It is just, moral and thus important to give credit where credit is due. It is equally important to hold people and organizations accountable. There are times when MHProNews (see disclosures) has been a critic of certain voices on the left like Matt Stoller (there are also times when forces or personalities on the right merit the same, as will be explored in Part III). Stoller is the author of the Big newsletter, the book Goliath, and who with David Dayen co-hosts the Organized Money podcast. There is an ancient principle of separating the wheat from the chaff that must be applied to everyone and every source, including this platform. Before separating the often-keen insights from Stoller’s points in Part I, a bit of self-lash and admissions are warranted as MHProNews approaches the completion of 16 years of publishing.

MHProNews expect to be held accountable too. We do more than just publish, and we are documented to have published more than any others in MHVille do. So yes, we do get some typos. Thankfully, our readers seem to get it and give us a pass on that point due to relevant content. The remark above is from an insider at a prominent MHI-linked firm. Mainstream media, with multiple times our budget and staff, get typos too, just not as often. 

The grammar and typing at MHProNews and/or MHLivingNews might be improving but it has never been ideal. The AP Stylebook has never finalized its proper terminology for manufactured housing. But in fairness MHProNews can’t be accused of slavishly following the AP Stylebook either. Thankfully, our readers overlooked those details (thanks again). Additionally, in the early years of our publications, our management frankly did not grasp that a key part of the problems facing the manufactured home industry were internal ones operating within manufactured housing. It isn’t that the management at MHProNews lived with rose colored glasses or had never seen corruption or scams firsthand. We had. But it was not initially understood how corruption and manipulation could be operating at scale within the manufactured housing industry.

That has shifted.

That doesn’t mean that there weren’t (and still are) bad actors outside of our industry in or beyond public officials working to stymie manufactured housing.  Nor can public officials easily ignore the fact that HUD’s own researchers have documented that for 50 years they knew the causes and cures of the affordable housing crisis and the role that manufactured housing could be playing to solve that crisis yet have failed to enforce existing laws that could have accomplished that worthy goal.

There are several forces that have limited our industry to the detriment of tens of millions of Americans that are not directly involved in our industry.

That said, without clarity of vision on limiting forces outside as well as within the often murky boundaries of manufactured housing we as professionals can’t and won’t solve the problems limiting HUD Code manufactured housing for the better part of 25 years.

Greed, lies, and lawbreaking contributed to the slide that began after 1998. Even more cunning and stealthily masked greed, paltering, lies, and manipulation are how the industry was driven to its lowest point in half a century and has been kept at around 100,000 new manufactured homes or less for the past decade. Meanwhile, the Manufactured Housing Institute (MHI) – a favored tool of the consolidators of manufactured housing – and those involved in data and messaging cheerlead despite obvious decades of evidence to the contrary. This later point, a paraphrase in the headline inspired by Stoller as shown in context in Part I will be applied to manufactured housing in this preface and Part II. Stoller’s title is “How to Overturn and Oligarchy.”  Stoller is writing about “concentrated power,” “monopolization” and “coercion.” He writes about how control of data – think control or attempted control over information – is how powerful interests operate our economy.

Restated, Stoller has several key insights, an admission, but still has either blind spots and/or is paltering.

Critiques are not necessarily about slamming a person, party, source, organization, or group. They are necessary for discerning what is true. Who said? How about the late and assassinated President John F. Kennedy (D)?

Critiques are arguably necessary to discern reality on a topic and then hold fast to discerned truth.

Without an objective grasp of the truth, we as a society of nominally free people can’t see the chains dragging the majority of Americans (as well as people in other lands too) down from the type of life that might be enjoyed in the absence of the masked chains of untruth or half-truths.

Without general voices like Stoller’s combined with more specific voices like those at the Manufactured Housing Association for Regulatory Reform (MHARR), James “Jim” Schmitz Jr. and his colleagues, Maris Jensen, Samuel Strommen, Daniel Mandelker, Amy Schmitz and others (MHProNews still has a report pending on financing from a new research source that merits a close look).

MHProNews has been unpacking reports from third-party sources publishing research on manufactured housing such as Northmarq for years. Consider this flashback from April of 2024.

