Opening FEA editorial muse. While our family were still living in the Land of Lincoln (the fine state of Illinois), we took a trip to Hawaii’s Big Island. It was a beautiful week. There was only one oddity that we personally witnessed that sticks out at this moment. Just one thing that was less than beautiful in a land of beaches, palm trees, waterfalls, rainforests, hot lava flows and other wonders. It was the scene of rusting white wind turbines off a beach we visited. Wind power has been used successfully for hundreds of years in various parts of the world. But there are good reasons, including environmental reasons, to question how some have been pushing wind energy today. Ultimately, taxation, concerns about crime and other costs were among the factors that pushed us into leaving IL for Florida, where there is no state income tax. Much of FL is a bit like being in Hawaii, only with lower taxes and more affordable housing.  Including far more manufactured homes in FL than in HI. There are places in IL we would gladly visit again and again, if time permitted. Which brings us to states as laboratories of public/political policies and the need for independent vs. corporate media in order to probe areas where corporate media doesn’t seem willing to go.

Hawaii is beautiful but expensive compared to most other states.

1) Let’s be clear and factual. There are examples of corruption and cronyism in so-called red, blue or purple states. But the NYTimes’ Harris has effectively made the point that “liberal” (i.e.: blue or Democratic leaning or solidly Democratic) states are fueling inequality with their own policies. Those polices include, as Harris points out, policies that effect housing.

2) Recently, MHLivingNews explored a key subject. How do leftist, socialist, Marxist policies play out in practice when viewed over time? As it turns out, the math has never supported that socialist-communist worldview. Nor has the history supported socialist-Marxist-Communist policies. This writer has for some time periodically asked people in public places (people not known, so no telling what if any there political, economic, religious, or other views may be) if they are familiar with TANSTAAFL? 3) When we look at social welfare policies, it is routinely the government, meaning the taxpayers, that foot the bill. How is that working out when in 2022 HUD reported a record number of homeless Americans?

 

 

The only year that was worse than 2022 in terms of homelessness was the next one in 2023, per the Biden-Harris (D) era’s own data.

 

 

Then again in 2024, HUD once more reported record homelessness. Biden’s HUD Secretary Marcia Fudge said that ‘homelessness is solvable and should not exist in the United States.’ If that is so, what happened? How many in mainstream media have reported that for three years running, homeless was rising while more money was being spent?

 

 

4) Ironically, or tragically (take your pick), it was HUD Secretary Fudge that pointedly refused to enforce the “enhanced preemption” provision of the Manufactured Housing Improvement Act of 2000 (a.k.a.: MHIA, MHIA 2000, 2000 Reform Law, 2000 Reform Act). This is a matter of video recorded statements. So, why is it that the Manufactured Housing Institute (MHI) has yet to mention this irksome detail, some 4 years after (uploaded on July 22, 2021) MHProNews first reported it?

 

 

5) By contrast, the Manufactured Housing Association for Regulatory Reform (MHARR) has been described by some in the industry as a watchdog as well as an independent producer’s trade group. MHARR, as MHProNews has frequently reported, is on record citing the “enhanced preemption” provision of the 2000 Reform Law scores of times. By contrast, while paying lip service from time to time to federal preemption, MHI fails to have the words “enhanced preemption” on their own website. The contrast between lip service and the absence on their own website of what they claim to be ‘fighting’ for is stark.

 

 

 

6) This isn’t just hypocrisy, as video journalist Harris used that term in the NYT video above. This is arguably duplicitous. Treacherous. And their prior vice chairman and current chairman of the board, William “Bill” Boor, CEO of Cavco Industries is apparently part of the apparently devious ploy of paying lip service to something that they in hindsight clearly had no intention of doing.

 

 

7) This is just one story among many that the mainstream “corporate” media has failed to tell. There are plenty of reports by media professionals about manufactured housing. But so far, perhaps only one journalist this year has taken the time to spotlight the clearly contradictory nature of MHI’s words and behaviors. That would be Rachel Cohen Booth via left-leaning Vox. Note that Cohen-Booth’s report, like many of those on MHProNews, runs thousands of words. It is precisely in the details that such remarkable hypocrisy and duplicity are able to be properly conveyed and displayed.

