Note that in MHI circles, the words \u201cthe industry\u201d are often a kind of shorthand or alternative phrase that means \u201cMHI\u201d or the \u201cManufactured Housing Institute.\u201d \u201cThe industry\u201d as an expression meaning MHI was used, for example, by <a href=\"https:\/\/www.manufacturedhomepronews.com\/warren-buffetts-pledge-to-kevin-clayton-you-can-access-plenty-of-capital-for-projects-quotes-facts-video-transcript-and-implications-for-manufactured-housing\/\">Kevin Clayton when he spoke about \u201cthe industry\u201d doing a national marketing campaign<\/a>. But those remarks by a MHEC insider also begs questions. If so, how is it possible that MHI \u201coverlooked\u201d chattel lending as the language for the Housing and Economic Recovery Act (HERA) of 2008 was well underway? More on that further below.<\/p><div id=\"manuf-3315194292\" class=\"manuf-content manuf-entity-placement\"><script async src=\"\/\/pagead2.googlesyndication.com\/pagead\/js\/adsbygoogle.js?client=ca-pub-3870480136270376\" crossorigin=\"anonymous\"><\/script><ins class=\"adsbygoogle\" style=\"display:block;\" data-ad-client=\"ca-pub-3870480136270376\" \ndata-ad-slot=\"\" \ndata-ad-format=\"auto\"><\/ins>\n<script> \n(adsbygoogle = window.adsbygoogle || []).push({}); \n<\/script>\n<\/div>\n<p>MHProNews contacted both MHI and the Manufactured Housing Association for Regulatory Reform (MHARR) for their reaction to the expos\u00e9 on <a href=\"https:\/\/www.manufacturedhomepronews.com\/you-cant-make-this-up-lesli-gooch-ph-d-manufactured-housing-institute-ceo-proclaims-i-commend-the-teams-at-fhfa-fannie-mae-and-freddie-mac-saturday-satire-plus-m\/\">Gooch\u2019s DTS remarks<\/a>.<\/p>\n<p><strong>Part I<\/strong><\/p>\n<p><a href=\"https:\/\/www.manufacturedhomepronews.com\/masthead\/wp-content\/uploads\/2022\/09\/QuoteMarksLeftSide.png\"><img decoding=\"async\" class=\"size-full wp-image-20771 alignleft\" src=\"https:\/\/www.manufacturedhomepronews.com\/masthead\/wp-content\/uploads\/2022\/09\/QuoteMarksLeftSide.png\" alt=\"QuoteMarksLeftSide\" width=\"102\" height=\"73\" \/><\/a>No industry representative should be &#8220;commending&#8221; Fannie Mae and Freddie Mac for their implementation of DTS [the Duty to Serve manufactured housing federal mandate], when the vast bulk of the manufactured housing finance market remains completely unserved after 15 years. Rather than validating excuses for this utter failure (<u>i.e.<\/u>, &#8220;may&#8221; versus &#8220;shall&#8221; language in the DTS statute), MHI [Manufactured Housing Institute] should be seeking full compliance with DTS in BOTH the MH [manufactured home] real estate and chattel markets, as well as a legislative remedy that would deprive Fannie and Freddie of this convenient, bad faith excuse.&#8221;<\/p>\n<p>Mark Weiss, J.D., President and CEO of the Manufactured Housing Association for Regulatory Reform (MHARR).<\/p>\n<p>&nbsp;<\/p>\n<p>A fair question that ought to be asked and answered by every manufactured housing publisher, trade association, and pundit is this. How is it possible that MHI\u2019s CEO, a Ph.D. in political science, made such a glaring goof during her recent listening session address remarks to the Federal Housing Finance Agency (FHFA), Fannie Mae and Freddie Mac? \u00a0Was \u201cDr. Gooch\u201d handing Fannie, Freddie, and the FHFA an excuse to sabotage efforts by other nonprofits to get DTS chattel lending from what was once a norm in manufactured home lending some 20 plus years ago?<\/p>\n<p>&nbsp;<\/p>\n<table>\n<tbody>\n<tr>\n<td width=\"48\">from:<\/td>\n<td width=\"223\"><strong>L. It arguably made the point in the analysis segment that Gooch&#8217;s remarks on the &#8220;may&#8221; vs. &#8220;shall&#8221; issue was an inexplicable stance to take if MHI is sincerely interested in getting chattel lending robustly implemented by Fannie Mae and Freddie Mac.<\/p>\n<p>MHProNews has heard from a MHEC member that said that Gooch&#8217;s remarks were a &#8220;cardinal sin&#8221; and may represent the first time that anyone in the DTS mix has publicly made that point with respect to chattel lending. If Fannie and Freddie haven&#8217;t made that argument publicly, why did MHI do so?