“State of Emergency” GOP Governor Ron DeSantis Asked by Democratic Lawmakers to Declare Affordable Housing Crisis Emergency; plus, Manufactured Housing Equities, Markets Updates

MSN and Yahoo News have amplified a report by WPBF reporter Steve King. King said, Two dozen Democratic lawmakers are calling on Gov. Ron DeSantis to take action on what they call “the affordable housing crisis.” State Rep. Carlos Guillermo Smith (D-49) sent this letter to DeSantis on Thursday, urging him to declare a state of emergency regarding unaffordable housing and asking the governor to direct the attorney general to impose limitations on rent hikes of more than 10%.”

Dear Governor DeSantis,
As you are certainly aware, many residents throughout our state are being denied the freedom to be healthy, prosperous, and safe due to an ongoing affordable housing crisis. According to the latest data from the Bureau of Labor Statistics, four of the bottom ten largest metro areas in the country for wages are in Florida, with the Orlando metro area ranking dead last.

As the $15 minimum wage amendment passed in Florida last year comes into effect, many Floridians are struggling to keep up with the soaring cost of housing due to years of lagging wage growth that forced voters to take action. In Central Florida, rents have increased by 20% since January, in South Florida rents have risen by an average of 14% across the board, and the Tampa Bay region has seen a staggering 24.8% increase in rental prices since July, the largest increase in the nation. According to data compiled by Apartment List, only 2% of apartments in Tampa cost less than $1,000 a month.

Additionally, Florida has been extremely slow in getting rental assistance out to those in need, significantly trailing other large states. This inaction has put many people who could be helped on the brink of eviction.

In a state which has swept more than $2.3 billion from our affordable housing trust fund since 2001, this has led to an unsustainable situation for too many working Floridians. In fact, the National Low Income Housing Coalition’s The Gap report shows that 40% of middle-income households in Florida are costburdened when it comes to housing, with that number rising to 89% of extremely low income households, meaning they are paying more than 30% of their income each month in rent.

This situation is no longer sustainable as Floridians simply cannot afford Florida.

We are calling on you to use your authority as Governor to declare a state of emergency in Florida for housing affordability. As the state’s chief executive, and as has been demonstrated many times throughout the pandemic, the Florida Constitution gives your office wide latitude to protect our state in times of crisis.

This moment surely meets that definition.

While under a declared state of emergency, Florida statute 501.160 applies price gouging protections to rental prices of a “dwelling unit” retroactive to 30 days prior to the declaration. That is why in order for Floridians to gain relief during this state of emergency, we are asking you to use your powers to meet this extraordinary crisis by:

  • Waiving the 30 day cap and extending it to the past 12 months, and;
  • Directing the Attorney General to recognize any rental prices increases of greater than 10% as price gouging.

As the Florida Housing Coalition currently estimates that our state faces a deficit of 344,000 affordable housing units, we ask that you continue this state of emergency until the housing needs of all Floridians have been met.

During this holiday season, and after the incredible hardships that the pandemic has brought on so many Florida families, we believe that no child should worry that they and their parents will be evicted due to predatory rental prices increases. Those hard working Floridians who have been on the frontlines throughout the pandemic who you have highlighted many times deserve to know they will have a roof over their heads after the exemplary service they have provided to our state.

“The Governor’s budget recommendations have provided full funding for the affordable housing trust funds every year he has been in office, which includes record funding levels in the Freedom First budget recommendations for the upcoming fiscal year. Additionally, Governor DeSantis vetoed the sweep of the affordable housing trust fund included in the current year budget and recommended appropriation of those funds for affordable workforce housing programs to expand access to homeownership.

“Attempting to insert the emergency powers of the Executive to manipulate prices in the market is likely to do more harm than good. In fact, federal government overreach is a major cause of affordable housing shortages nationwide in the first place. Recall that the CDC eviction moratorium continued for more than a year, distorting the market and incentivizing landlords to raise their rents to make up for lost income.

“Perhaps Representative Smith should instead raise his concerns about the rising cost of living with his fellow Democrats, who control Congress and the White House. By enacting irresponsible policies and reckless spending at the federal level, the socialists who call themselves Democrats are driving up the prices of necessities across the board.

“Inflation harms all Americans – especially lower-income families. Governor DeSantis is committed to doing everything he can to alleviate this pressure on Florida families. In addition to the affordable housing funds in his budget recommendation, the governor has proposed $1 billion in gas tax relief, pay raises for teachers and law enforcement personnel, and other policies that help Florida remain free, prosperous, and full of opportunity. Moreover, the governor has fought to protect Floridians’ jobs and small businesses, whereas Democrats like Rep. Smith support economy-killing lockdowns and believe that woke corporations should have the power to fire workers over vaccine mandates.

“Governor DeSantis has always recognized the importance of recommending significant resources in the state budget for increasing the development and availability of affordable housing. The Freedom First Budget provides $355.5 million to fully fund the Sadowski Affordable Housing Trust Funds.