8) Per that Vox report.

When I asked Gooch why it’s taken so long for Congress to tackle this issue, she acknowledged her group didn’t really start applying pressure until eight years ago.

“In 2017, I had a dialogue with our technical activities committee, and we said, ‘Okay, what is it that we need to do to move manufactured housing forward?’ and the chassis issue was raised,” Gooch recalled. It was then, she said, that MHI started to really discuss how to change the legislation.

9) That was telling. There were no howls from MHI after that was published that Gooch had been misquoted. There are an array of questions that ought to be posed to MHI and their staff/corporate leaders about those two paragraphs. Among them? In no particular order of importance.

• Why did it take until 2017 to ask such a question and to have such a discussion on “what is it that we need to do to move manufactured housing forward?’” Over a decade and a half after the 2000 Reform Law is enacted, and she is asking this question? It appears to be an absurd lie on the face of it. But supposing Gooch spoke the truth, wouldn’t that be worse?
• Unmentioned by Cohen-Booth or Gooch is the 2000 Reform Law and “enhanced preemption” that MHI claims to support, but whose words can’t be found on their own website.

 

 

10) Note that consolidated graphic from the MHI website posted above points to the fact that since about 2018, presumably not long after Gooch claims MHI’s technical activities committee (TAC) said that removing the chassis was the way “forward,” MHI was already failing to have those key words “enhanced preemption” on their own website.

11) According to testimony given on behalf of MHI by Kevin Clayton, CEO of Berkshire Hathaway (BRK) owned Clayton Homes that has been previously reported here, here, and here are the following remarks.

Federal preemption is essential to the manufactured housing industry’s reliance on interstate commerce to produce and distribute housing.  A clear advantage for keeping homes affordable is to utilize a single building code and enforcement system.

Even with Congressional action to significantly strengthen preemption of the HUD Code and its enforcement regulations, HUD has failed to change its outdated 1997 policy guidance on preemption.

Kevin Clayton used the words “preemption” four times. He used the word “enhancing” “federal preemption” among those four.

12) As MHProNews has observed numerous times, Clayton on its own has the legal and financial resources without MHI to sue to get “Federal” “enhanced preemption” enforced.  So too does Bill Boor led Cavco Industries (CVCO). So too does Equity LifeStyle Properties (ELS) or Sun Communities (SUI), or Champion Homes (SKY), to name but a few of those with the resources to accomplish that goal, IF for some reason MHI declined to do so.

13) MHARR has raised the legal action topic for years. But they made it a formal part of their record in 2019, for example, when they reported that neither MHI nor MHI linked state association would join them in an effort to force the first Trump Administration to implement the 2000 Reform Law’s “enhanced preemption” provision.

 

 

14) Any mainstream reporter could easily take the information compiled above, double check it with the original and provided sources, and do an expose on these relevant housing related topics. But so far, none have done so. Why not?

15) Because as the Saturday 8.30.2025 report in the Daily Business News on MHProNews (see below) reflects in detail, corporate media often has an agenda. Who says so? Those with a long history in corporate media. But it isn’t just media, it apparently includes powerful platforms in big tech too. Don’t miss that report, or the others.

16) MHARR is in the process of getting a FOIA on the question of communications between Teresa Payne and MHI prior to her leaving the U.S. Department of Housing and Urban Development (HUD) to join MHI announced in May of 2025.

 

 

17) MHARR is doing what MHI won’t because doing so could reveal their apparently duplicitous behavior during more than 2 decades. When did MHI pivot from sincerely seeking enhanced preemption enforcement to merely posturing and occasionally talking about it? That is a matter of research, gathering interrogatories, taking testimony under oath, and possible cross-examination in court if such a case would be brought to a civil or criminal trial. But one might make the case that it started around 2002-2003, when Warren Buffett led Berkshire Hathaway (BRK) began to buy up pieces of the manufactured housing industry. Instead of making the industry grow, the industry has demonstrably trended smaller since those dates.
