COVID19 Shutdowns! “The Great Barrington Declaration,” SCOTUS Constitutional Rights Ruling

It isn’t just Clayton Homes that have suffered COVID19 related shutdowns earlier this year as well Skyline Champion (SKY) more recently. Millions of restaurants, bars, clubs, gyms, and places of worship have periodically – and sometimes for weeks on end – government ordered closures. It is not just giant companies such as Walmart, Amazon, or Target that magically seem to be exempt from such business limiting edicts from government official under the guise of COVID19.

When law enforcement visited a Hobby Lobby earlier this week, based on an order from NM Governor Michelle Lujan Grisham (D) they ordered it closed and the shoppers were ordered out of the store. Hobby Lobby became known for its religious values during their pushback against certain provisions of ObamaCare during the Obama-Biden Administration. Fox 14 in El Paso reported that the NM Gov. Grisham’s order applied to: “non-essential big box stores like Hobby Lobby and Ross” that “were ordered to close.” But also “Gyms, indoor malls, salons, spas, tattoo shops, pet grooming, recreational facilities, museums, ‘big box’ stores that don’t sell food, and on-site dining (only to-go and delivery allowed) must be closed.”

Such closures might be easier for larger firms to weather. But for smaller companies, they could be a death knell. As noted, earlier this year, certain states like Pennsylvania took steps that impacted a range of manufactured home connected firms. American civil liberties, gun rights, religious liberties, the rights of businesses, workers, and other citizens are coming into question – all “due” to the global pandemic.

What was initially accepted in the spring of 2020 when the Wuhan Coronavirus pandemic was new and not well understood has since been met with increasing resistance by citizens and independent business owners in cities and states across the USA. That patterns if also playing out in other nations around the world. Places once praised for how they handled the “Crimson Contagion” – see reports here and here – are now seeing a surge of cases, not unlike what the USA is undergoing.

Despite bipartisan federal emergency legislation that resulted in trillions of dollars in borrowed spending given to idled workers and businesses in the U.S., large numbers of independently owned businesses have suffered or closed in 2020. Did you mean: how many U.S. businesses are closed forever due to the Wuhan virus global pandemic. The Muncie Star Press on 11.27.2020 encouraged readers “How to support local businesses impacted by COVID-19 this Small Business Saturday” noting that “163,735 total U.S. businesses on Yelp had closed,” saying that “The business struggled heavily due to the virus in May…” Other sources put the figure of the number of closed business far higher.

While American unemployment was at historic lows in early January 2020, in just a few short months, there was rates of unemployment not seen in our nation since the Great Depression. While some states like South Dakota, Iowa,  that handled the pandemic differently are at only 3.6 percent unemployment, the national average after months of “recovery” by some buy ongoing shutdowns and businesses limitations hovers around 6.9 percent. KVTO in Des Moines, Iowa said that only Nebraska and Vermont have a lower unemployment rate than Iowa and SD. Most of those states took a far less stringent stance toward COVID19 related shutdowns.

Still, that national 6.9 percent unemployment rate reflects a sharp economic recovery from where the nation stood at the bottom of the China Virus induced recession. Higher unemployment rates are often found in so-called ‘blue states’ where Democratic public officials are seemingly more prone to shutting down independently owned firms, churches, and places of worship.

For those who don’t know or need a reminder, medical professionals in Communist China, often at great risk to themselves and their families, spoke out regarding the origins of the disease, which now many believe was from a bio-weapons lab in the Wuhan Institute of Virology. In the wake of civil unrest that broke out following the gruesome death of George Floyd, plus the COVID19 pandemic, hundreds of thousands are reportedly fleeing metro areas.  Senator Rand Paul (KY-R), along with his wife and others, were threatened after a White House Republican event last summer recently said that federal officials were not going to probe the source of the funding for those groups.

 

 

That noted, months before, third-parties had already done such research, which MHProNews compiled and reported on in the article with sources and details cited that is linked below. On just one of our dozen-plus servers, this report linked below has logged well over 1.5 million hits.  That’s an astonishing total, given that manufactured housing pre-COVID19, only had an estimated 75,000 full time employees, per the Manufactured Housing Institute (MHI) and Cavco Industries (CVCO).

