Manufactured Housing Institute (MHI) Claims Priorities Addressed in Congress’ Year-End Legislative Package, Pros and Cons Fact Check, Analysis; plus MHVille REITs, Stocks Update

Facts and hard-hitting fact checks, said an active manufactured housing industry executive, are critical for the manufactured housing industry to achieve its true potential. “Facts are stubborn things,” according to Mark Weiss, J.D., to MHProNews, was a remark he learned in law school. The pre-Christmas emailed “Housing Alert” ‘news’ update from the Manufactured Housing Institute (MHI) sparked several remarks that will be examined below. Minus their footer items, the bulk of the MHI ‘news update’ will be provided to readers. Following the self-congratulatory MHI missive will be some remarks by an industry insider to MHProNews under the additional information with more analysis and commentary segment of this report. A special section will then be provided. The final segment will be the manufactured home industry connected equities, including MHVille REITs and other stocks, along with the signature left-right mainstream and market-moving headline news recap on MHProNews.

 

I. MHI’s “Housing Alert” news for 12.23.2022

MHI Priorities Addressed in

Congress’ Year Legislative Package

Congress has passed a massive $1.7 trillion year-end legislative package including $58.2 billion to fund the U.S. Department of Housing and Urban Development (HUD) in 2023, a $4.5 billion dollar increase from 2022. MHI has been working closely with Congress and the Administration to ensure the interests of the manufactured housing industry are considered in any year-end legislation. Below are provisions included in the package, which reflect MHI’s work with Congress to address key policy priorities:

 

Directive to HUD to Substantively Engage with the Department of Energy on Efficiency Standards for Manufactured Housing

The omnibus package includes a directive to HUD to substantively engage with the Department of Energy prior to the implementation of the DOE energy standards for manufactured housing to ensure the new standards are cost-effective with respect to housing affordability. During the recent meeting of HUD’s Manufactured Housing Consensus Committee (MHCC), the MHCC rejected the incorporation of the DOE energy standards into the HUD Code by reference and instead drafted specific language incorporating the DOE standards into the HUD Code that fit with the realities of manufactured home construction. Following that meeting, HUD told Congress that “the industry will face significant challenges in complying with the implementation timeline set by DOE.”

 

New HUD Funding for Manufactured Housing Community Preservation

The spending package includes a new $225 million grant program at HUD for the preservation and revitalization of manufactured housing communities. Grants would be awarded through a competitive process and program funds could be used for infrastructure improvements, resident and community services, land and site acquisition, and other activities. The program specifically reserves $25 million for a pilot program to assist in the redevelopment of manufactured housing communities and the replacement of pre-1976 mobile homes. Per MHI’s advocacy, HUD has the discretion to include private entities as eligible applicants. Other eligible applicants include states, local governments, Tribes, nonprofits, community development financial institutions (CDFIs), resident-owned manufactured housing communities and co-ops.

 

Incentives for States and Localities to Make their Zoning Policies More Inclusionary

The spending package allocates $85 million to HUD for a new grant program to encourage state and local jurisdictions to improve inclusionary zoning practices and land use policies. Recipients of Community Development Block Grant funding would receive bonuses for working to remove barriers to housing production, such as by increasing density, reducing minimum lot sizes, streamlining or shortening permitting processes and timeline, expanding by-right multifamily zoned areas, allowing accessory dwelling units on lots with single family homes, and donating vacant land for affordable housing development. HUD is also directed to issue best practices for local, state, and regional agencies to improve such opportunities.

 

Directive to HUD to Update FHA’s Financing Programs for Manufactured Housing

The package includes a directive to HUD to continue to review FHA financing guidelines for all of its manufactured housing mortgage programs to modernize policies to reflect today’s market and improve the availability of this housing financing option. This language is a part of MHI’s advocacy strategy to make long-needed FHA program updates a reality.

 

Increase in Funds for the Manufactured Housing Program and Directive to HUD to Finalize HUD Code Updates

The spending package includes $14 million for the Office of Manufactured Housing Programs, which is a $1 million increase from 2022. Congress also included a directive for HUD to prioritize clearing the backlog of unpublished Manufactured Housing Consensus Committee (MHCC) recommendations, specifically calling on HUD to finalize the fourth and fifth sets of HUD Code updates. In July, HUD proposed the fourth and fifth sets of changes to the HUD Code. MHI submitted recommendations to HUD about the proposed changes and the Department is currently reviewing all the comments it received on the proposal. The package calls for final publication of these fourth and fifth set changes within 30 days.

 

II. Additional Information with More MHProNews Analysis and Commentary

An industry insider told MHProNews that he personally knows “at least” 5 or 6 veteran manufactured housing industry HUD Code builders who would go back into the production business. What would that take? Per that source, if the manufactured housing industry’s production returned to “close” to the 200,000 annual new manufactured home shipments level, they would be back in.

Another remark was that active and prior manufactured home builders are routine readers of MHProNews. One of them said that “only Tony” “that guy in Florida” among the manufactured housing industry’s publishers and bloggers is willing to hold MHI accountable.

