It would have been difficult to imagine just a few years ago that state officials would go to court to argue to limit the rights of their own citizens to free speech. After all, free speech was considered so important in American history from its earliest days that after winning the Revolutionary War against England, the 13 independent states would not commit to the U.S. Constitution until the Bill of Rights – the first ten amendments – was added to it. That was then. Now, there are nearly two dozen states where public officials became involved in a move to fight for the authority of public officials to limit the free speech rights of their own state citizens. Which tees up the all too serious headline question. Are you living in, and/or doing business in, a state that is effectively trying to undermine the U.S. Constitution and its protection of individual rights?

That noted, in Part I of today’s report, is the following from the WND News Center to MHProNews. It is based on the work of a constitutional law professor, who is cited in that report. That said, note that for balance and accuracy, in Part II issues related to Democrats trying to marginalize other Democrats will be examined, because the constitutional attorney is question is Jonathan Turley, who has become quite popular on Fox News. Turley recently did an X-post (i.e.: ‘tweeted’) in part the following: “The Democratic Party that I was raised in and supported…” Turley, a longtime Democrat, is under fire by other Democrats over free speech and other Constitutionally guaranteed rights. That detail is not explicitly mentioned by WND’s important report shared in Part I below.

That stated, the list of states involved in this stunning move by public officials to limit the free speech of their citizens includes roughly half of the country’s population. So, there are good odds that a sizable share of our readership is living in and/or are doing business in one of those states.

There now is a definitive list of states where officials want to be able to censor their residents, controlling what they claim is “misleading information.”

And all 23 are led by Democrats.

The list comes courtesy of constitutional expert and popular legal commentator Jonathan Turley, a renowned law professor at George Washington University who not only has testified as an expert before Congress but has represented members in court.

“For years, we have discussed the alarming shift in the Democratic party on free speech with candidates running on pledges to censor opposing views and politicians supporting blacklisting and censorship on social media,” he explained. “Many citizens oppose such efforts to restrict their rights under the First Amendment, but are unaware of the work of their representatives to limit free speech. Now, a filing in the Supreme Court supporting censorship efforts by the Biden administration has supplied a handy list of the anti-free speech states for citizens.”

The legal filing comes in the case Missouri v. Biden in which a district court judge ordered the government to stop coordinating censorship campaigns with social media companies. That ruling is on hold now while the U.S. Supreme Court considers the facts.

The district judge who originally ruled in the dispute, Terry Doughty, charged that, “The United States government seems to have assumed a role similar to an Orwellian ‘Ministry of Truth.'”

In the case, the evidence shows Biden administration officials would pick a comment they disliked, then complain to one of several foundations or organizations. Those groups then would lobby social media companies until those comments were censored.

Turley noted, “The 5th Circuit previously ruled in Missouri v. Biden that administration officials ‘likely violated’ the First Amendment and issued a preliminary injunction banning the government from communicating with social media companies to limit speech.”

He explained California “is leading the effort to get the Supreme Court to reverse a decision enjoining the government from censorship efforts. California has long sought to impose speech limits on doctors, businesses, and citizens to silence opposing viewpoints.”

But he said other Democrat-led states also have joined “this ignoble effort in signing on to the brief of California Attorney General Rob Bonta. ”

He said, “The brief lauds past efforts of these states to combat ‘harmful content’ on the Internet and to protect the public from ‘misleading information’ through partnerships with social media companies.”

The list includes: Arizona, Colorado, Connecticut, Delaware, Hawaii, Illinois, Maine, Maryland, Massachusetts, Michigan, Minnesota, Nevada, New Jersey, New Mexico, New York, Oregon, Pennsylvania, Rhode Island, Vermont, Washington, Wisconsin and [the] District of Columbia. ##

Those disclosures and examples noted, it would be foolish at best to ignore the political trends that have manifest themselves in the U.S. in recent years.

