‘Weakness and Delay in Washington’ ‘Helped Fuel Decline’ – Manufactured Housing Institute Faulted by MHARR for ‘Shocking’ ‘Decline’ in Manufactured Home Production; plus MHVille Markets Update

According to the Manufactured Housing Association for Regulatory Reform (MHARR), “Weakness and delay in Washington, D.C., accordingly – especially in the representation of the post-production sector of the industry – has helped to fuel the present decline and will continue to hamper the industry without further change.” MHARR pointedly blamed the Manufactured Housing Institute (MHI) by name for “more than eight months for fear and concern over the cost-impact of the DOE [Department of Energy manufactured housing energy] rule to overtake the market and help collapse sales far below previous levels.” While that editorial analysis by MHARR may be seen by MHI defenders as unremarkable, save for its increasing sharpness, one must keep in mind that the Texas Manufactured Housing Association (TMHA) raised flags about the DOE energy rule too. In a report by the Texas Real Estate Research Center (TRERC) on Wednesday, Jan 11, 2023, the TMHA’s Vice President Rob Ripperda said the following. “Manufacturers have five more months to prepare for the Department of Energy’s (DOE) new conservation standards and the Environmental Protection Agency’s updated Energy Star program requirements,” said Ripperda. “These adjustments require a lot of retooling, design updates, new materials sourcing, and a host of other process changes for each of Texas’ 26 manufacturing plants. The final impact on construction costs is unknown.” Those remarks were known months in advance. Ripperda said that a month before the TMHA and MHI finally filed suit, something that MHARR recommended months earlier. Restated, it isn’t just MHARR that pointed the finger at MHI, but TMHA’s remarks then and elsewhere arguably were less than enthusiastic about the hit that was coming in the absence of the correct action by MHI to sue to get the DOE to pause their costly and arguably flawed energy regulations.

SHOCKING NUMBERS — Manufactured Housing Production Decline Steepens as Manufactured Home Industry Impediments Multiply

Washington, D.C., June 5, 2023 – The Manufactured Housing Association for Regulatory Reform (MHARR) reports that according to official statistics compiled on behalf of the U.S. Department of Housing and Urban Development (HUD), HUD Code manufactured housing industry year-over-year production has declined again in April 2023. Just-released statistics indicate that HUD Code manufacturers produced 6,676 new homes in April 2023, a    34.3% decline from the 10,165 new HUD Code homes produced in April 2022. Cumulative production for 2023 is now 27,850 homes, a 30% decrease from the 39,835 homes produced over the same period during 2022.

A further analysis of the official industry statistics shows that the top ten shipment states from January 2023 — with monthly, cumulative, current year (2023) and prior year (2022) shipments per category as indicated — are:

The production statistics for April 2023 yield multiple changes to the new cumulative index, moving South Carolina and Georgia into 5th and 6th place respectively.

As the production statistics enter the second quarter of 2023, they continue to reflect not only declining year-over-year (YOY) industry production each month, but an alarming trend toward a steepening rate of decline as compared with 2022. Thus, the monthly YOY decline for January 2023 was 23.6%, the YOY decline for February 2023 was 29.1%, the YOY decline for March 2023 was 32.2% and now the YOY decline for April 2023, is 34.3%.

As was stressed in the MHARR production report published on May 3, 2023, this deepening decline is occurring not only at a time of unprecedented (and growing) demand for affordable housing, but at a time when sales of new site-built homes have increased year-over-year (up 11.8% in April 2023). This significant and worsening decline illustrates the market impact of two sets of major converging problems for the industry. On the one hand, as was noted in MHARR’s May 3, 2023 production report (and explained in detail in MHARR’s July 2022 White Paper), there is the long-term negative impact of unresolved discriminatory/exclusionary zoning and the absence of competitively-priced consumer financing for the vast bulk of the HUD Code manufactured housing market (nearly 80%) represented by personal property (chattel) financing.

Now, though, these longer-term obstructions to industry growth have been joined by another more immediate short-term shock to the market – specifically the threat of draconian U.S. Department of Energy (DOE) “energy conservation” standards that will significantly increase the acquisition price of manufactured homes. Those standards, as noted by a May 9, 2023 Wall Street Journal editorial, deserve to be “killed.” But while the enforcement of the DOE standards has been temporarily delayed, it is no coincidence whatsoever that new manufactured home sales began to show signs of weakness in the immediate aftermath of the publication of the May 31, 2022 final DOE rule and entered negative growth territory a few months later.

