More on that in Part II of this column, which will examine the notion of this being a consolidator fueled crisis for the manufactured housing industry.<\/li>\n<\/ul>\n<p>Next up, in Part I of this column is the report from the Manufactured Housing Association for Regulatory Reform (MHARR) with the following information on the latest production and top states for manufactured home shipments.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Part I<\/strong><\/p>\n<h3 style=\"text-align: center;\"><strong><u>Severe Manufactured Home Production Decline Continues in August 2023 <\/u><\/strong><\/h3>\n<p><strong>Washington, D.C., October 5, 2023 \u2013 <\/strong>The Manufactured Housing Association for Regulatory Reform (MHARR) reports that according to official statistics compiled on behalf of the U.S. Department of Housing and Urban Development (HUD), HUD Code manufactured housing industry year-over-year production declined again in August 2023. Just-released statistics indicate that HUD Code manufacturers produced 8,670 new homes in August 2023, a 19.1% decrease from the 10,722 new HUD Code homes produced in August 2022. As MHARR has explained and documented, this decline continues to be driven by key failures within the <u>industry\u2019s post-production sector<\/u> including, most significantly, discriminatory zoning exclusion (tolerated by HUD) and the stubborn refusal of Fannie Mae and Freddie Mac to securitize chattel loans for nearly <u>80% of the industry\u2019s most affordable mainstream manufactured homes<\/u>. Who says?<\/p>\n<p><a href=\"https:\/\/www.manufacturedhomepronews.com\/hud-reports-homelessness-rising-housing-should-be-a-right-says-hud-secretary-marcia-fudge-praising-biden-initiatives-manufactured-home-factor-missing\/\">HUD Secretary Marcia Fudge<\/a>\u00a0spoke recently about the tragedy of increased homelessness in America.<\/p>\n<p>HUD\u2019s sad\u00a0<a style=\"font-style: inherit; font-weight: inherit;\" href=\"https:\/\/www.manufacturedhomepronews.com\/hud-reports-homelessness-rising-housing-should-be-a-right-says-hud-secretary-marcia-fudge-praising-biden-initiatives-manufactured-home-factor-missing\/\">report<\/a>\u00a0is fascinating because\u00a0<a style=\"font-style: inherit; font-weight: inherit;\" href=\"https:\/\/www.manufacturedhomepronews.com\/monopolies-silent-spreaders-of-poverty-and-economic-inequality-insights-from-henry-simons-thurman-arnold-applied-by-schmitz-and-fettig-to-hud-manufactured-housing-economic-inequality-and-poverty\/\">James Schmitz Jr. \u2013 a researcher for the Minneapolis Fed<\/a><a style=\"font-style: inherit; font-weight: inherit;\" href=\"https:\/\/www.manufacturedhomepronews.com\/monopolies-silent-spreaders-of-poverty-and-economic-inequality-insights-from-henry-simons-thurman-arnold-applied-by-schmitz-and-fettig-to-hud-manufactured-housing-economic-inequality-and-poverty\/\">,<\/a>\u00a0and\u00a0<a style=\"font-style: inherit; font-weight: inherit;\" href=\"https:\/\/www.manufacturedhomepronews.com\/sabotaging-monopolies-minneapolis-fed-researchers-charge-hud-collusion-w-builders-to-sabotage-manufactured-housing-independents-created-u-s-housing-crisis\/\">three colleagues<\/a>\u00a0\u2013 published reports accusing HUD and builders of collusion in deliberately undermining manufactured housing.<\/p>\n<p>Schmitz and those researchers argued that collusion between HUD and builders is a case of \u201c<a style=\"font-style: inherit; font-weight: inherit;\" href=\"https:\/\/www.manufacturedhomepronews.com\/monopolies-silent-spreaders-of-poverty-and-economic-inequality-insights-from-henry-simons-thurman-arnold-applied-by-schmitz-and-fettig-to-hud-manufactured-housing-economic-inequality-and-poverty\/\">sabotage<\/a>\u00a0<a style=\"font-style: inherit; font-weight: inherit;\" href=\"https:\/\/www.manufacturedhomepronews.com\/monopolies-silent-spreaders-of-poverty-and-economic-inequality-insights-from-henry-simons-thurman-arnold-applied-by-schmitz-and-fettig-to-hud-manufactured-housing-economic-inequality-and-poverty\/\">monopoly<\/a><a style=\"font-style: inherit; font-weight: inherit;\" href=\"https:\/\/www.manufacturedhomepronews.com\/monopolies-silent-spreaders-of-poverty-and-economic-inequality-insights-from-henry-simons-thurman-arnold-applied-by-schmitz-and-fettig-to-hud-manufactured-housing-economic-inequality-and-poverty\/\">.