In fairness, it should be apparent that the Manufactured Housing Association for Regulatory Reform (MHARR) also publishes association news and views as part of their mission to represent the interests of manufactured housing independents. To quote MHARR, “The Manufactured Housing Association for Regulatory Reform is a Washington, D.C.-based national trade association representing the views and interests of independent producers of federally-regulated manufactured housing.”

Speaking of MHARR, another comment shared with MHProNews was that the MHARR White Paper ought to be compared to what MHI said in their latest report. For that and other reasons, the MHARR 2022 White Paper – published in Washington, D.C., on July 25, 2022 – will be provided in its entirety, for readers to consider the validity of those remarks. By “industry” MHARR is pointing their finger directly at MHI.

True blue MHI believers are arguably less common than some may think. As MHProNews recently reported, SimilarWeb data has unmasked anew how lightly read MHI’s own members follow them. Prior to providing this from SimilarWeb, it should be noted that some sights will be more accurately reflected by their data, and others less so. SimilarWeb methodology statement on their website explains why.

That said, here is what MHI’s engagement levels are like, per SimilarWeb. As MHProNews previously reported, the traffic and engagement on our smaller site, MHLivingNews, towers over that of MHI. Then, our MHProNews site totally towers over MHLivingNews which means it totally smokes MHI.

The Monopolistic Housing Institute, err, Machiavellian Housing Institute site, oops, Machiavellian Housing Institute (MHI) – dang it – Manufactured Housing Institute (MHI) website traffic is dropping, per SimilarWeb data on the date and time shown. Their traffic, compared to information claimed by MHI some years ago, is falling in that comparison too. The engagement rate once someone arrives at the MHI website is poor, as the pages per visit suggest that only about half of those arrivals read one page beyond the home page. The implications of such embarrassing facts to MHI and their leaders ought to be many. But one possible takeaway is that their posturing, paltering, and propaganda are not playing even with the audience of their own member companies’ employees. Another possible takeaway? That MHProNews’ fact-checks, analyses, and MHVille expert commentaries are having an obvious impact. MHI can ‘hide’ on one level, but it is apparently suffering for its lack of direct responses to MHProNews’ direct, substantive, and informed inquiries. Nor can the impact of MHARR’s  published insights be overlooked. MHARR’s website is far newer. They have a much smaller staff. MHARR has less content (newer site). MHARR has a tiny fraction of MHI’s budget. Nevertheless, per reliable information, MHARR’s website gets significantly better engagement than MHI does. That is the flip side of the evidence and analysis on MHI. 

Behind the Scenes Facts, Insights, Reams of 3rd-Party Research on Manufactured Homes and ‘Mobile Home’ Controversies–MHLivingNews to MHI Data-MHVille 2022 in Review I; plus, MHREITs-Stocks Update

 

What makes that embarrassingly low 14,800 visitors monthly to MHI’s website almost comical is this. Clayton Homes, arguably their largest producer by far said in their annual report that they have almost 20,000 team members. The MHI/SimilarWeb data implies that if every Clayton employee visited the MHI website once a month there would be 20,000 visits, not 14,800 as SimilarWeb reports. MHI claims 1000 member firms. So, by implication from such data, the vast majority of MHI’s own member-employees do not check in on the MHI website. That is further supported by the poor level of response to MHI’s ‘call to action’ to ‘write your congressman’ on the too little, too late, MHI-backed bill that is obviously NOT going to achieve its goal — see those facts and analysis at this link here, per evidence from Gov.Info and Skopos Labs.

Additionally, SimilarWeb’s data indicates that the typical visitor to the MHI website visits a tepid 1.00 minute on average (perhaps doesn’t even read, given only a 1-minute average time on site) and only 1.52 pageviews per visit.

That data above is an apparent slap in the face of MHI and their credibility. Why? Because they claim over 1000 member firms. MHI has previously said that there are some 75,000 full time equivalent (FTE) employees in manufactured housing. If so, then the vast majority of industry professionals ignore MHI’s website.

MHI’s self-congratulatory message should be considered in the light of the MHARR White Paper. Their White Paper pointedly accuses MHI of engaging in a phony PR campaign that is long on talk and short on results. That will follow shortly for those who may have missed it or need a refresher. Because MHARR has gone step by step through the industry’s history in recent years to explore what MHI has, and has not, authentically accomplished.

