   The HUD standard is a pre-emptive standard that prevents any local jurisdiction from setting its own requirements or limitations on homes built in accordance with the standard. I can see how a local jurisdiction may require structures in particular zones to meet certain aesthetic or energy-efficiency requirements (neither of which prevents one from building a home under the HUD Standard), but a zoning restriction on all homes built to a federally pre-emptive standard runs directly counter to the purposes of the HUD standard and should not be found legal in court. How are the Orangeburg zoning plans worded?

   You raise a point which is why we report on such stories. The HUD Cide pre-emotion is routinely ignored. In Texas, the TDHCA’s Joe Garcia is known at times to help the D J Pendelton’s TMHA’s members, by sending notices to local jurisdictions that their office’s understanding if the law us that they are violating the HUD promotion. We need more efforts like DJ’s, and more regulators such as Joe Garcia.