<\/a>\u201d<\/p>\n<p>They said that sabotaging collusion between HUD and builders increased homelessness, harmed minorities, and cut off the lower income class of all backgrounds from the benefits of affordable manufactured home ownership.<\/p>\n<p>Schmitz and his colleagues wrote positively about the manufactured home option.<\/p>\n<p><a style=\"font-style: inherit; font-weight: inherit;\" href=\"https:\/\/www.manufacturedhomepronews.com\/affordable-manufactured-housings-puzzling-contemporary-condition-revealed-by-quotable-quotes-from-residents-professionals-expert-researchers-advocates-public-officials-graphics-and-repo\/\">Scholastica \u201cGay\u201d Cororaton\u2019s research for the National Association of Realtors<\/a>\u00a0also praised modern manufactured homes.<\/p>\n<p>What makes Schmitz and his colleagues\u2019 charge of HUD\u2019s role in\u00a0<strong style=\"font-style: inherit;\">\u201csabotage monopoly<\/strong>\u201d more compelling are comments from\u00a0<a style=\"font-style: inherit; font-weight: inherit;\" href=\"https:\/\/www.manufacturedhomelivingnews.com\/the-solution-to-the-affordable-housing-crisis-is-hiding-in-plain-sight\/\">Bill Matchneer. Attorney Matchneer is the former HUD administrator<\/a>\u00a0for the Office of Manufactured Housing Programs (OMHP).<\/p>\n<p><a href=\"https:\/\/www.manufacturedhomepronews.com\/bombshells-former-hud-manufactured-housing-program-administrator-bill-matchneer-cavcos-manuel-santana-statements\/\">Matchneer said HUD\u2019s Office of General Counsel consistently failed to enforce the enhanced preemption<\/a>\u00a0<a style=\"font-style: inherit; font-weight: inherit;\" href=\"https:\/\/www.manufacturedhomepronews.com\/bombshells-former-hud-manufactured-housing-program-administrator-bill-matchneer-cavcos-manuel-santana-statements\/\">clause made law when the Manufactured Housing Improvement Act of 2000<\/a>\u00a0(MHIA or 2000 Reform law) was enacted.<\/p>\n<p><a style=\"font-style: inherit; font-weight: inherit;\" href=\"https:\/\/www.manufacturedhomelivingnews.com\/how-the-manufactured-housing-institute-mhi-and-their-corporate-masters-painted-themselves-into-a-corner-consumer-alert-news-analysis\/\">Jim Gray<\/a><a style=\"font-style: inherit; font-weight: inherit;\" href=\"https:\/\/www.manufacturedhomelivingnews.com\/how-the-manufactured-housing-institute-mhi-and-their-corporate-masters-painted-themselves-into-a-corner-consumer-alert-news-analysis\/\">,<\/a>\u00a0formerly with the FHFA Duty to Serve program, said in his exit message that FHFA and GSEs \u2013 \u201c[W]<strong style=\"font-style: inherit;\">e have not made as much progress<\/strong>\u00a0[toward meeting the Duty to Serve mandates]\u00a0<strong style=\"font-style: inherit;\">as many of us would have liked; so much remains to be done to reach these<\/strong>\u00a0[DTS]\u00a0<strong style=\"font-style: inherit;\">markets<\/strong>.\u201d<\/p>\n<p>In December 2019, I made two different listening session presentations on the DTS mandates; one virtual and another live in Washington, D.C.<\/p>\n<p><a style=\"font-style: inherit; font-weight: inherit;\" href=\"https:\/\/www.manufacturedhomelivingnews.com\/fhfa-gses-high-cost-to-minorities-all-americans-due-to-asserted-failures-to-follow-duty-to-serve-affordable-housing-existing-federal-laws\/\">In both presentations<\/a><a style=\"font-style: inherit; font-weight: inherit;\" href=\"https:\/\/www.manufacturedhomelivingnews.com\/fhfa-gses-high-cost-to-minorities-all-americans-due-to-asserted-failures-to-follow-duty-to-serve-affordable-housing-existing-federal-laws\/\">,<\/a>\u00a0I made the evidence-based case how disgraceful it was that the FHFA and GSEs have ignored the law to the harm of millions.