While we may not hit the hoped for level of 60,000 homes produced in 2013, still the growth has been steady.<\/p><div id=\"manuf-2667382803\" class=\"manuf-content manuf-entity-placement\"><script async src=\"\/\/pagead2.googlesyndication.com\/pagead\/js\/adsbygoogle.js?client=ca-pub-3870480136270376\" crossorigin=\"anonymous\"><\/script><ins class=\"adsbygoogle\" style=\"display:block;\" data-ad-client=\"ca-pub-3870480136270376\" \ndata-ad-slot=\"\" \ndata-ad-format=\"auto\"><\/ins>\n<script> \n(adsbygoogle = window.adsbygoogle || []).push({}); \n<\/script>\n<\/div>\n<p>But what will happen now that the Consumer Financial Protection Bureau (CFPB) regulations are kicking in this month? With regulations that will make it difficult to originate low balance loans &ndash; especially to those who may have challenged credit or modest income &ndash; will shipments go down, as many fear?<\/p>\n<p>Or will the industry find creative ways to adapt &#8211; as some predict &ndash; that will keep new home production level? Or&#8230;<\/p>\n<p><img fetchpriority=\"high\" decoding=\"async\" alt=\"painted-into-a-corner-credit-canaconcepts-posted-masthead-blog-mhpronews-com-\" height=\"311\" src=\"http:\/\/manufacturedhomepronews.com\/masthead\/wp-content\/uploads\/painted-into-a-corner-credit-canaconcepts-posted-masthead-blog-mhpronews-com-.gif\" style=\"float: left; margin-top: 8px; margin-right: 10px; margin-left: 10px;\" width=\"250\" \/>&#8230;will the industry now rally and do what it takes to engage on a multi-level effort to both increase shipments and modify regulations?<\/p>\n<p><b>Up, Down or Sideways?<\/b><\/p>\n<p>With a broken crystal ball, there won&#39;t be a <i>prediction<\/i> coming from me any time soon. What your scribe will opine is that sometimes people <i>wake up and act only when forced to do so<\/i>.<\/p>\n<p>Frankly, it is very possible that shipments could go UP. Yes, even in the face of these new regulations that will cut out loans that were previously being made.<\/p>\n<p>But how? While some are advocating and using the &#39;lease option&#39; approach, others have dropped that due to concerns that regulators may see it as a &#39;disguised credit transaction.&#39; An <a href=\"http:\/\/www.mhmarketingsalesmanagement.com\/home\/industry-news\/industry-in-focus\/6455-ncc-discussion-on-manufactured-housing-rent-to-own-and-lease-option\" target=\"_blank\"><u><i><b>Industry in Focus <\/b><\/i><\/u><u> report on that topic is linked here<\/u><\/a>.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" alt=\"rent-versus-buy-credit-rent-direct-posted-masthead-blog-manufactured-housing-pro-news\" height=\"180\" src=\"http:\/\/manufacturedhomepronews.com\/masthead\/wp-content\/uploads\/rent-versus-buy-credit-rent-direct-posted-masthead-blog-manufactured-housing-pro-news.jpg\" style=\"float: left; margin-top: 8px; margin-right: 10px; margin-left: 10px;\" width=\"180\" \/>The ease and simplicity of rentals certainly has its appeals.<\/p>\n<p>For some, this is a break with tradition! They see it as an option of last resort, understandably so.<\/p>\n<p>Meanwhile, some have always used rentals in their community business models.<\/p>\n<p>Having personally supervised\/managed from 7 to 17 communities, duh, it is clearly better to sell a home than lease it. Especially if the sale is a true third party finance or cash sale, less capital, more profit and more stable residency occurs in a community when the homes are owner-occupied.<\/p>\n<p>With rentas rates rising, as the <u><a href=\"http:\/\/manufacturedhomelivingnews.com\/manufactured-homes-and-the-harvard-study-on-rental-housing\/\" target=\"_blank\">Harvard study linked as a download from the article here demonstrates, the opportunities for manufactured housing are growing by leaps and bounds<\/a><\/u>. But those opportunities will be successfully tapped only by those who are truly prepared to do so.<\/p>\n<p><b>Change isn&#39;t coming, it&#39;s HERE<\/b><\/p>\n<p>As we noted above, with new regulations, change isn&#39;t coming, it is now HERE. The CFPB has sent plenty of signals that they will enforce their<img loading=\"lazy\" decoding=\"async\" alt=\"moving-ahead-of-the-pack-credit-modcoach-posted-masthead-blog-mhpronews-com2014-\" height=\"100\" src=\"http:\/\/manufacturedhomepronews.com\/masthead\/wp-content\/uploads\/moving-ahead-of-the-pack-credit-modcoach-posted-masthead-blog-mhpronews-com2014-.jpg\" style=\"float: right; margin-top: 8px; margin-right: 10px; margin-left: 10px;\" width=\"250\" \/> regulations. We had a respected attorney tell one of our seminar audiences at Louisville last year that he won&#39;t be surprised if besides regulators, that you may see private attorneys seek out customers who are losing their homes &#39;sold&#39; via captive finance and lease-option transactions, to see if they can sue community owners.<\/p>\n<p>The point is the risks are many. We strongly advocate working with your state and\/or national association to <u><a href=\"http:\/\/www.mhmarketingsalesmanagement.com\/home\/industry-news\/industry-in-focus\/6659-dodd-frank-fix-hr-1779-preserving-access-to-manufactured-housing-act-of-2013-achieves-growing-bi-partisan-support-\" target=\"_blank\"><b>get HR 1779 and S 1828 passed<\/b><\/a><\/u>, and to explore other options such as obtaining a Writ of Mandamus to compel regulators to do what the law requires on subjects like the Duty to Serve.