<\/p>\n<p>MHProNews plans a follow up.<\/p>\n<ul>\n<li>MHARR has been asked for a remark, which they provided immediately.<\/li>\n<li>We are hereby requesting a formal explanation from MHI as to why Gooch said what she did during the listening session if MHI sincerely desires DTS to be fully implemented on chattel as well as land-home lending?<\/li>\n<\/ul>\n<p>Given this apparent fumble (again, see the report linked below), is MHI going to ask Senator Tim Scott to formally amend his ROAD to housing bill to amend HERA 2008 to change that DTS language from &#8216;may&#8217; to &#8216;shall&#8217; in order to fix what MHI&#8217;s CEO goofed?<\/p>\n<p>You know the drill. The BCC&#8217;s documented the outreach.<\/p>\n<p>&nbsp;<\/p>\n<h3><strong>Part II<\/strong><\/h3>\n<p>Time and again, \u2018mistakes\u2019 have been made by MHI during much of the 21<sup>st<\/sup> century that magically manage to benefit the industry\u2019s consolidators, who also routinely happen to be MHI members. Amazing, isn\u2019t it?<\/p>\n<p>In hindsight, isn\u2019t it obvious that the DTS \u201coversight\u201d alleged by that MHEC member was yet another convenient oversight that benefited Berkshire Hathaway owned Clayton Homes, 21<sup>st<\/sup> Mortgage Corporation, and Vanderbilt Mortgage and Finance (VMF)?<\/p>\n<p>Those \u201coversights\u201d caused financial pains for untold numbers of stockholders, independent businesses, sellers, consumers, investors, taxpayers, and others.<\/p>\n<p>Early on in Gooch\u2019s remarks, she said that the: \u201cDuty to Serve took a long time to stand up but is now beginning to kick in and I commend the teams at FHFA, Fannie Mae and Freddie Mac for their efforts.<\/p>\n<p>So far, there are some bright spots, but overall Enterprise performance with respect to DTS in the manufactured home space is at best mixed.\u201d<\/p>\n<p>After praising Fannie and Freddie for their support for MHI\u2019s obviously failed CrossMod\u2019s scheme, which she referred to as: \u201cMH Advantage and Choice home programs for Cross Mod homes.\u201d Can MHI be so sloppy as to have typos for all three of those brand names, including their own? Apparently so. See the full context which used the <a href=\"https:\/\/www.manufacturedhomepronews.com\/you-cant-make-this-up-lesli-gooch-ph-d-manufactured-housing-institute-ceo-proclaims-i-commend-the-teams-at-fhfa-fannie-mae-and-freddie-mac-saturday-satire-plus-m\/\">MHI document of her remarks obtained from an MHI email at this link here<\/a>.<\/p>\n<p>Gooch said under the topical subheading of \u201c<strong>Personal Property Loans\u201d the following. <\/strong><\/p>\n<p>\u201cThe one area that there is universal agreement on that Fannie and Freddie have failed in Manufactured Housing Duty to Serve is personal property \u2013 sometimes referred to as chattel \u2013 loans.\u201d That\u2019s true enough. But then comes the outrageous part that the MHEC member said \u2018You should crucify Gooch for saying.\u2019 Given that these were prepared remarks, how can their be any excuse for a Ph.D. in political science to say the following?<\/p>\n<p>\u201cThe Duty to Serve statute does not require Fannie and Freddie to purchase personal property loans \u2013 but does say explicitly that they QUOTE \u2013 \u201cmay consider\u201d such loans.\u201d Since when is it Dr. Gooch\u2019s job to give Fannie and Freddie \u2013 or FHFA for that matter \u2013 with an excuse?<\/p>\n<p>As if the tragic comedy of errors wasn\u2019t bad enough, Gooch then said (all per MHI\u2019s copy of her prepared remarks) \u201cFannie and Freddie cannot be considered to be fulfilling their Duty to Serve Manufactured Housing statutory responsibility without purchasing such loans since personal property loans constitute the vast majority of all new manufactured homes.