<\/p>\n<p>GSEs and FHFA failures arguably included key corporate members of the Manufactured Housing Institute or MHI.<\/p>\n<p>Several scheduled to present today are aware of the issues I\u2019m raising. Because some worked for HUD, FHFA, GSEs, or are otherwise connected to the manufactured housing industry.<\/p>\n<p>For instance. Lesli Gooch, Ph.D., with the Manufactured Housing Institute (MHI) made statements in her filed EHG comments letter that sound supportive of manufactured homes.<\/p>\n<p>But upon closer examination, Ms. Gooch focused on an unproven plan that Berkshire Hathaway (BRK) owned Clayton Homes \u2013 which supports MHI \u2013 in their push for their branded\u00a0<a style=\"font-style: inherit; font-weight: inherit;\" href=\"https:\/\/www.manufacturedhomelivingnews.com\/manufactured-homeowners-interests-threatened-by-manufactured-housing-institute-deceptive-scheme-per-modular-home-builders-associations-tom-hardiman\/\">CrossMod<\/a><a style=\"font-style: inherit; font-weight: inherit;\" href=\"https:\/\/www.manufacturedhomelivingnews.com\/manufactured-homeowners-interests-threatened-by-manufactured-housing-institute-deceptive-scheme-per-modular-home-builders-associations-tom-hardiman\/\"><sup style=\"font-style: inherit; font-weight: inherit;\">TM<\/sup><\/a><a style=\"font-style: inherit; font-weight: inherit;\" href=\"https:\/\/www.manufacturedhomelivingnews.com\/manufactured-homeowners-interests-threatened-by-manufactured-housing-institute-deceptive-scheme-per-modular-home-builders-associations-tom-hardiman\/\">\u00a0homes scheme<\/a><a style=\"font-style: inherit; font-weight: inherit;\" href=\"https:\/\/www.manufacturedhomelivingnews.com\/manufactured-homeowners-interests-threatened-by-manufactured-housing-institute-deceptive-scheme-per-modular-home-builders-associations-tom-hardiman\/\">.<\/a><\/p>\n<p>Where was Gooch\u2019s similarly robust support for\u00a0<u>all other mainstream manufactured homes<\/u>?<\/p>\n<ul>\n<li>Fannie calls CrossMod<sup style=\"font-style: inherit; font-weight: inherit;\">TM<\/sup>MH Advantage<sup>\u00ae<\/sup>.<\/li>\n<li>Freddie calls their version of CrossMod<sup style=\"font-style: inherit; font-weight: inherit;\">TM<\/sup>CHOICEHome<sup>\u00ae<\/sup>.<\/li>\n<li>The known data reveals that these programs are market failures.<\/li>\n<\/ul>\n<p>Supposedly there have been double-digit sales nationally of CrossMod<sup style=\"font-style: inherit; font-weight: inherit;\">TM<\/sup>\u00a0\u2013 under whatever name \u2013 in the last few years. That\u2019s in a market producing some 95,000 HUD Code manufactured homes annually.<\/p>\n<p>Attorney and manufactured home finance veteran Marty Lavin \u2013 an MHI award winner \u2013 did consulting for Fannie Mae.\u00a0<a style=\"font-style: inherit; font-weight: inherit;\" href=\"https:\/\/www.manufacturedhomelivingnews.com\/award-winning-attorney-marty-lavin-sounds-alert-about-manufactured-housing-institute-backed-loan-program-home-values-supply-demand-case-for-manufactured-housing-sabotage\/\">Lavin told\u00a0<\/a><a style=\"font-style: inherit; font-weight: inherit;\" href=\"https:\/\/www.manufacturedhomelivingnews.com\/award-winning-attorney-marty-lavin-sounds-alert-about-manufactured-housing-institute-backed-loan-program-home-values-supply-demand-case-for-manufactured-housing-sabotage\/\">MHLivingNews<\/a>\u00a0<a style=\"font-style: inherit; font-weight: inherit;\" href=\"https:\/\/www.manufacturedhomelivingnews.com\/award-winning-attorney-marty-lavin-sounds-alert-about-manufactured-housing-institute-backed-loan-program-home-values-supply-demand-case-for-manufactured-housing-sabotage\/\">t<\/a>hat MHAdvantage<sup>\u00ae <\/sup>was likely to be as successful as MH Select\u00ae. Lavin said MH Select<sup>\u00ae<\/sup> was also a virtual goose egg.