  • $95 million for the State Apartment Incentive Loan (SAIL) Program, and

This weaves the unstated threads between the representatives of the two major parties in Florida cited above toward a solution.  Because neither a form of rent control nor ‘more money’ for affordable housing programs have worked for 50 years in solving the affordable housing crisis, as a report by HUD cited below makes clear.

We plan to spotlight your report and that letter from Democratic lawmakers to Gov. Ron DeSantis today. That said, I’d like to encourage you to do a follow up. If you don’t mind, let me share some insights that may prove eye-opening.

The thrust of the statements by Democratic lawmakers and in your report are correct. However, it would benefit from the obvious need for more new housing construction.  Economics 101 tells us that prices are rising due to a supply and demand imbalance.

A few third-party research items will lay the foundation.

 

1) On 9.7.2021 HUD’s Pamela Blumenthal and Regina Gray published this report.

That HUD report makes a stunning admission that most mainstream media (no offense, this is our speciality, and reporters are routinely stretched and pressed for time) missed the above. Here is a compelling pull quote. I’m adding the highlighting.

“Federally sponsored commissions, task forces, and councils under both Democratic and Republican administrations have examined the effects of land use regulations on affordable housing for more than 50 years. Numerous studies find land use regulations that limit the number of new units that can be built or impose significant costs on development through fees and long approval processes drive up housing costs. Research indicates higher housing costs also drive up program costs for federal assistance, reducing the funds available to serve additional households.”

Restated, the causes and cures for the housing crisis have long been known. But for 5 decades, there is talk without sufficient follow through, regardless of who is in the White House.

 

2) Then consider what HUD Secretary Ben Carson said in 2019.

Dr. Carson laid out compelling housing facts, the truth about manufactured housing vs. merely the dated myths. That includes the obvious point that there has to be more new housing production because housing demand guarantees sales.

 

3) Note the first oddity. HUD’s Blumenthal and Gray never mentioned manufactured homes, yet HUD is the primary federal regulator. Florida happens to be the #2 state in the U.S. for new HUD Code manufactured home shipments.

4) Marketplace did a recent report that aptly noted that most conventional builders are ‘throttling’ home sales. The reasons to do so are many, from a builder’s perspective. But the impact is insufficient new housing production. Further, numerous sources have observed that only factory home building can close the demand vs. supply gap. Which goes to the rationale behind Dr. Carson’s 2019 statements above.

Note that not long after Carson’s remarks, the Innovative Housing Showcase occurred in Washington, D.C. in June 2019. Tiny houses, manufactured homes, and modular homes were all among the “innovative” options featured.

5) Something neither Carson nor Blumenthal or Gray mentioned is this. Congress was well aware of the affordable housing crisis when in 2000 they enacted the Manufactured Housing Improvement Act of 2000 (MHIA). The 2000 reform act specifically said this was an affordable housing law.

6) Congress also had manufactured homes specifically in mind when the Housing and Economic Recovery Act (HERA) of 2008 enacted as provision the Duty to Serve Manufactured Housing (DTS), rural and underserved markets.  But a look at the Lincoln Land Policy site reveals that 13 years after DTS was enacted, it is still not being properly enforced.

Keep in mind that those who signed onto that coalition included MHI members and periodic coalition partners. But MHI itself did not sign on. Why?

 

7) There are two primary national trade organizations serving manufactured housing professionals. One is an ‘umbrella’ group that says of themselves that they serve “all segments” of manufactured (and modular, factory built, etc.) housing.  That’s the Manufactured Housing Institute (MHI). Then there is the Manufactured Housing Association for Regulatory Reform (MHARR). MHARR says that they are an independent HUD Code manufactured home producers trade group. Zoning, placement, finance – these are post-production issues. So, one might presume that MHI would be taking point. Objectively, MHI and MHARR in their various comments letters to federal officials say superficially similar things.

 

8) But despite MHI’s claims, there is growing evidence that the trade group is adding to the affordable housing crisis by favoring a status quo that fosters consolidation.

9) Let me boil this down to that last document which was meant to be a resource for researchers. Much of this affordable housing crisis comes down to a lack of production. But why? The solutions are known, as Blumenthal and Gray noted for HUD. To that point, the MHIA – 3 years after it was enacted – had Democratic lawmakers asking a Republican HUD Secretary to enforce its “enhanced preemption” provision. On paper, MHI and MHARR seem to agree on this. But MHI has never sued to get this law enforced. MHARR has offered to team up with one or more MHI state affiliates to get the law enforced, but there were no takers.

10) Facts are what they are. If this sounds conspiratorial, there are federal laws that deal with that concern. The late William Proxmire aptly said that when you want to understand what is occurring in Washington, D.C. ‘there are no coincidences’ and ‘follow the money.’ Those are tried and true journalistic and investigators mantras, as you know.

