For various reasons, the joint news release that follows below from the U.S. Department of Housing and Urban Development (HUD) and the Federal Housing Finance Agency (FHFA) was not published on 8.12.2021 when the announcement occurred. At times, such delays in publishing prove to be beneficial, because other information develops that sheds light on the original statement. Such was the case with this joint announcement by HUD and the FHFA, which will be followed by a challenge made by key manufactured housing advocates. HUD and FHFA Announce Collaboration to Advance Fair Housing and Fair Lending Enforcement

Washington, D.C. – Today, the U.S. Department of Housing and Urban Development (HUD) and the Federal Housing Finance Agency (FHFA) (collectively, the Agencies) entered into a first-of-its-kind collaborative agreement regarding fair housing and fair lending coordination. Under the Memorandum of Understanding (MOU), the two Agencies will focus on enhancing their enforcement of the Fair Housing Act, which HUD is primarily charged with administering and enforcing, and their oversight of Fannie Mae, Freddie Mac (the Enterprises), and the Federal Home Loan Banks (collectively, the regulated entities), all of which FHFA regulates.

The MOU is an important mechanism that strengthens the Agencies’ ability to enforce fair housing and fair lending requirements, by promoting information sharing, coordination on investigations, compliance reviews, and the ongoing monitoring of the Enterprises. The Agencies anticipate that the MOU will lead to stronger oversight that will help advance vigorous fair housing enforcement that can begin to redress our nation’s history of discriminatory housing practices.

Dear Secretary Fudge and Acting Director Thompson:

On behalf of federally-regulated manufactured housing producers and the HUD Code manufactured housing industry as a whole, we are writing to thank you and congratulate you on the establishment of the August 12, 2021 Memorandum of Understanding Between the U.S. Department of Housing and Urban Development and the Federal Housing Finance Agency Regarding Fair Housing and Fair Lending Coordination (MOU).

As you know, and as we have previously communicated with both of you, manufactured housing, regulated by HUD, is the nation’s most affordable source of non-subsidized housing and homeownership – particularly for lower and moderate-income families. Moreover, as has recently been documented by the Consumer Financial Protection Bureau, manufactured housing, and particularly manufactured homes financed through home-only personal property loans, are a significant housing resource for American minority communities.

Yet, the availability of manufactured housing and the affordable homeownership that it provides — for all Americans — has needlessly, baselessly and discriminatorily been subverted by local zoning mandates that exclude or severely restrict the placement of manufactured housing, as well as a lack of available and fully-market-competitive consumer financing, resulting from the longstanding refusal of Fannie Mae and Freddie Mac to provide secondary market and securitization support for manufactured housing consumer loans, and particularly manufactured housing personal property loans.

Existing federal law, however, together with the Fair Housing Act and the August 12, 2021 MOU, provides HUD and FHFA with ample authority to address and correct these destructive limitations which undermine federal housing policy as established by Congress, as well as the economic justice principles of the Biden Administration. In particular, the enhanced federal preemption provision of the Manufactured Housing Improvement Act of 2000 provides HUD the authority to override discriminatory local zoning exclusions, while the Duty to Serve Underserved Markets (DTS) provision of the Housing and Economic Recovery Act of 2008 (HERA) provides FHFA with the authority to ensure that Fannie Mae and Freddie Mac support all elements of the manufactured housing consumer finance market in a market-significant manner.

Through the August 12, 2021 MOU, HUD and FHFA can now simultaneously and effectively address both of these baseless, discriminatory and indefensible constraints on the manufactured housing market and the availability of affordable manufactured housing for all Americans but, most especially, lower and moderate-income families who rely on manufactured housing as their main source of affordable housing and homeownership.

We urge you to utilize the instrumentalities of the MOU aggressively in pursuit of the federal housing objectives established by Congress through the 2000 manufactured housing reform law, DTS and HERA, and take concrete steps to eliminate existing discrimination against manufactured housing owners and purchasers.

Attached, for your information and follow-up, is a copy of a communication from the Manufactured Housing Association for Regulatory Reform (MHARR) to HUD Secretary Marcia Fudge and Federal Housing Finance Agency (FHFA) Acting Director, Sandra Thompson, regarding the important agreement between the two agencies announced on Friday, August 13, 2021 (see copy attached).

The Memorandum of Understanding (MOU) between these two agencies provides yet another opportunity and basis for concrete action by both, to address and resolve the two main impediments to the greater utilization of HUD Code manufactured housing — i.e., discriminatory and exclusionary zoning restrictions, as well as the unavailability of fully-competitive consumer financing for purchasers of  federally-regulated, affordable manufactured housing. As the letter indicates, federal law provides a strong basis to address these fundamental post-production failures, through the enhanced federal preemption of the Manufactured Housing Improvement Act of 2000 (42 U.S.C. 5403(d)) and the “Duty to Serve” provision of the Housing and Economic Recovery Act of 2008 (12 U.S.C. 4565).

We urge other industry members and organizations to share these concerns — and their importance to the industry and consumers — with the leadership of both federal agencies.

There are certain niceties that virtually all trade associations use. Both MHARR and the Manufactured Housing Institute (MHI) will from time to time use the politically correct language of ‘congratulating’ and ‘thanking’ some federal official(s). What follows after those polite terms of political speech can be far more important than those opening words of greeting. In fairness, that flowery lingo leans on the notion that it is easier to catch flies with honey than vinegar.

That noted, thus far MHARR is the only trade association in manufactured housing that is know to have made such a statement to HUD and FHFA. Perhaps MHI has and has simply not revealed their dazzling display of genius on behalf of the consolidators of manufactured housing.  Because thus far, there is no known statement by MHI that corrects their demonstrable deception and misdirection that was exclusively highlighted by MHProNews in the report shown in the report linked below.

MHI has restricted their emails to non-members.  As the report above made clear, MHI’s emails to members/non-members are demonstrably deceptive at times in a manner that should spark federal investigation and possible fines, other regulatory action, if not prosecution under RICO, the Hobbs Act, etc.

The Florida Manufactured Housing Association (FMHA), after the reports linked below, stepped up and issued a press release that took a noteworthy step toward promoting the image and understanding of manufactured housing during an affordable housing crisis.

Last but not least. For those who believe in big government and its self-proclaimed value, the events of the last week and month should make it clear that it is all an illusion. A quick review will illustrate.

  • Decades of death, wounds, a trillions spent in Afghanistan have suddenly vaporized. Did the markets react negatively? Hardly. After all, the military-industrial-spy complex rolls on despite victory or defeat.
  • The HUD-FHFA MOU is a de facto admission that what they claim has not occurred that they aim to fix through this collaboration has gone unaddressed since the Manufactured Housing Improvement Act (MHIA) of 2000 was enacted. While the rate of homeownership ticked up during the Trump Administration, the overall trend of home ownership in the U.S. is lower today than in 2000 when the MHIA was signed into law. Yet, as MHARR’s communications made clear, the purpose behind the MHIA was to make more affordable housing – specifically more affordable manufactured homes that routinely do not require federal subsidies available.
