In a wide-ranging discussion, one of the points raised was simple and direct. When will the Manufactured Housing Institute (MHI) begin to press for an enforcement of existing federal laws?

Failing that, the same professional pressed – when industry manufactured home independents who hunger for more sales organize to enforce existing industry laws?

That 500,000 new HUD Code home sales potential was reportedly authorized by Tim Williams, 21st Mortgage Corp President and CEO, prior to Jennison making that statement. Rephrased, it was clearly believed to be doable by informed, veteran industry leaders.

There are numerous professionals who are engaged at the Manufactured Housing Institute (MHI) who believe that much more can and should be done to increase sales. Indeed, some are disgusted that the industry has suffered two consecutive years of decline during an affordable housing crisis.

 

One of those voices called MHProNews today. He made a simple case for how MHI could be advancing the industry in a rapid fashion.

 

  • The laws needed for combating zoning and placement issues already exist, he said.
  • It is unacceptable that those good federal laws are not being put to full use.
  • A “Legal Conflict Team” of attorneys should be retained. He said with MHI’s annual budget, this would not be a problem to fund.
  • That Legal Conflict team would be assigned to deal with any jurisdiction that attempts to stop the placement of a HUD Code manufactured home due to a range of common excuses currently made by local governments.
  • He said that just a few victories in various courts – or through threats of launching legal efforts when local jurisdictions begin without cooperation – would rapidly reward the efforts.
  • Additionally, those Legal Conflict Team attorneys should meet with HUD leadership and get them to join in such efforts to enforce the HUD Code.

If MHI won’t do it, that professional said that the industry’s independents ought to organize and do it apart from MHI.

MHProNews listened, made some observations, asked some questions, and mentioned that the report that was in process at the time – linked below the related reports dealt in part with institutional failure.  That failure, the case could be made, was intentional on the part of MHI. How else to explain their lack of effort to do precisely what he was suggesting?

Time will tell if that person decides to pick up a mantle and move such a noble effort ahead by organizing with others to do what he suggested.