<\/p>\n<p><a href=\"https:\/\/www.manufacturedhomepronews.com\/david-dworkin-national-housing-conference-compared-and-contrasted-with-lesli-gooch-manufactured-housing-institute-on-fannie-mae-freddie-mac-proposed-modifications-to-fhfa-on-duty-to-serve-finance\/\"><strong style=\"font-style: inherit;\">David Dworkin<\/strong><\/a><a style=\"font-style: inherit; font-weight: inherit;\" href=\"https:\/\/www.manufacturedhomepronews.com\/david-dworkin-national-housing-conference-compared-and-contrasted-with-lesli-gooch-manufactured-housing-institute-on-fannie-mae-freddie-mac-proposed-modifications-to-fhfa-on-duty-to-serve-finance\/\">, CEO of the National Housing Conference in federal comments said that manufactured<\/a>\u00a0<a style=\"font-style: inherit; font-weight: inherit;\" href=\"https:\/\/www.manufacturedhomepronews.com\/david-dworkin-national-housing-conference-compared-and-contrasted-with-lesli-gooch-manufactured-housing-institute-on-fannie-mae-freddie-mac-proposed-modifications-to-fhfa-on-duty-to-serve-finance\/\">housing was necessary<\/a>\u00a0for affordable housing.<\/p>\n<p>Dworkin was fully confident that the GSEs could successful do manufactured home loans.\u00a0 Dworkin previously worked for a GSE as a Vice President.<\/p>\n<p><a href=\"https:\/\/www.manufacturedhomelivingnews.com\/huds-urban-institutes-edward-golding-knew-because-manufactured-housing-institutes-lesli-gooch-told-him\/\">Edward Golding<\/a>\u00a0worked for HUD and the FHA.<\/p>\n<p>In 2018, Golding and 3 colleagues did a post for the Urban Institute. It was a entitled\u00a0<a style=\"font-style: inherit; font-weight: inherit;\" href=\"https:\/\/www.urban.org\/urban-wire\/manufactured-homes-could-ease-affordable-housing-crisis-so-why-are-so-few-being-made\">\u201cManufactured<\/a>\u00a0<a style=\"font-style: inherit; font-weight: inherit;\" href=\"https:\/\/www.urban.org\/urban-wire\/manufactured-homes-could-ease-affordable-housing-crisis-so-why-are-so-few-being-made\">homes could ease the affordable housing crisis. So why are so few being made<\/a><a style=\"font-style: inherit; font-weight: inherit;\" href=\"https:\/\/www.urban.org\/urban-wire\/manufactured-homes-could-ease-affordable-housing-crisis-so-why-are-so-few-being-made\">?<\/a>\u201d<\/p>\n<p>Citing\u00a0<a style=\"font-style: inherit; font-weight: inherit;\" href=\"https:\/\/www.manufacturedhomelivingnews.com\/former-manufactured-housing-institute-president-manufactured-home-owners-urban-institute-and-you\/\">FHFA data, Golding and his co-authors in that Urban Institute report said manufactured homes<\/a>\u00a0<a style=\"font-style: inherit; font-weight: inherit;\" href=\"https:\/\/www.manufacturedhomelivingnews.com\/former-manufactured-housing-institute-president-manufactured-home-owners-urban-institute-and-you\/\">appreciated in value<\/a><a style=\"font-style: inherit; font-weight: inherit;\" href=\"https:\/\/www.manufacturedhomelivingnews.com\/former-manufactured-housing-institute-president-manufactured-home-owners-urban-institute-and-you\/\">.<\/a>\u00a0They said manufactured homes could appreciate even more given access to affordable sustainable GSE loans.<\/p>\n<p>What that Urban Institute post\u00a0<a style=\"font-style: inherit; font-weight: inherit;\" href=\"https:\/\/www.manufacturedhomepronews.com\/challenges-to-obtaining-manufactured-home-financing-urban-institute-report-fact-check-analysis\/\">didn\u2019t disclose on that specific page is that Berkshire chairman Warren<\/a>\u00a0<a style=\"font-style: inherit; font-weight: inherit;\" href=\"https:\/\/www.manufacturedhomepronews.com\/challenges-to-obtaining-manufactured-home-financing-urban-institute-report-fact-check-analysis\/\">Buffett is a lifetime trustee of the Urban Institute<\/a><a style=\"font-style: inherit; font-weight: inherit;\" href=\"https:\/\/www.manufacturedhomepronews.com\/challenges-to-obtaining-manufactured-home-financing-urban-institute-report-fact-check-analysis\/\">.