“The administrative repeal of the DOE standards and termination of any parallel HUD rulemaking is essential because a bill by Rep. Erin Houchin (R-IN) – supported by MHARR – which would have fully repealed not only the 2022 DOE “final” manufactured housing energy standards, but also the EISA statutory mandate for such standards, has been significantly and incomprehensibly weakened in the pending housing legislation promoted by the Manufactured Housing Institute,” states the press release from the Manufactured Housing Association for Regulatory Reform (MHARR). Attached for your information and review is a May 5, 2026 MHARR communication to U.S. Department of Energy (DOE) Secretary, Chris Wright and U.S. Department of Housing and Urban Development (HUD) Secretary, Scott Turner, amplifying MHARR’s call for the withdrawal and repeal of DOE’s discriminatory and excessive May 31, 2022 “final” manufactured housing “energy conservation” standards and the termination of any and all administrative procedures at DOE and HUD relating to those standards or any variant thereof.

This communication is based upon – and cites – HUD’s May 1, 2026 recission (i.e., withdrawal) of an April 26, 2024 “Final Determination” pursuant to the Energy Independence and Security Act of 2007 (EISA), finding that energy standards derived from the 2021 edition of the International Energy Conservation Code (IECC) would “not negatively affect the affordability or availability” of new single-family homes (other than manufactured homes) financed through HUD and U.S. Department of Agriculture (USDA) programs. MHARR maintains in its communication, that this recission, based on a January 20, 2025 Trump Administration directive to all federal agencies to “pursue ‘appropriate actions to lower the cost of housing and expand housing supply’” is legally and factually indistinguishable from the fatal flaws underlying the May 31, 2022 DOE manufactured housing energy standards (also derived from the 2021 IECC), and that those standards (and all related administrative proceedingsmust similarly be withdrawn pursuant to the same authority, logic and precedent.

In non-particular order of importance.

1. What follows may not initially seem to relate to the DOE energy rule topic raised by MHARR.

That said, from the now late Doug Gorman authored article for MHProNews’ Industry Voices linked here are the following. For newcomers and as a reminder, Gorman often attended meetings of MHI for years. For context, Gorman authored this shortly after the Atlantic issued their report on IBTS’ research on 4.2.2011: “America’s Fastest-Dying Business? It’s Mobile Homes” which said in part: “Now they [manufactured housing a.k.a. ‘mobile homes] might yet might miss out on the recovery. That makes them [manufactured housing] America’s fastest dying industry, according to a new report from IBISWorld.”

Quotes from the late Gorman to MHProNews.

“I certainly do not have the credentials to refute the recent IBIS report that labeled the manufactured housing industry as being on the verge of extinction. I also approach the subject with some trepidation as I majored in Marketing and I am keenly aware that most of the buggy whip manufacturers are no longer in business.”

“We have had to endure ongoing discrimination of the allocation of lending resources even when the Duty to Serve language is rewritten to specifically cite manufactured housing. As a retailer, I do not see any shortage of willing buyers for the homes that we build. We do experience a series of problems related to recent acts foisted upon us by the federal government.”

I observed in a LinkedIn comment earlier that our industry trade organization, the Manufactured Housing Institute (MHI) is constricted by the composition of their membership from assuming the role of a being a strong advocate for individual industry divisions. Retailers would have to form an independent organization dedicated to retailers in order to have someone in Washington, DC truly going to bat on all the issues that retailers face. I don’t see the numbers or the money being there for that to happen. In the mean time, we accept MHI with its wrinkles, knowing that the diversity of the membership does not allow for the extreme dedication to our needs that we would like to have.

The Manufactured Housing Association for Regulation and Reform (MHARR) serves in that capacity for independent manufacturers and manufacturers need that dedicated representation as they have many issues affecting them that are completely unknown to other industry segments.

Another theory being floated by some industry members is that a conspiracy is in play to undermine the effectiveness that the HUD Code provides and bring about its demise. If that theory is true and if the conspirators have enough influence, market demand will not matter. I am not smart enough to know whether or not a conspiracy exists to destroy our industry. I would say that if it does exist, it is experiencing reasonable success.

2. One must keep in mind that Gorman’s remarks were hardly unique, as his own column stated he was reading something similar on LinkedIn and indicated others were discussing that same concern.

Beyond social media and other musings, there are serious research that points to the notion of what Minneapolis Federal Reserve senior economist James “Jim” Schmitz and several of his colleagues have called “sabotage monopoly” tactics. Note that Schmitz later remarked (see further below) that some in manufactured housing appeared to be taking advantage of the sabotage monopoly tactics within the manufactured housing industry. Neither the late Gorman, nor the researchers that follow, are known to be members of the tin foil conspiracy theory hats club.

Additionally, there is a national class action antitrust case that is pending, involving 8 out of the 11 defendants who are members of MHI. One of those MHI members – Murex Properties – has reportedly agreed to provide documents and testimony as part of a settlement agreement. Is it inexplicable that MHI, and key industry members are deliberately hobbling the industry for their own purposes? Considering that UMH Properties appears to be an outlier at MHI in calling for a tripling of land-lease communities (adding 100,000 to the 50,000 known land-lease communities of all sizes identified by FEMA, per the Lincoln Institute).  For his trouble for calling for a bold expansion strategy, another prominent MHI member – Frank Rolfe – said Landy’s notion was “asinine”

MHI and its members have not yet formally been found guilty of sabotaging for monopolization (or other purposes) manufactured housing. They may never be found guilty of such an allegation. That said, the Murex settlement, the details of which may not been known until it is made public (possibly in September 2026), could prove to be a pivotal moment in the history of concerns raised by people like Gorman, Weiss, Strommen, Schmitz, and others. That may also explain what MHARR said is otherwise difficult to explain. For an objective clarification, that difficult in understanding MHI’s behavior in the last two decades could be clarified if in fact they are striving for a smaller industry that may at some point cease to be HUD Code manufactured housing, a long-speculated notion in MHVille.

You can’t make this stuff up. Allen blasted MHI and several leading MHI firms by name, but was reportedly recruited by Richard ‘Dick’ Jennison for being their surrogate and attack dog and has since been made re-embraced and is now a MHI “member emeritus.” But when his bark or ‘roar’ are examined, there is no bite behind it. Some years ago, for a time, Allen contradicted MHI’s stances publicly.  Allen has never properly explained his flip flops. Per sources, he was rewarded for his attack dog role.

 

Much of MHI’s behavior makes more sense if someone accepts the notion that they are working for the consolidation of what remains of the industry. Even the institutional investors involved behind publicly traded MHI member firms may overlook such concerns, because they routinely have far larger investments in conventional housing and/or real estate.

Our son has grown quite a bit since this 12.2019 photo. All on Capitol Hill were welcoming and interested in our manufactured housing industry related concerns. But Congressman Al Green’s office was tremendous in their hospitality. Our son’s hand is on a package that included the Constitution of the United States, bottled water, and other goodies.