\u201d That\u2019s fine. But it is essentially nullified by her previous remark. It is mind numbingly bad judgment to have said the prior and then followed it up with the former. Her remarks: \u201cThe Duty to Serve statute does not require Fannie and Freddie to purchase personal property loans \u2013 but does say explicitly that they QUOTE \u2013 \u201cmay consider\u201d such loans\u201d added nothing to the discussion, <em>UNLESS<\/em> MHI is giving Fannie, Freddie, and FHFA a pass on implementation of DTS for chattel lending.<\/p>\n<p>That\u2019s precisely what Doug Ryan for CFED (later rebranded and now known as Prosperity Now) claimed was MHI\u2019s (unstated) plan. \u201cThis is likely why it and the Manufactured Housing Institute \u2013 the industry\u2019s trade association \u2013 have been unwilling to criticize the rule, even though including such loans could bolster manufactured home sales by attracting new lenders.\u201d Ryan also said: \u201c<strong style=\"font-style: inherit;\">Those dominating the industry <\/strong><strong>[i.e.: Berkshire owned Clayton Homes and their affiliated lending]<\/strong><strong> likely fear incursions into their vertically integrated market<\/strong>.\u201d<\/p>\n<p>Ryan was arguably described Clayton\u2019s and their lending\u2019s moat.<\/p>\n<p>Warren Buffett may have been posturing and paltering, but nevertheless he himself said that Fannie and Freddie implementing chattel loans would be good for the manufactured housing industry. Buffett said the following during a Berkshire Hathaway annual meeting.<\/p>\n<p>Per the YouTube generated transcript, Warren Buffett at:<\/p>\n<p>1:10<\/p>\n<p>\u201c\u2026expand we already we already solved I<\/p>\n<p>1:12<\/p>\n<p>don&#8217;t know whether it&#8217;s 10 million a<\/p>\n<p>1:14<\/p>\n<p>month of loans or something like that to<\/p>\n<p>1:17<\/p>\n<p>Freddie and Fannie but it would be very<\/p>\n<p>1:19<\/p>\n<p>good for America in my view if Freddie<\/p>\n<p>1:24<\/p>\n<p>and Fannie did more in that area.\u201d<\/p>\n<p>1:27<\/p>\n<p>\u201cObviously we would sell some more homes<\/p>\n<p>1:30<\/p>\n<p>but we would lose financing and we might<\/p>\n<p>1:33<\/p>\n<p>come out behind we might come out ahead<\/p>\n<p>1:35<\/p>\n<p>but I think is that I think it would be<\/p>\n<p>1:39<\/p>\n<p>a good thing to do, Charlie. &#8230;&#8221;<\/p>\n<p>&nbsp;<\/p>\n<p><iframe title=\"YouTube video player\" src=\"https:\/\/www.youtube.com\/embed\/0cyn4WDKifg\" width=\"560\" height=\"315\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/p>\n<p>&nbsp;<\/p>\n<p>Buffett said it. Clayton Homes may \u2018come out behind or ahead\u2019 because they could lose financing profits but may gain that back in the profits generated by more manufactured home sales. \u201cIt would be a very good thing, in my view, if Freddie and Fannie did more [lending] in that [manufactured home] area.\u201d<\/p>\n<p>Gooch was quite right in pointing out that such loans are profitable. MHI has several lenders that are making those chattel loans profitably.<\/p>\n<p>What caused the GSEs to exit the support previously given in the 1990s and early 2000s to manufactured home chattel lending were the widespread problems caused by \u2018liar loans.\u2019 But as 21<sup>st<\/sup>\u2019s President and CEO, Tim Williams and Marty Lavin, J.D., both of whom have run manufactured home lending operations for years said in their own words, the problems with fraudulent manufactured home lending was wrung from the system through a painful process that began some 2 decades ago. The argument can be made that by the time DTS was enacted, safeguards had been built into the systems used by the industry\u2019s remaining lenders. As Lavin expressed it, \u2018Losses in the late 1990s and early 2000s caused most lenders to exit manufactured housing. The remaining lenders implemented strict controls to prevent fraud.