<\/a><\/p>\n<p>The applied logic of Golding, Dworkin,\u00a0<a style=\"font-style: inherit; font-weight: inherit;\" href=\"https:\/\/manufacturedhousingassociationregulatoryreform.org\/mharr-calls-for-mainstream-manufactured-home-loans-to-be-included-in-enterprise-housing-goals\/\">MHARR\u2019s Mark Weiss<\/a><a style=\"font-style: inherit; font-weight: inherit;\" href=\"https:\/\/manufacturedhousingassociationregulatoryreform.org\/mharr-calls-for-mainstream-manufactured-home-loans-to-be-included-in-enterprise-housing-goals\/\">,<\/a>\u00a0and others should make it plain that the GSEs could and should be doing robust lending in manufactured housing.<\/p>\n<p>Oxford Bank has made personal property loans on manufactured homes for some 2 decades. font-weight: inherit;\" href=\"https:\/\/www.manufacturedhomepronews.com\/warren-buffett-declared-class-warfare-buffett-says-fellow-billionaires-were-winning\/\">\u201c<\/a><a style=\"font-style: inherit; Some examples of that are shown below.<\/p>\n<p>Certainly, getting lower cost lending and fixing the DOE issue are important. But for the purposes of this analysis, let&#8217;s focus on this issue &#8211; namely, the lack of enforcement by HUD of the enhanced preemption provision of the MHIA.\u00a0 While as noted, MHI and MHARR may initially seem to be on the &#8216;same page&#8217; on this issue, a closer look reveals something different.\u00a0 Namely, that MHI may make comments to Congress or regulators in documents that are often not seen by the vast majority of the public. Those documents by MHI where they have verbally supported &#8220;enhanced preemption&#8221; may or may not appear, for instance, in a search by Bing&#8217;s AI Chat function. Why? Because for years, they are NOT found on the MHI website! Furthermore, they are routinely not found on the websites of MHI-linked bloggers or trade publications. See the graphic below for a snapshot of the evidence. By contrast, MHARR has over a dozen posts on their website that include mention of federal enhanced preemption. MHProNews\/MHLivingNews have hundreds of mentions of the issue dating back for over a decade. Furthermore, MHARR, MHProNews\/MHLivingNews have issued press releases, or this writer has done guest articles on other platforms, that specifically mention this issue by name. How so? Because if <em>enhanced preemption<\/em> were fully and properly enforced, based on the MHIA law&#8217;s federal preemption provision, more homesites for manufactured housing could be utilized and\/or developed.\u00a0 More homesites, more communities, could mean less upward pressure for site fee hikes. That&#8217;s a basic application of the law of supply and demand as it would relate to this situation.<\/p>\n<p>&nbsp;<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter\" pressed the notion manufactured home community operators should &#8216;never&#8217; build &#8216;a new mobile home park.&#8217; In essence, Rolfe and others who share that view are arguing for a monopolistic grasp of given local manufactured home community markets.<\/p>\n<p>&nbsp;<\/p>\n<figure id=\"attachment_17463\" aria-describedby=\"caption-attachment-17463\" style=\"width: 600px\" target=\"_blank\" rel=\"noopener\">consolidators<\/a>.<\/p>\n<p>But what this amounts to is a<em> de facto<\/em> conspiracy or collusion by several MHI members and\/or members of MHI-linked state By &#8216;hiding&#8217; and failing to press for enforcement of the MHIA and enhanced preemption, while posturing via emails something different to their members, MHI appears to be working for &#8220;all segments&#8221; of the industry. But when the evidence is carefully examined, what they are working for are the interests of consolidators.