General MHC Trends

The MHC market has become more institutional over the previous cycle, providing potentially lucrative opportunities for savvy investors.

As the wider real estate market cools, manufactured housing communities (MHCs) remain a hot asset. Demand for this type of commercial real estate (CRE) is on the rise, as are rents. Plus, occupancy and cap rates tend to be more stable than their traditional multifamily sibling. Here, we explore the latest MHC developments, including regulatory and rent control issues, as well as investment and financing trends.

With a lack of five-star communities – which are equivalent to Class A in multifamily – available for sale on the market, many MHC investors have been expanding or even breaking their typical investment criteria in an effort to find deals. For instance, those who once only invested in communities with public utilities are now considering private utility deals. Financing is also driving many investment decisions. Some institutional owners are selling tertiary deals to free up capital so they can focus on the primary MHC market, where it’s easier to finance.

Decline of M&P Ownership
A longer-term trend is institutional owners almost eliminating mom-and-pop ownership, which has been going on for the last 15 years or so. Institutional groups over the last cycle have bought out a good portion of the M&P sector of the market, particularly larger mobile home communities with 75 or more spaces.

These are among the topics that are not publicly discussed with clarity by those operating in the MHI orbit who in their own investor pitches may frame that trend as “Expand Portfolio Footprint and Lead Consolidation of Fragmented Industry.” State associations and MHI are a “source [of] Off-Market Acquisitions.”  The Duty to Serve mandated by the Housing and Economic Recovery Act (HERA) of 2008 which was supposed to provide liquidity to finance single family manufactured housing, including chattel financing and land/home mortgages, was somehow turned into “Access to Public Capital Markets [that] Provides a Competitive Advantage.” That’s not a theory, as xAI’s Grok put it. It is directly from the investor pitch of an operator like higher profile MHI member Flagship Communities (TSE: MHC.U).  There is an array of consolidation focused documentation developed by MHProNews which are documents and quotes by MHI’s own members.

Pivoting back to oligarchs – which is Stoller’s 10.8.2025 headline topic in Part I – and the relationship with oligopoly.  JSTOR has a page devoted to this topic (see below). It has been the demonstrable trend in manufactured housing more broadly. Who says? How about Kevin Clayton in his remarks to Congress under truth in testimony certification?

In this mashup, as the headline suggests, Part II will explore ‘all the latest’ in October 2025 according to the Manufactured Housing Institute (MHI). Part III will unpack the relationship between some of Stoller’s remarks, apparent trends in the industry, and will do so using third-party AI for facts-evidence-analysis (FEA) checking purposes.

How to Overturn an Oligarchy

We’ve had some real victories. The FTC is looking into fire truck monopolization, California passed a law against coercion machines, and lobbyists took a big loss last month. America is waking up.

In 1815, John Adams wrote a letter to Thomas Jefferson about the American Revolution. “What do We mean by the Revolution?” he asked. “The War? That was no part of the Revolution. It was only an Effect and Consequence of it. The Revolution was in the Minds of the People, and this was effected, from 1760 to 1775, in the course of fifteen Years before a drop of blood was drawn at Lexington.” Adams cited the legislative records, the pamphlets, newspapers, and the public debates “by which the public opinion was enlightened and informed concerning the Authority of Parliament over the Colonies.”

What Adams wrote has always stuck with me. Those guys fought a war against the most powerful empire in the world, and won, and they did so because they convinced each other a decade earlier, during deeply distressing economic times, that independence from a king was critical to their wellbeing and dignity as free people. And the revolution was the act of convincing, of gaining the self-confidence to declare independence, far more so than the violence of a war. They imagined a new society before they overthrew the old.

I’ve been running BIG for six years, and that’s how I think about this newsletter and our movement. Liberty from concentrated power starts in our own minds, before it happens anywhere else. I believe in public education, because I believe in the public. I never expected to be writing a newsletter on monopoly power; I started writing BIG because I thought it would be a useful way to promote my book Goliath, which was a history of fights over monopoly in the 20th century, and a tacit way to explain to Democrats that President Obama had turned his back on traditional democratic principles. But it turns out there’s a hunger for writing and analysis of how our commercial society works, so I kept it going.