 

11) In 2011 and 2012, Congress held hearings precisely because the MHIA of 2000, with a focus on its enhanced preemption provision, was not being enforced.

HUD’s witness – Henry Czauski – claimed the law was being enforced. Both MHI and MHARR witnesses denied that claim, while admitting there were a few occasions when enhanced preemption for HUD Code manufactured homes were enforced.

12) But MHProNews has an on-the-record statement from the first administrator of HUD’s Office of Manufactured Housing Programs (OHMP), William “Bill” Matchneer, J.D. OHMP was established by the MHIA. Matchneer said that he could not get HUD’s Office of General Counsel to enforce federal preemption.

13) MHI had Dr. Carson addressing their trade group (which as a disclosure, I was a member of for several years, served on one of their boards, before we parted ways). But there is no evidence known that MHI ever asked Dr. Carson in person to enforce so-called “enhanced preemption.”  There are comment letters by MHI that mention preemption, but since when do HUD Secretaries read through hundreds of comment letters? Restated, the evidence based case can be made that MHI postures, preens, and palters without doing the common-sense things that would get good existing laws enforced.

 

14) The upshot? The possible motivation? Consolidation of smaller firms by larger ones.  NPR reported (again) recently about Havenpark Capital, one of several MHI member brands that are accused by residents and advocates of being predatory. MHI has a “code of ethical conduct.” But our sources say there is no known example of that code being enforced. MHI has an antitrust statement. But there is no known example of the apparent antitrust violations being enforced.

 

15) Minneapolis Federal Reserve researchers have alleged that HUD and builders are “sabotaging” manufactured housing as part of a monopolistic ploy. James A. “Jim” Schmitz and his colleagues came at this differently than Samuel “Sam” Strommen with Knudson Law. Strommen called what is occurring in manufactured housing a “Rube Goldberg Machine of Human Suffering.” Both Schmitz and his colleagues are cited in the report linked below that has Strommen’s entire heavily footnoted thesis. Strommen says this is a case of “felony” monopolization conspiracy, and specifically said MHI is part of the conspiracy.

16) That’s a lot to digest. But the point is that the causes and cures of the affordable housing crisis are known. Most industry professionals would say that other steps beyond manufactured housing are obviously part of the solution to the housing crisis.

 

17) Several of the dirty tricks that have occurred in the manufactured housing profession have been reported by mainstream media, but thus far no mainstream media have pulled the various threads together into a comprehensive report that lays out causes and cures.

 

18) The cures amount to proper enforcement of existing laws. That’s the good and the tragic part of it. There is no need to pass new laws. Enforce those already on the books.

 

19) As a closing point. Some when they are first exposed to these fact and evidence patterns wonder, how could this go on for so long? One must keep in mind that in the 21st century alone, there have been numerous major scandals that went on for years before they were finally exposed and dealt with.

20) By keeping capital access limited, the larger players can slowly consolidate the smaller ones. By subtly thwarting the laws that would grow the industry (and thus solve the affordable housing crisis), the case can be made that MHI is benefiting the few at great cost to the many.

 

21) HBO’s Last Week Tonight with John Oliver did a satirical hit misnamed “Mobile Homes” in 2019. The terminology is off, but several of the troubling issues he raised are true enough. Oliver brought several of the predatory elements out. What Oliver did not do is say that a common thread is that these predatory firms are all MHI members.

22) If that is not enough, consider the recent SEC suit filed against MHI member Cavco Industries. It reads like a fictional novel. But it fits the fact pattern outlined above. Those pleadings by the SEC and related are unpacked below.

23) The bottom line for now might be this, from your vantagepoint. This recent letter from Democratic lawmakers to Gov. Ron DeSantis is an opportunity to put both major parties on the spot. The causes and cures are known.

It stands to reason that if state associations, which are routinely MHI affiliates, and MHI were doing their claimed job of working to increase manufactured housing sales, then they would be doing media outreaches like the one above. Indeed, MHI’s prior chairman said as much. Other’s comments about “this isn’t rocket science” – said by Jim Ayotte of the Florida Manufactured Housing Association – are relevant too.

This isn’t a popularity contest. Nor is it contest about laying out sugary sweet commentary that fails to get to the root causes and cures. Manufactured homes are needed in the U.S. But the industry’s front-line advocates on the retailing (post-production) side are clearly not engaged as is necessary to get the good laws enforced that already exist.

A range of tools can be deployed that will over time provide the necessary heat under the ‘leaders’ who claim to be working for industry growth, but when the evidence is carefully examined, are instead effectively keeping the status quo intact. To what end? Consolidation by larger brands of smaller brands. When Sun Communities has to go to England to score their next big Acquistion, that should be a wakeup call for ‘white hat’ manufactured home professionals, affordable housing advocates, public officials, and others.
