Comprehensive Housing Plan to Create Affordable Units, Increase Supportive and Senior Housing, Advance Homeownership Opportunities and Make Homes More Environmentally Friendly

Governor Kathy Hochul today announced the launch of a comprehensive, $25 billion housing plan in the historic FY 2023 State Budget. The Budget includes a bold $25 billion, five-year housing plan that will create or preserve 100,000 affordable homes across New York, including 10,000 with support services for vulnerable populations. The Enacted Budget will also make continued major investments to build new supportive housing, preserve existing multifamily developments, construct new homes for seniors, create new opportunities for first-time homeowners, and improve energy-efficiency across the state’s current housing stock.

“Creating and maintaining affordable, safe, secure homes for New York’s families, seniors, veterans, adults with special needs, and individuals experiencing homelessness is a cornerstone of my administration and this year’s Budget builds on that commitment,” Governor Hochul said. “These comprehensive investments are vital to serving low- and moderate-income renters and homeowners, preserving and protecting our existing housing stock, investing in manufactured homes and parks across the state, and assisting those experiencing housing insecurity, and I thank the legislative leaders for their work in helping ensure these historic investments.”

Governor Hochul is building on the success of the state’s current housing plan with the creation of a new $25 billion, five-year plan that will focus on economic recovery, social justice, climate action, and improved digital connectivity.

The plan is comprised of $5.7 billion in capital resources, $8.8 billion in State and Federal tax credits and other federal allocations, and $11 billion to support the operation of shelters and supportive housing units and to provide rental subsidies.

This also provides for the electrification of an additional 50,000 homes as part of the state’s plan to electrify one million homes and make another one million electrification-ready.

Highlights of the plan include:

    • $1.5 billion for the creation and preservation of supportive housing that provides individuals and families that need supportive services and are experiencing homelessness or housing insecurity with the on-site resources they need to thrive and live independently;
    •  $1 billion for new construction of multifamily affordable housing to help individuals and families find new opportunities to live affordably;
    • $450 million to preserve existing multi-family rental housing that will serve to strengthen existing affordable housing across the state and allow individual and families to remain stably housed;
    • $400 million to advance homeownership opportunities across the state, especially in historically underserved markets, and to give low-income families the opportunity to have the dream of first time homeownership;
    • $300 million for senior housing to help older New Yorkers age in place safely in homes that meet their health needs in the communities they love;
    • $250 million for a nation-leading electrification fund to improve energy efficiency in low-income housing units;
    • $220 million for Mitchell-Lama developments across the state to preserve affordability and make important long-term capital improvements as well as the creation of permanently affordable homeownership;
    • $200 million to preserve public housing outside New York City – this housing often serves the lowest-income New Yorkers and is need of capital investment; and
    • $105 million to preserve rural rental properties, and mobile and manufactured home parks.

The FY 2023 Enacted Budget will also address several additional key housing priorities such as $350 million in capital improvements for the New York City Housing Authority and $100 million for the Housing Our Neighbors With Dignity Act to convert vacant commercial properties and distressed hotel properties across the state.

Furthermore, $85 million in funding will help bring current accessory dwelling units across the state — including basement apartments, garage units, and backyard cottages — into code compliance and improve safety for these alternative housing options.

$50 million has been allocated for Land banks to purchase and redevelop vacant or abandoned properties to better serve the public interest.

$35 million will be dedicated to create an Eviction Prevention Legal Assistance Program to make free legal counsel more readily available to low- and moderate-income tenants to defend against eviction proceedings.

$35 million will support the state’s Homeowner Protection Program which will help ensure that New Yorkers do not have to face the loss of their home because they do not have legal assistance or qualified housing counseling.

The Rural Preservation and Neighborhood Preservation Programs will receive their first increase in funding since their inception more than 40 years ago. By providing more than $18 million in funding, the programs will be open to more Neighborhood and Rural Preservation Companies who provide local, frontline support for housing needs in communities and neighborhoods throughout the state.

A total of $36 million will go to the New York State Affordable Housing Corporation (AHC) to increase homeownership opportunities for low- and moderate-income families by providing grants to governmental, not-for-profit and charitable organizations to help subsidize the cost of newly constructed houses and the renovation of existing housing.

The state’s Fair Housing Testing Program will be provided an additional $2 million in order to increase the ability to proactively investigate suspected housing discrimination and to enhance education and outreach efforts on fair housing rights and requirements to landlords, tenants, real estate professionals, and local governments.” … ##

 

Additional Information, More MHProNews Analysis and Commentary

MHProNews contacted the New York Governor’s Office media contact with manufactured housing specific questions about this program announcement. They declined further comment.

MHProNews also contacted New York Housing Association (NYHousing), which is the Manufactured Housing Institute (MHI) state affiliate in that state. Manufactured housing specific inquiries were made with them. They too declined comment, though MHProNews routinely gets replies from other public officials, attorneys, experts, and other nonprofit organizations and numbers of manufactured housing professionals.

Given the lack of clarity with respect to manufactured housing in their release, it is not clear what the NY Governor Hochul plan for manufactured home communities might mean. Nor is it clear if other aspects of their plan may allow manufactured housing to be used instead of perhaps conventional construction. But it is at a minimum, subject to interpretations, their plan is a potential threat to various aspects of the industry. It may also be that their office declined comment because the details would have looked bad in the eyes of the industry’s sober professionals.