Since the start of BIG, we’ve covered a pandemic, two Presidential elections, a revival of antitrust law, and several major bank bailouts. Despite some very important victories, the trends have been bad in general. The number of billionaires in America has increased by about 25%. The economy is now dependent on consumer spending by the wealthy, as well as an obvious AI bubble with its direction concentrated in the hands of between ten and twenty men. There are many reason for this oligarchical control, but a key one is that since the 1970s, the people have allowed it. We lost our skepticism towards concentrated power, and became deeply confused about why our society is less free.

But I am going to offer a reason for optimism. I believe the American people are learning about the real sinews of power. And there’s data backing that up. Since 2006, every election but one has seen a change in one or both houses of Congress, or the Presidency. And popular faith in big business has collapsed. One law firm that advises on jury selection does polling, and recently found that “the jury landscape has fundamentally shifted. 72% of Americans now see their role as sending messages to corporations—a dramatic increase from 2022.” Americans are seeing the corruption of their society, and they don’t like what they see. That’s good. And they are now realizing that one center of the problem is corporate power.

Such a shift in the mind of the public doesn’t happen all at once. There are over three hundred forty million Americans, each with our own lives and interests and communities. But over the past six years, we’ve been watching in real time, like tiny light bulbs turning on, as different communities learn to see power and coercion they had formerly imagined was part of nature. Over the past month, it happened to “row crop” farmers, angrily watching as their government bails out Argentina’s soybean exporters while their input costs go up. It happened to video gamers last week, when Microsoft did to them what it said it would not: raise prices and lay off game developers after buying Activision. Lots of gamers believed Microsoft was a good actor, now they do not. The lightbulb went on.

 

 

A few years ago, it was people in the cheerleading world, who were dealing with the monopoly Varsity Brands. Cattle ranchers, pharmacists, dentists, chicken farmers, Hollywood producers and talent, Uber drivers, and app developers are starting to get it on a fundamental level. Anti-monopolists in the defense world, metal producers, and even anti-corruption businesses are emerging.

At BIG, we make an argument about politics and commerce. We do the podcast Organized Money, we run Big Tech on Trial to cover the antitrust cases in detail. What we say is garbed in technocratic clothing around markets, but the basic principle is a simple and eternal truth. Arbitrary coercion is immoral. And that principle is enormously powerful, especially when matched to the rule of law. Today, the anti-monopoly language finally exists for the dissatisfied multitude to describe the world they are seeing in useful ways. We haven’t built a politics designed to take this energy and turn it into a majority, but we will. As John Adams noted, revolutions start in the minds of the people.

Ok, so now I want to discuss three small victories that the community around BIG has helped foster. In 2021, I decided to accept paid subscriptions, though nearly all the content is free. So part of what we’ve been able to do is because we have a small amount of capital. Here’s victory number one:

1) Firefighters Get Mad at Monopolies

Last year, BIG brought on antitrust lawyer and researcher Basel Musharbash to do investigative reporting. In January, BIG published a piece on how a private equity engineered fire truck roll-up worsened the costs of the Los Angeles fires. In September, a Senate subcommittee led by anti-monopoly Republican Senator Josh Hawley and Democrat Andy Kim completed an investigation, and held a hearing titled “Sounding the Alarm: America’s Fire Apparatus Crisis.” Executives from REV Group and Pierce Manufacturing testified, as did a fire chief and the President of the International Association of Fire Fighters.

The New York Times and Wall Street Journal reported on it, and the Federal Trade Commission is now probing the industry. I’m guessing that negotiations over fire apparatus will become slightly easier, and those firms are likely seeing the writing on the wall.

On a more basic level, what I’ve noticed since we published our expose is how firemen, fire chiefs, and municipal officials talk about the problems they are facing. They use the words monopoly and private equity in discussing why it’s hard to get fire apparatus, and they see there’s a body of law that exists for them to use. That’s another light bulb turning on.