In so-called blue states – i.e. those with more Democrats in positions of political authority – as well as red states (more Republican ones), there is a growing sense among businesses regardless of their political affiliation that they are not getting the protection and support that their tax dollars are supposed to be paying for safeguarding. Additionally, the loss of jobs and the financial pressure on businesses tied to prospects for affordable manufactured housing and other professions is steadily eroding.

 

 

With the very real possibility that a Biden-Harris Administration may emerge as the declared if not the actual winner of the 2020 presidential contest, there is an increased angst that far more smaller businesses may be crushed in the regulatory as well as COVID19 related ‘public health’ pronouncements.

Meanwhile, big tech, big media, many of the billionaires on Wall Street are watching their wealth soar. By accident and/or design, where lockdowns are ordered, big businesses tend to win, and their owners or main stockholders are watching their wealth soar.

SCOTUS Ruling

It is against that backdrop that the recent Supreme Court of the United Stats (SCOTUS) ruling against NY Gov. Mario Cuomo’s harsh treatment of places of worship provides a ray of hope for not only religious liberties, but other Constitutionally protected rights.

In a 5-4 split that reversed a stance prior COVID related case earlier this year while the late Justice Ruth Grader Ginsburg was still alive. “The [Supreme] court’s action was a victory for the Roman Catholic Church and Orthodox Jewish synagogues that had sued to challenge state restrictions announced by Gov. Andrew Cuomo on Oct. 6,” said ABC7. “The Diocese of Brooklyn, which covers Brooklyn and Queens, argued houses of worship were being unfairly singled out by the governor’s executive order.”

ABC7 said that “Avi Schick, an attorney for Agudath Israel of America, wrote in an email: “This is an historic victory. This landmark decision will ensure that religious practices and religious institutions will be protected from government edicts that do not treat religion with the respect demanded by the Constitution.”

Cardinal Timothy Dolan, Archbishop of New York, tweeted, “I’d like to congratulate @BpDiMarzio and the @BrooklynDiocese on their victory for religious freedom in the U. S. Supreme Court. Our churches are essential. While we have been and will continue to adhere to all safety protocols to protect our communities, it is also important to protect that fundamental Constitutional right, religious liberty.”” – also per ABC7.

Two lower courts had allowed Cuomo’s order to stand. But Gov. Cuomo pushed back on the ruling, saying “The decision isn’t final, in the first place. It goes back to the second circuit appeals court, so its not even a final legal decision.” He called the decision “irrelevant,” which may suggest that he will continue to press his position.

NY Gov Cuomo said the courts conservative majority – with the justices appointed by President Trump all supporting the religious liberty stance – took the opportunity to make an ideological point.

You have a different [Supreme] court,” the governor said. “And I think that was the statement the court was making.”

The SCOTUS case arguably points to the battle which could loom if Biden-Harris prevail in the various legal challenges seeing mounted by the Trump Campaign. Even if Biden Harris takes the keys to the White House, but if they fail to capture the last two seats in contention for the U.S. Senate, there is much that they could do through executive fiat. If Biden-Harris win and Democrats take the two seats up for grabs in the January 5, 2020 senate runoff election in GA, then a range of possible legislative moves could emerge that would arguably dilute the political power of smaller businesses and workers.

That is a useful backdrop to the Great Barrington Declaration, which sheds light on the medical/public health side of this controversy.

 

The Great Barrington Declaration

MHProNews has previously noted that there is NOT a consensus among medical professionals and scientists about the best way to handle the COVID19 pandemic. The Lancet, a medical website reporting on respiratory illnesses, said on November 24, 2020 that In early October, 2020, three epidemiologists convened in Great Barrington, a small town in Massachusetts, USA. Jay Bhattacharya (Stanford University Medical School, Stanford, CA, USA), Sunetra Gupta (University of Oxford University, Oxford, UK) and Martin Kulldorff (Harvard University, Cambridge, MA, USA) were there to draft an argument for a new strategy to combat COVID-19. They called it the Great Barrington Declaration. It has since been endorsed by thousands of medical practitioners, researchers, and public health scientists.”