MHProNews will editorially note with the benefit of multi-decade hands-on manufactured housing industry expertise the following 3 broad points about MHI’s remarks. In no particular order of importance:

  • 1). MHI fails to mention the lack of planned or actual litigation to get the Manufactured Housing Improvement Act (MHIA) of 2000’s “enhanced preemption” provision enforced. If MHI did such a fine job engaging Congress, supposedly on behalf of ‘all segments’ of the industry, then why is it that MHI didn’t insert an item into the bloated $1.7 trillion dollar omnibus bill language that would require HUD to enforce “enhanced preemption” or suffer some meaningful penalty?
  • 2). MHI fails to mention that Warren Buffett, Kevin Clayton, and Clayton Homes executives like prior MHI Chair Tom Hodges boasts about their moat. The moat has been called a slow motion monopolization method. A regular attendee to MHI meetings for years has been Doug Ryan, with Prosperity Now (formerly CFED). Ryan publicly ripped MHI for failing to pursue more chattel lending for manufactured housing. Lesli Gooch responded, but in hindsight, Gooch’s remarks are revealed to be more window dressing. MHI keeps talking about the same issues, but fails to actually accomplish what they claim they want to see done. No wonder they have to reach for a laundry list of items they say are grand tucked into a bloated Congressional bill that are not their own self-proclaimed priorities.
  • 3). MHI fails to admit that they should hold themselves responsible for the Department of Energy (DOE) regulations of manufactured housing energy standards which are scheduled to go into effect in 2023. As the official Federal Register said, “Compliance with the adopted standards established [by the DOE] for manufactured housing in this final rule is required on and after May 31, 2023.

Three claimed MHI issues. Three obvious MHI big misses on achieving their stated goals. Also not mentioned by MHI in the above is that manufactured housing production declined in the most recent monthly data. Such evidence underscores MHARR’s white paper, and renders MHI’s apparent paltering, posturing, deception and misdirection all the more obvious. Note that IF MHI were achieving their goals, or even if MHI were initiating lawsuits – perhaps in conjunction with MHARR? – MHI’s website traffic would likely rise significantly. But after over two decades of talk on some issues and still no progress by MHI, it makes their credibility among the informed minimal.

Additionally, MHI fails to note that despite the Biden-Democratic hype about “inclusion” and a housing plan that mentions manufactured housing several times, that third-party evidence reveals that housing is in retreat in the Biden era. By contrast, the Modular Home Builders Association Tom Hardiman had the chutzpah to call out a prior package as packed with political payoffs. When will MHI grow similar testicular fortitude? Washington, D.C., July 25, 2022 – The Manufactured Housing Association for Regulatory Reform (MHARR) has published a research White Paper (copy attached –attachment 1– attachment 2) which exposes a decades-long pattern of public relations exploitation — by the supposed representative of “all segments” of the manufactured housing industry — of laws and government benefit programs which purportedly include federally-regulated manufactured housing but, in fact, fail to achieve or deliver results on the ground for either the industry or consumers.

For many years and at an increasing pace, the erstwhile “national” representative of “all segments of the manufactured housing industry” has touted the supposed inclusion of manufactured housing within various housing, housing finance and community assistance programs of the federal government as an alleged benefit for the industry and consumers, and supposed testament to its reach and prowess.

As the MHARR White Paper indicates, however, that alleged inclusion – as well as the “benefits” supposedly flowing from such inclusion – are largely illusory, for both the industry and the lower and moderate-income American consumers who rely on high-quality, affordable and energy-efficient manufactured housing. Simultaneously, this disconnect is one of the main reasons that industry production is mired near the 100,000 homes per year level, despite unprecedented nationwide demand for affordable housing.

The reason for this disconnect, as the White Paper illustrates, is that even though Congress has generously provided – through multiple laws — for the equitable inclusion of manufactured housing in such benefit programs, that inclusion rarely, if ever, translates into the realization of corresponding benefits on the ground due, principally, to the same factors that inhibit and restrict the utilization of HUD Code manufactured housing more broadly – i.e., exclusionary and discriminatory zoning and the absence of meaningful, market-significant support for manufactured housing consumer loans by Fannie Mae, Freddie Mac, the Federal Housing Administration (FHA) and the Government National Mortgage Association (GNMA). Consequently, while benefits through such programs are nominally “available” to manufactured housing consumers, their scope and impact is undermined by the same policy failures that constrain and limit the industry more broadly.

The White Paper thus concludes that rather than seeking to take advantage of (and exploit for public relations purposes) the nominal inclusion of HUD Code homes in federal housing and housing assistance programs – with little or no matching benefit(s) on the ground — the industry should instead be focused on taking specific, aggressive and positive action in order to promote, advance and ensure the full and effective implementation of such programs – on the ground – so that the honorable and legitimate intentions of their supporters in Congress are fulfilled, rather than subverted by discriminatory policies and outright defiance.

In Washington, D.C., MHARR President and CEO, Mark Weiss, stated: “If an organization is going to take credit for representing all segments of the industry, it should be held accountable for the job that it does in relation to all segments of the industry, and whether its words are consistent with and properly representative of its actions. Legitimate accomplishments merit praise, but there is – and should be – no place for empty posturing, seeking credit for alleged accomplishments that achieve nothing concrete or even worse, convey a false pretense of accomplishment while doing nothing of substance to advance either the industry or its consumers. Therefore, rather than continuing to accept empty posturing, the industry should demand proper and legitimate accountability and measurable progress for the industry in living up to its full potential.” Weiss concluded, “The MHARR must-read White Paper sets the direction as to how the industry’s post-production sector can — and indeed, must — fully and properly implement these outstanding laws and programs that congress has generously provided for consumers of affordable housing and the manufactured housing industry”