(2) Ending the Coercion Machine Economy

The second victory happened yesterday, when the Governor of California signed legislation to stop the coercion at the heart of a lot of our economic transactions. According to this new law, it is now illegal to coerce someone into using a pricing algorithm based on non-public data. California is the fourth largest economy in the world, so a state law matters here in a way that it doesn’t in other states. And while I’m not entirely sure how important this new law will be, it is a big ideological achievement, and I’m cautiously optimistic that it will be quite meaningful.

Here’s why. The key change in the 1970s engineered by Chicago’s law and economics school was to eliminate any sort of meaningful power analysis in antitrust law, in favor of an efficiency analysis. Older cases from the 1950s and 1960s were full of statements saying that suppliers and buyers were not allowed to “coerce” or “force” companies through tying or other forms of restraints to adopt pricing choices. There’s a Supreme Court case in 1948 on antitrust consent decrees discussing the difference between coercion and persuasion. (“He may not go beyond that and use something that is within his power to use as a club to coerce the person to accept that which he has to offer.”)

The Chicago School revolution got rid of this framework, under the premise that efficiency mattered, not coercion, fear, or the liberty to trade. If you were coerced by a dominant supplier, but an economist showed there was no loss of output, then that was just vigorous competition. Gradually, the notion that the antitrust laws protect business from economic violence fell away. The result is an economy of coercion machines, from Amazon to pharmacy benefit managers to RealPage.

Now, tech platforms and data brokers open up an entirely new mechanism to restrict trade and harm citizens. To put it differently, algorithms based on non-public data are a form of price-fixing where a tech platform or data exchange secretly organizes a conspiracy throughout an industry. Gathering control of data, and then forcing others to set prices based on that data, is how powerful actors now seem to be operating in our economy, in industries as varied as renting apartments to pvc pipe to hotel room prices.

Of course, the law will be tested in court, as terms like “coercion” need to be heard by judges and juries to determine how they apply. But the old case law is going to come back, because that’s where the term “coercion” is often used. Opponents of the law gave the game away when they claimed that “coercion is not an antitrust concept.” Oh but it is. They just wish it weren’t so.

One of the key people working on this legislation, antitrust lawyer Lee Hepner, joined our podcast Organized Money back in May to talk about the “Wild World of Surveillance Pricing.”

 

There are many ways to discuss this new law, perhaps as an attempt to regulate platforms as utilities, or perhaps as a way to end new forms of systemic price-fixing. But it is fundamentally a statement about what it means to live in free society. We don’t care if an economist says that you have been coerced in a way that’s good for for the market. It’s still illegal, because America is a free country.

(3) Is Our Politicians Learning?

The final victory I’ll discuss is that we were able to push back successfully on the corrupt lobbyists destroying the Antitrust Division and kneecapping the Assistant Attorney General for Antitrust, Gail Slater. Slater has not been good, but she has maintained the monopolization cases against Google, Ticketmaster, Apple, and RealPage. That’s significant. Our excellent court reporter, Jerry Cayford, has been doing blow-by-blow accounts of the latest Google antitrust remedy trial, which just finished yesterday. Slater is the reason it’s still happening.

But in July, as we noted, there was a coup to get rid of her, led by corporate lobbyists on the payroll of Hewlett Packard, Ticketmaster, and others, based on their relationship with Pam Bondi’s chief of staff, Chad Mizelle. This corporate coup got pretty far; Mizelle managed to fire several of her deputies.

Anti-monopolists helped stir up a storm, including encouraging a judge to investigate what looks like a corrupt merger settlement, the Hewlett Packard-Juniper deal. And last month, Mizelle was forced out of his position. And today, in a general oversight hearing for Bondi, four different Senators raised the prospect of corruption at the Antitrust Division. I’ve never seen four Senators raise questions on antitrust before the Attorney General. That’s a compelling point about political priorities, since Bondi is a lightning rod for every complaint under the sun.