  •  “Stop militarism, stop the corruption, secrecy, and the cronyism, that was the function of the freedom of press.” So said Robert McChesney, Communications Professor, Author & Journalist.

Each of those three quotes and related insights go to the heart of the mission of journalists to properly and accurately report the truth yet admit that such is routinely not the case in contemporary American journalism.

Note too that the evidence suggests that each of those quoted above – and others that will be cited in that pending special report – are apparently voices from the political left. Journalists, per recent research, are many times more likely to be self-declared Democrats than Republicans. According to recent research, which is likely to be covered here soon, while many reporters declare themselves to be “independent” politically, that source said that many who say they are independent are in fact far more likely to be Democrats in their orientation than Republican. The bottom line is that mainstream journalism which routinely features reports by those with a left-leaning bent is being critiqued by others who are themselves leftists.

So, while there are obviously supporters among Democrats for what amounts to online and other forms of censorship, there are also those who are critical of the practice, like Turley.

This lurch left is oddly driven by big businesses, big tech, big media, and the billionaires who back big government and other forms of monopoly power. As evidence of the reaction against that much of the public has become skeptical or critical of monopoly power. Trust in media is also at a low ebb, per Gallup.

There are those who have accused us, rightly or wrongly, of having our own bias. Well, duh. Even giant Facebook admitted in a legal proceeding that when it supports so-called fact checkers that those fact checkers have a bias. Once someone is self-aware enough that they recognize their own bias, efforts can be made to balance that out. That’s true for many professions which deal with the public.

That said, once more the first job of journalism is supposed to be to tell the truth. Related to that are other qualities noted by the American Press Institute (API), the Society of Professional Journalists (SPJ) in its Code of Ethical Conduct, and so on.  We tend to give more information, more details than other sources who publish, not only in manufactured housing, but in mainstream media in general, regardless of the political bias of a given publisher. Those points made, it would arguably be negligent to not report on issues that threaten the livelihood and rights of much, if not essentially all, of our readers. The 2024 election is not an election year that millions can afford to sit out. In a practical sense, everyone that fails to vote, for whatever reason, is essentially casting a ballot in favor of the very troubled status quo.

Trump upended the Bush-family and Establishment lock on the Republican Party.

That doesn’t mean that the Establishment isn’t fighting back against Trump, of course they are.

But it does mean that a clear majority of Republican voters are now apparently aware of the problems under the Bush flavor of Republican leadership, and they rejected it. 

The MAGA or “America First” side of the “Grand Old Party” (GOP or that alternate name for Republicans) is similar in some respects to what Teddy Roosevelt and John Sherman believed when they rejected the monopolistic tendencies of the elites in the country.

A Pending Switcheroo?

Several pundits and politicos believe that growing criticism of Joe Biden in left-leaning publications is a signal that the Democratic Party “super delegates” will pull a rule on their own voting base and select someone to be that party’s nominee who is currently not running. This may explain why California Governor Gavin Newsome (D) has been playing up his profile on the national stage, and why some think that Michelle Obama could possibly emerge despite neither being an official candidate. Other names are floated among Democrats too.

But the point that perhaps millions of registered Democrats and Democratic leaning independents don’t realize that their party’s rules allow for a last minute change despite whatever their voters may say ought to be one more factor that shocks the consciences of those who claim that they are ‘democratic.’ As former Democrat and 17 year award-winning CNN journalist turned WMAL radio show (9-12 ET M-F, broadcast through syndicated affiliates) pundit Chris Plante has paradoxically and sarcastically said, “the Democratic Party isn’t [i.e.: isn’t democratic].”

If millions of people vote out of habit and thoughtlessly, or if too many stays home and don’t vote, it is entirely conceivable that the big corporate grip over the Democratic Party and the levers of power in the U.S. that makes this lurch to the left possible could succeed. There needs to be a sense of urgency to share with your circle the realities being reported on MHProNews and MHLivingNews.