\u2019<\/p>\n<p>&nbsp;<\/p>\n<p><iframe title=\"Inside MH Road Show - Marty Lavin Interview\" src=\"https:\/\/player.vimeo.com\/video\/139999115?badge=0&amp;autopause=0&amp;player_id=0&amp;app_id=58479\" width=\"560\" height=\"315\" frameborder=\"0\"><\/iframe><\/p>\n<p>&nbsp;<\/p>\n<p><a href=\"https:\/\/www.manufacturedhomepronews.com\/wp-content\/uploads\/2021\/08\/AcquistionsConsolidationsHighlyFragmentedManufacturedHousingInstituteLogoMembersFlagshipCommunitiesNathanSmithKevinClaytonTimWilliams21stQuotesInfographicMAMHProNews.png\" target=\"_blank\" rel=\"noopener\">Kevin Clayton<\/a> made a similar argument in <a href=\"https:\/\/www.manufacturedhomepronews.com\/masthead\/dems-provide-revealing-clayton-info-kevin-clayton-ceo-clayton-homes-federal-testimony-yields-apparent-agreements-with-mharr-concurs-with-manufactured-housing-institute-berkshire-hathaway-fhfa-and\/\" target=\"_blank\" rel=\"noopener\">his remarks to Congress<\/a>.<\/p>\n<p>But the point here is that Gooch handed the GSEs a <em>giftwrapped excuse<\/em>.<\/p>\n<p>&nbsp;<\/p>\n<figure style=\"width: 600px\" class=\"wp-caption aligncenter\"><img decoding=\"async\" src=\"https:\/\/www.manufacturedhomepronews.com\/wp-content\/uploads\/2021\/03\/DougRyanPicProsperityNowLOGOQuoteCapitalAccessClaytonHomesLWhyManufacturedHousingInstituteUnwillingCritizeExclusionChattelLoansBoostSalesAttractNewManufacturedHomeLendersMHProNewsLogo.jpg\" alt=\"\" width=\"600\" height=\"320\" \/><figcaption class=\"wp-caption-text\"><a href=\"https:\/\/www.manufacturedhomepronews.com\/epic-kevin-clayton-moat-rant-analysis-lesli-gooch-debate-defense-doug-ryan-charge-end-clayton-monopoly-over-manufactured-housing-breaching-buffett-berkshire-clayton-monopolistic-moat-method\/\" target=\"_blank\" rel=\"noopener\"><i> https:\/\/www.manufacturedhomepronews.com\/epic-kevin-clayton-moat-rant-analysis-lesli-gooch-debate-defense-doug-ryan-charge-end-clayton-monopoly-over-manufactured-housing-breaching-buffett-berkshire-clayton-monopolistic-moat-method\/ <\/i><\/a><\/figcaption><\/figure>\n<p>&nbsp;<\/p>\n<p>William \u201cBill\u201d Boor, who said <a href=\"https:\/\/www.manufacturedhomepronews.com\/cavco-ceo-william-bill-boor-for-mhi-to-congress-esg-distorts-market-v-roxanne-bland-martin-lavin-follow-the-money-pay-more-attenti\/\" target=\"_blank\" rel=\"noopener\">he will be MHI\u2019s next chairman and is Cavco Industries president and CEO, in his remarks to Congress that<\/a>: \u201cThe manufactured housing industry is at a critical crossroads due to regulatory barriers and market forces.\u201d<\/p>\n<p>After explaining that HUD has had jurisdiction over manufactured housing construction and safety standards for decades, Boor said: \u201cHowever, the jurisdictional lines were blurred in 2007 when a rider was attached to\u00a0the Energy Independence and Security Act of 2007 (EISA). In that rider, the DOE was directed to \u201cestablish standards for energy efficiency in manufactured housing.\u201d<sup>\u00a04<\/sup>\u00a0This language had not been subject to congressional hearings and the House Financial Services Committee, which has jurisdiction over HUD and therefore the manufactured housing construction code, was not aware of this provision. So, how can we explain that MHI&#8217;s board has kept Gooch for so long with so many <a href=\"https:\/\/www.manufacturedhomepronews.com\/whistleblowers-documents-on-lesli-gooch-manufactured-housing-institute-ceo-new-discoveries\/\" target=\"_blank\" rel=\"noopener\">documented problematic behaviors<\/a>? Isn&#8217;t the answer as obvious as it is corrupt?\u00a0 They find Gooch useful for their well-documented <a href=\"https:\/\/www.manufacturedhomepronews.com\/wp-content\/uploads\/2021\/08\/AcquistionsConsolidationsHighlyFragmentedManufacturedHousingInstituteLogoMembersFlagshipCommunitiesNathanSmithKevinClaytonTimWilliams21stQuotesInfographicMAMHProNews.png\" target=\"_blank\" rel=\"noopener\">consolidation purposes<\/a>.<\/p>\n<p>MHI&#8217;s board, and MHI&#8217;s staff leadership, are under the spotlight. Their &#8216;heads they win, tails you lose&#8217; methodology has long been exposed here on <em>MHProNews<\/em>. Others are being incentivized to look the other way, to borrow the Upton Sinclair insight. They won&#8217;t answer the reasonable questions like the ones mentioned above. ##<\/p>\n<p><em>PS:<\/em> In that photo of MHI CEO Gooch at the top, what is in that drink she is holding?