There’s a lot more, but I just want to say, thank you for reading and subscribing and sending notes and tips. It may seem a discouraging time, but that is because we have not yet re-imagined what is possible. As Adams put it, “The Revolution was in the Minds of the People” before it became the war written in the history books. They had to imagine a new world before they could jettison the old. That is our task. That is how to overthrow the oligarchy. And dark though it may be today, as those lightbulbs keep turning on in the minds of the people, the country will get brighter.

2) Pivoting back to Stoller’s column (but returning to MHI later below). These are pull quotes from Stoller (see Part I above) as it relates to the paraphrases in the headline.  In no particular order of importance, per Stoller.

Liberty from concentrated power starts in our own minds, before it happens anywhere else.

I started writing BIG because I thought it would be a useful way to promote my book Goliath, which was a history of fights over monopoly in the 20th century, and a tacit way to explain to Democrats that President Obama had turned his back on traditional democratic principles.

Despite some very important victories, the trends have been bad in general. The number of billionaires in America has increased by about 25%. The economy is now dependent on consumer spending by the wealthy, as well as an obvious AI bubble with its direction concentrated in the hands of between ten and twenty men. There are many reason[s] for this oligarchical control, but a key one is that since the 1970s, the people have allowed it. We lost our skepticism towards concentrated power, and became deeply confused about why our society is less free.

But I am going to offer a reason for optimism. I believe the American people are learning about the real sinews of power.

“…the jury landscape has fundamentally shifted. 72% of Americans now see their role as sending messages to corporations—a dramatic increase from 2022.” Americans are seeing the corruption of their society, and they don’t like what they see. That’s good. And they are now realizing that one center of the problem is corporate power.

Such a shift in the mind of the public doesn’t happen all at once.

…like tiny light bulbs turning on, as different communities learn to see power and coercion they had formerly imagined was part of nature.

It happened to video gamers last week, when Microsoft did to them what it said it would not: raise prices and lay off game developers after buying Activision. Lots of gamers believed Microsoft was a good actor, now they do not.

At BIG, we make an argument about politics and commerce.

Arbitrary coercion is immoral. And that principle is enormously powerful, especially when matched to the rule of law. Today, the anti-monopoly language finally exists for the dissatisfied multitude to describe the world they are seeing in useful ways. We haven’t built a politics designed to take this energy and turn it into a majority, but we will. As John Adams noted, revolutions start in the minds of the people.

Ending the Coercion Machine Economy

There’s a Supreme Court case in 1948 on antitrust consent decrees discussing the difference between coercion and persuasion. (“He may not go beyond that and use something that is within his power to use as a club to coerce the person to accept that which he has to offer.”)

Now, tech platforms and data brokers open up an entirely new mechanism to restrict trade and harm citizens. To put it differently, algorithms based on non-public data are a form of price-fixing where a tech platform or data exchange secretly organizes a conspiracy throughout an industry. Gathering control of data, and then forcing others to set prices based on that data, is how powerful actors now seem to be operating in our economy, in industries as varied as renting apartments to pvc pipe to hotel room prices.

The final victory I’ll discuss is that we were able to push back successfully on the corrupt lobbyists destroying the Antitrust Division and kneecapping the Assistant Attorney General for Antitrust, Gail Slater. Slater has not been good, but she has maintained the monopolization cases against Google, Ticketmaster, Apple, and RealPage.

As Adams put it, “The Revolution was in the Minds of the People” before it became the war written in the history books. They had to imagine a new world before they could jettison the old. That is our task. That is how to overthrow the oligarchy. And dark though it may be today, as those lightbulbs keep turning on in the minds of the people, the country will get brighter.

3) As MHProNews noted in the preface, there have been several times MHProNews has critiqued as well as highlighted (in a positive fashion) what Matt Stoller has said, done or not said or done. For example, Stoller has been made directly aware of problems within the manufactured housing industry, because he acknowledged it in communications with MHProNews. Stoller is generally pro-Democrat and is demonstrably from the political left. That said, he does from time to time point out the disconnect between what some (or specific) Democrats have said and done and how that fostered behavior quite at odds with Democratic claims on issues such as antitrust enforcement. For example, in his email this morning, Stoller specifically explained that former President Barack Obama was not doing what he said before being elected. Quoting Stoller.