That is why MHARR strongly urged the Manufactured Housing Institute (MHI) to file legal action against the DOE rule immediately after its May 31, 2022 publication. While MHI ultimately did file suit against the DOE rule, it waited until February 2023 to do so, leaving more than eight months for fear and concern over the cost-impact of the DOE rule to overtake the market and help collapse sales far below previous levels. Weakness and delay in Washington, D.C., accordingly – especially in the representation of the post-production sector of the industry – has helped to fuel the present decline and will continue to hamper the industry without further change. Decisive action to address and resolve these matters is needed and long overdue.

High profile member of both major political parties have been saying for years that the “system is rigged.”  The popular alternative media website, ZeroHedge, which features business, stocks, and political news, recently asserted that the U.S. stock market is openly rigged in part by Federal Reserve actions. Investopedia recently featured an article on the topic of the “Illusory Truth Effect.” The Merriam Webster Word of the Year for 2022 was gaslighting.  Among the announced Democratic candidates for their party’s nomination for the presidency in this election cycle, the top alternative to Joe Biden is Robert F. Kennedy Jr., J.D., (RFK Jr.) who is the nephew of the assassinated President John F. Kennedy and son of the slain Senator Robert F. “Bobby” Kennedy.  RFK Jr. has spoken openly about what he called a “corporate kleptocracy” that is leading to a new style of “corporate feudalism.” Republican presidential nomination hopeful Vivek Ramaswamy, a successful entrepreneur, claims that Joe Biden’s mental and fitness challenges they “are a feature,” not a problem, for his puppet masters in the “managerial class.” Approaching two years ago, Warren Buffett told CNBC that politicians want more power and so do businesses. Previously, Buffett was quoted as saying that his class, the wealthy class, had been waging class warfare for years and that his class had “won.”

 

Agree with RFK Jr, on holding then President Donald J. Trump accountable for the lockdowns, or not, is a debatable point. For instance, it is counterintuitive for Trump to have done lockdowns to benefit Amazon, when Amazon founder Jeff Bezos opposed him and supported Joe Biden.  That noted, sifting the wheat from the chaff the broad picture being painted is that in subtle to bold ways, the system is rigged in favor of wealthy corporate insiders. Kennedy and others across the left-right spectrum reveals the thinking of millions who are tired of a rigged system. While downplayed by many in mainstream media, RFK Jr has polled at similar levels to Governor Ron DeSantis (FL-R), who is hailed as the Trump alternative by his supporters. Shouldn’t that make Kennedy the Democratic Biden alternative? Kennedy’s themes include a pledge to ‘end the corrupt merger of state-corporate power that is threatening a new feudalism’ in America.

Understanding Modern Manufactured Housing in the Context of a “Rigged System”

Against that brief backdrop, manufactured housing a year ago was roaring. Per MHARR on 6.3.2022: “Just-released statistics indicate that HUD Code manufacturers produced 10,165 homes in April 2022, a 10% increase over the 9,244 new HUD Code homes produced during April 2021. Cumulative production for 2022 now totals 39,835 homes, an 11.5% increase over the 35,723 homes produced during the same period in 2021.” Contrast that with this month’s sobering data, again per MHARR above.  “Just-released statistics indicate that HUD Code manufacturers produced 6,676 new homes in April 2023, a  34.3% decline from the 10,165 new HUD Code homes produced in April 2022. Cumulative production for 2023 is now 27,850 homes, a 30% decrease from the 39,835 homes produced over the same period during 2022.” MHARR elaborated by saying the following.

MHARR points the finger in part at the Manufactured Housing Institute (MHI). Is that fair? Consider the facts. MHI themselves say that they represent “all segments” of manufactured housing. MHI has said that they have “clout.” If you want “clout,” MHI said industry professionals should look to them. MHARR represents independent producers.  MHI represents both production and “post production.” Finance and zoning/placement issues are post-production issues. Nevertheless, MHARR teamed up with MHI in 2000 and 2008 to get favorable legislation passed that was supposed to solve the very problems that manufactured housing is now facing.

MHI shows that they have ‘access’ through photo opportunities and videos.  This flashback below is an example that reminds longtime readers, while informing newcomers, that this pattern has been occurring for years.

Investigators are trained to seek an answer to the question, cui bono? Who benefits from a certain situation? Buffett made clear early on that Clayton’s lending would be held in portfolio by Berkshire. That plan would backfire if the FHFA enforced the law on DTS. Allen is embraced as a “contributing editor” for MHI supported MHInsider.  Restated, there are ‘establishment’ manufactured housing trade media that routinely regurgitate the talking points of MHI and their corporate masters.

