(s) and ask them to investigate this issue. ##