…a tacit way to explain to Democrats that President Obama had turned his back on traditional democratic principles.

The nexus between governmental power and corporate power has been explored numerous times by MHProNews in both general and manufactured housing industry specific ways.  Politicians make promises. The question then becomes do the politicos then do what they promised? Time after time many (not all) politicians fail at the test of delivering on their campaign promises. If not for the largely left-leaning media echo chamber, politicians like Obama and Biden may have a far different image than they enjoy in the minds of millions today.  That’s well documented by people from the political left, no need to turn to ‘conservatives,’ ‘libertarians,’ Republicans, or others to make that point. MHProNews and/or MHLivingNews plan to explore in the near term the fascinating story of Bari Weiss. Weiss is painted by some as a conservative. Perhaps the more apt description is that she is more centrist, but compared to several on the left she appears to be conservative. Weiss felt she was pushed out of the New York Times by leftists who didn’t approve of her providing some conservatives periodic op-eds in that editorial department that she was in charge of while there. She eventually founded The Free Press. It reportedly has about 3.7 million visitors monthly (roughly double the confirmed visits MHProNews achieved in September 2025). The Free Press was acquired in a reportedly $150 million dollar deal that included making Weiss the head of CBS’ News division as editor in chief.

When Stoller politely slammed former President Barak Obama, as shown above, he was doing something similar to what Bernie Sanders and others in the Democratic orbit have done in the last year or so. Some have pointed out that Democrats are as in bed with the oligarchs – if not demonstrably more so – than so-called RINO, “Establishment,” or other Republicans.

4) As attorney turned award-winning liberal journalist Glenn Greenwald put it, it is no longer about left vs. right, it is rather about anti-Establishment vs. the Establishment. That is a point that Stoller ought to pick up on, because a close look reveals the keen insight from Greenwald on that point.

6) Pivoting back to MHI’s messaging in Part II. Former MHI Vice President Danny Ghorbani, and the founding President and CEO of MHARR previously said this to MHProNews. By post-production, Ghorbani and MHARR routinely are referring to MHI, which claims to represent “all segments” of the industry.

To overcome the industry’s zoning and consumer financing woes, this so-called post production representation needs to do more than hold meetings, issue talking points, engage in “photo ops,” or publish newsletters full of braggadocio and boasts but bereft of any tangible results.

Speaking of MHARR and their post-production critique. Their study below is one of several articles of MHARR’s that has demonstrably stood the test of time.

There is an evidence-based argument to be made that if several organic growth minded independents had organized what MHARR advocated in 2017, the industry today might be producing 500,000 new homes a year vs. perhaps around 100,000 new homes this year at the current pace. Per a source at MHARR, they advised MHProNews that they have established a research tab on their website. That article above is the first one placed into that MHARR research category. Another former MHI member that has made a similar observation phrased differently than Ghorbani is Marty Lavin, J.D. Lavin is an MHI ‘lifetime achievement’ award winner. Nevertheless, Lavin‘s name – like Ghorbani, and several past 21st century MHI presidents/CEOs, multiple vice presidents, and others have been culled from their website. Apparently, those past officials and individuals no longer fit the current MHI narrative.

Notorious MHI member Frank Rolfe periodically has periodically slammed MHI, even though he is an MHI member. Rolfe publicly slammed UMH’s Sam Landy, which at least gave Landy the courtesy of making his remarks public. Several MHI members have reportedly slammed Landy behind their backs and have done so off and on for a period of years.

What makes some of Rolfe‘s remarks particularly interesting is that he has sounded off several times in a fashion that appears to be pushing oligopoly style monopolization. But that isn’t theoretical either, as the late ELS chairman Sam Zell said as much in remarks as shown below.

Why Stoller hasn’t devoted time to spotlighting such issues is a worthwhile question, given his interest in consolidation and antitrust. It seems likely that such topics are among the reasons that MHProNews hit record high engagement from researchers, media, industry professionals, nonprofits, and others in September 2025.

Our son has grown quite a bit since this 12.2019 photo. All on Capitol Hill were welcoming and interested in our manufactured housing industry related concerns.