While the thrust of this definition is fine, it is mistaken to think that paltering began in the medieval period. Paltering literally dates back to the incident in the Garden of Eden when the slippery serpent, a stand in for Satan the Devil, told a sly half-truth to Adam and Eve in order to tempt them to break the one and only commandment that God had issued up to that point in time. Do not eat the fruit of the tree in the center of the garden. One commandment, and humans couldn’t keep it.

 

Applying the notion of paltering to the Biden Fact Sheet, MHProNews noted that tall talk of antitrust action has not been followed up by muscular and successful antitrust action. MHProNews predicted shortly after that Biden White House Fact Sheet was published that it would lead nowhere in terms of effective antitrust action. In the nearly two years since, that prediction has come to pass. How could we know? Because an understanding of paltering, posturing, and the fact that Biden and company were unlikely to bite the hands that have enriched them. Compare the recent statistics with what Cavco Industries (CVCO) William “Bill” Boor, their president and CEO, had to say in response to analyst Gregory Palm’s important inquiry. “I think everybody is trying to get a sense for why at least [manufactured housing] industry production data was so weak. And not just calendar Q1, but March [2023] specifically.” Like it or not, there are several apparent disconnects between what Boor said and what the emerging reality is. Pro-MHI sources have said for months that a turnaround is coming. Where is it? MHARR has pointedly documented that the downturn has gained speed. In doing so, MHARR referenced some of the same data that MHProNews recently pointed out that manufactured housing is still in decline while conventional housing is beginning to adjust and recover to higher rates. The case is made in the report above posted yesterday, and supported by the data in this report today, that Boor et al are paltering. That may lead to concerns if they are making material misrepresentations and/or omissions to investors as well as manufactured home industry professionals. The fact that others aren’t hammering away at this speaks volumes. Three different attorneys, all looking at manufactured housing, have raised concerns that need to be grasped in part through the light of industry underperformance.

Why the cloak and dagger, wink and a nod behavior? Why should manufactured housing be allowed to underperform?  How do consolidators benefit from that pattern?

As manufactured home industry production plummets, marginal firms or those pondering their future may opt for an exit. That exit is likely to occur in the context of selling out to a consolidator that routinely happens to be members of MHI. It was some 7 years ago that this writer for MHProNews, in the context of an educational discussion at the Tunica Manufactured Housing Show, offered to put an MHI official on a panel discussion in front of a live audience of industry professionals. No one at MHI accepted. FACT SHEET: Executive Order on Promoting Competition in the American Economy

  • For decades, corporate consolidation has been accelerating. In over 75% of U.S. industries, a smaller number of large companies now control more of the business than they did twenty years ago. This is true across healthcare, financial services, agriculture and more.
  • That lack of competition drives up prices for consumers. As fewer large players have controlled more of the market, mark-ups (charges over cost) have tripled.  Families are paying higher prices for necessities—things like prescription drugs, hearing aids, and internet service.
  • Barriers to competition are also driving down wages for workers. When there are only a few employers in town, workers have less opportunity to bargain for a higher wage and to demand dignity and respect in the workplace. In fact, research shows that industry consolidation is decreasing advertised wages by as much as 17%Tens of millions of Americans—including those working in construction and retail—are required to sign non-compete agreements as a condition of getting a job, which makes it harder for them to switch to better-paying options.
  • In total, higher prices and lower wages caused by lack of competition are now estimated to cost the median American household $5,000 per year.
  • Inadequate competition holds back economic growth and innovation. The rate of new business formation has fallen by almost 50% since the 1970s as large businesses make it harder for Americans with good ideas to break into markets. There are fewer opportunities for existing small and independent businesses to access markets and earn a fair return.  Economists find that as competition declines, productivity growth slows, business investment and innovation decline, and incomewealth, and racial inequality widen.
  • When past presidents faced similar threats from growing corporate power, they took bold action. In the early 1900s, Teddy Roosevelt’s Administration broke up the trusts controlling the economy—Standard Oil, J.P. Morgan’s railroads, and others—giving the little guy a fighting chance. In the late 1930s, FDR’s Administration supercharged antitrust enforcement, increasing more than eightfold the number of cases brought in just two years—enforcement actions that saved consumers billions in today’s dollars and helped unleash decades of sustained, inclusive economic growth.”

All on Capitol Hill were welcoming and interested in manufactured housing related issues. But Congressman Al Green’s office was tremendous in their hospitality. Our son’s hand is on a package that included a copy of the Constitution of the United States and other goodies. Tamas has grown considerably since this photo was taken. He is now an impressive, often thoughtful, teen.