 

NY Related Data, Housing and Manufactured Housing Facts

Information obtained by IBTS which they gather under contract with the U.S. Department of Housing (HUD), the primary federal regulatory for manufactured housing indicate that in February 2022, a total of only 150 manufactured homes were shipped inside New York State.

According to the U.S. Census Bureau, the “Population of NY on April 1, 2020 was 20,201,249.”

Per Wikipedia, New York statistics include the following factoids. “With a total area of 54,556 square miles (141,300 km2), New York is the 27th largest state geographically. With 20.2 million residents, it is the fourth most populous state in the United States as of 2021, with approximately 44% living in New York City and another 14% on the remainder of Long Island.”

  • “New York needs more housing of all types and at all scales in both the city and in the suburbs,” said CBCNY.org.

The Census Bureau conventional construction report shows data by region, and in NY is in their Northeast Region. In the NE region, some 11,500 units of “New Privately‐Owned Housing Units Completed” in January and February of 2022.

Another 201,400 “New Privately‐Owned Housing Units Under Construction at End of Period” of February 2022. 36,400 more units of housing were authorized, but not yet started in February 2022 in the NE region.

Clearly, the potential for affordable manufactured housing sales in New York State, or in dozens of other states across the nation, are vast.

But as the Manufactured Housing Association for Regulatory Reform (MHARR) has argued for years, local zoning and placement regulations are often barriers to more manufactured home construction. This is despite the fact that MHI joined with MHARR and a coalition of state association led by the Texas Manufactured Housing Association’s late Will Earle in the late 1990s to collaborate on a plan that was enacted into law under the Clinton Administration. The result was the Manufactured Housing Improvement Act (MHIA) of 2000. The MHIA included language that aimed to element zoning and placement barriers.

Lawmakers involved in that process said that HUD under the George W. Bush (POTUS #43-R) Administration was failing to use its enhanced preemption authority.

MHProNews obtained exclusive comments in 2021 from the late William Wade “Bill” Matchneer, the first administrator under the MHIA in the Office of Manufactured Housing Programs (OMHP) about the MHIA, before he succumbed to cancer.

Matchneer, an attorney, said in one message that his interpretation of the law was that the MHIA could preempt local zoning barriers.

Matchneer also told MHProNews that while his office issued several preemption letters, these were ideally issued by Office of General Counsel. Per Matchneer, Office of General Counsel (OGC) declined using that preemption authority.

Nor were those the only times that Matchneer, often spurred by MHProNews input, reacted to evolving events to clarify what was going wrong at HUD with respect to the MHIA. Some of those statements occurred in a context that were arguably embarrassing to MHI.

But when Gooch or MHI were asked to get involved legally in specific cases to take legal action on preemption, MHI has routinely failed to do so. MHARR offered to partner with MHI state affiliates during the Trump Administration. Per MHARR, no state took them up on their offer.

Tiny houses have not federal preemption rights, yet IJ has crafted a case to get the rights of citizens to buy or live in a tiny house enforced. Which begs the question. Why is MHI, and apparently there state association affiliates unwilling to get the pro-manufactured housing MHIA law enforced?

While MHI may say positive things, they apparently fail to do what the logic of their own statements indicate is necessary. Namely, to robustly promote manufactured housing, educate the public in an effective way on manufactured homes, and protect the industry when regulatory or other forces are seemingly an obstacle. Yet, P.E.P. is the cornerstone of an umbrella trade organization, such as MHI claims to be.

In investigating the possible motives for MHI’s failure to act, a look at some of their dominating brands and larger board members that are publicly traded, a pattern in their public statements to current or potential investors emerges. That pattern?

They routinely use language that indicates their desire to consolidate smaller firms under their respective corporate umbrellas.

In short, there is evidence that MHI has been posturing for years, but has in fact been working on behalf of consolidators. Those consolidators apparently are okay with low production rates, even though companies and groups – such as Cavco Industries (CVCO – have indicated that the industry could be rivaling conventional housing numbers.

Bill Boor is correct in saying that the industry has an opportunity to ‘catch up’ – or even pass – conventional housing builders. But that opportunity existed 2 decades ago too. That means, that until the root issues are addressed, authentic progress will not be obtained. That noted, by addressing the root issues robust growth can occur.

MHI’s prior president and CEO, Richard “Dick” Jennison, after experiencing a bout of foot in mouth disease in 2014, when he openly stated that the industry should grow slowly.  Jennison later reversed course in 2015 following, an inquiry by MHProNews.

 

 

After that MHProNews inquiry and communication with Tim Williams, President and CEO at 21st Mortgage Corporation, Jennison flip-flopped. He told dozens of industry professionals that the industry ought to be aiming for 500,000 shipments, not a mere 100,000 or 372,000 new units annually.

Jennison signed IRS form 990 statements that clearly indicate that the trade group claims to be working to grow the market for manufactured housing.

This may be one of the most important documents to federal investigators or others who are probing manufactured housing’s historic underperformance in the 21st century.

Those statements are first examined by board members before being filed. Restated, there are potentially several levels of legal response possible. Who says? Samuel “Sam” Strommen for Knudson Law. In Strommen’s outsider looking in probe of manufactured housing, he came to the conclusion that MHI was also failing to do as claimed, and that consolidators were benefiting. He asserted there is evidence of “felony” antitrust and possible RICO violations in manufactured housing. Strommen further asserted that MHI should be barred from a Noerr Pennington defense if someone takes the trade group to court, because of their egregious behavior.