The following Great Barrington Declaration was originally issued on October 4, 2020 and was initially signed by hundreds of medical and scientific professionals. Since then, some 50,000 such professionals globally have signed onto “The Great Barrington Declaration” statement.

The Great Barrington Declaration

The Great Barrington Declaration – As infectious disease epidemiologists and public health scientists we have grave concerns about the damaging physical and mental health impacts of the prevailing COVID-19 policies, and recommend an approach we call Focused Protection.

Coming from both the left and right, and around the world, we have devoted our careers to protecting people. Current lockdown policies are producing devastating effects on short and long-term public health. The results (to name a few) include lower childhood vaccination rates, worsening cardiovascular disease outcomes, fewer cancer screenings and deteriorating mental health – leading to greater excess mortality in years to come, with the working class and younger members of society carrying the heaviest burden. Keeping students out of school is a grave injustice.

Keeping these measures in place until a vaccine is available will cause irreparable damage, with the underprivileged disproportionately harmed.

Fortunately, our understanding of the virus is growing. We know that vulnerability to death from COVID-19 is more than a thousand-fold higher in the old and infirm than the young. Indeed, for children, COVID-19 is less dangerous than many other harms, including influenza.

As immunity builds in the population, the risk of infection to all – including the vulnerable – falls. We know that all populations will eventually reach herd immunity – i.e.  the point at which the rate of new infections is stable – and that this can be assisted by (but is not dependent upon) a vaccine. Our goal should therefore be to minimize mortality and social harm until we reach herd immunity.

The most compassionate approach that balances the risks and benefits of reaching herd immunity, is to allow those who are at minimal risk of death to live their lives normally to build up immunity to the virus through natural infection, while better protecting those who are at highest risk. We call this Focused Protection.

Adopting measures to protect the vulnerable should be the central aim of public health responses to COVID-19. By way of example, nursing homes should use staff with acquired immunity and perform frequent PCR testing of other staff and all visitors. Staff rotation should be minimized. Retired people living at home should have groceries and other essentials delivered to their home. When possible, they should meet family members outside rather than inside. A comprehensive and detailed list of measures, including approaches to multi-generational households, can be implemented, and is well within the scope and capability of public health professionals.

Those who are not vulnerable should immediately be allowed to resume life as normal. Simple hygiene measures, such as hand washing and staying home when sick should be practiced by everyone to reduce the herd immunity threshold. Schools and universities should be open for in-person teaching. Extracurricular activities, such as sports, should be resumed. Young low-risk adults should work normally, rather than from home. Restaurants and other businesses should open. Arts, music, sport and other cultural activities should resume. People who are more at risk may participate if they wish, while society as a whole enjoys the protection conferred upon the vulnerable by those who have built up herd immunity.”

The Great Barrington Declaration website says on today’s date – 11.27.2020 – that: “12,372 medical & public health scientists” and another “36,443 medical practitioners” have signed the online document.

The points from the above are many. It includes the notion that there is no consensus that what some called “the draconian” lockdown approach is actually more harmful than helpful, on a practical level. But in addition, there are also legal and constitutional arguments. Finally, and not to be forgotten, the origin of the virus is China. There are small businesses that announced a multi-trillion in lawsuits against the Chinese Communists, because they were the origin of the COVID19 virus.

Last but not least, there are reasons to wonder what Archbishop Carlo Maria Viganò, former papal nuncio to the U.S. during the Obama-Biden Administration, meant by his warning of COVID21 following COVID19. Was the mere speculation? Or does Viganò, who as a longtime diplomat would have access to information that most would lack, know something is coming in the way of a new Chinese originated virus? Note that the Jewish Post cited Viganò’s statement, which is one of many examples of non-Catholic, non-Christian sources of interest in the matter.
