Federally sponsored commissions, task forces, and councils under both Democratic and Republican administrations have examined the effects of land use regulations on affordable housing for\u00a0<a href=\"https:\/\/www.huduser.gov\/portal\/publications\/RBCPUBS\/NotInMyBackyward.html\">more than 50 years<\/a>.\u201d That link is to a document entitled \u201cNot in My Back Yard [NIMBY] Removing Barriers to Affordable Housing.\u201d It mentioned the phrase \u201cmanufactured home\u201d six (6) times, per a Word search of that 168-page report. \u201cManufactured housing\u201d was mentioned 38 times in the federally commissioned research. On 7.20.2022 Professor Lee E. Ohanian <a href=\"https:\/\/www.manufacturedhomepronews.com\/wp-content\/uploads\/2023\/06\/PolicyProposalsToIncreaseAffordableHousingProfLeeE.OhanianSenateFinanceCommitteeTestimony7.19.2022-JamesSchmitzSabotagingMonopoliesManufacturedHousingMHProNewsMast.pdf\" target=\"_blank\" rel=\"noopener\">delivered testimony to the U.S. Senate Finance Committee<\/a>. The text of his remarks &#8211; <a href=\"https:\/\/www.manufacturedhomepronews.com\/wp-content\/uploads\/2023\/06\/PolicyProposalsToIncreaseAffordableHousingProfLeeE.OhanianSenateFinanceCommitteeTestimony7.19.2022-JamesSchmitzSabotagingMonopoliesManufacturedHousingMHProNewsMast.pdf\" target=\"_blank\" rel=\"noopener\"><em>Policy Proposals to Increase Housing Affordability<\/em><\/a> &#8211; run six (6) pages and Ohanian used the phrase \u201cmanufactured home\u201d six (6) times and \u201cmanufactured housing\u201d a dozen times. Ohanian\u2019s written testimony referenced the work of James A. \u201cJim\u201d Schmitz Jr. and his research colleagues five (5) times.<\/p><div id=\"manuf-4292446819\" class=\"manuf-content manuf-entity-placement\"><script async src=\"\/\/pagead2.googlesyndication.com\/pagead\/js\/adsbygoogle.js?client=ca-pub-3870480136270376\" crossorigin=\"anonymous\"><\/script><ins class=\"adsbygoogle\" style=\"display:block;\" data-ad-client=\"ca-pub-3870480136270376\" \ndata-ad-slot=\"\" \ndata-ad-format=\"auto\"><\/ins>\n<script> \n(adsbygoogle = window.adsbygoogle || []).push({}); \n<\/script>\n<\/div>\n<p>Specifically noted by Professor Ohanian to the U.S. Senate was Schmitz and his Minneapolis Federal Reserve colleagues work in 2020 is a document entitled: \u201cSolving the Housing Crisis will Require Fighting Monopolies in Construction.\u201d There we can find the phrase \u201csabotaging monopolies.\u201d<\/p>\n<p>A Google search of &#8211; &#8220;sabotaging monopolies&#8221; James Schmitz &#8211; on 6.20.2023 yielded 11 results. The top two of those search results are on the Minneapolis Federal Reserve website. No link mentioning Schmitz and his colleagues work on the \u201csabotaging\u201d of manufactured housing are found on the Manufactured Housing Institute (MHI) website. No references to &#8220;sabotaging monopolies&#8221; and Schmitz are identified by Google as being on a website of a blogger or publication that is a member of MHI.<\/p>\n<p>Senator Tim Scott (SC-R) has a positive story to share. Scott is a declared presidential candidate for the Republican nomination in 2024. He appears to be pro-manufactured housing, which is no surprise, since his state has one of the highest percentages of mobile and manufactured homes in the nation. <a href=\"https:\/\/www.manufacturedhomelivingnews.com\/manufactured-homes-truly-one-of-best-opportunities-for-realizing-dream-of-homeownership-says-sen-tim-scott-rips-doe-standards-overly-broad-unduly-burdensome-cost\/\">Senator Scott wrote a helpful and supportive letter to Department of Energy (DOE) Secretary Jennifer Granholm<\/a> on behalf of manufactured housing seeking a stay in those regulations that the industry has agreed is harmful. Restated, he put some level of action behind his words.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Examples of Senator Scott in His Own Words<\/strong><\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">Federal housing programs are meant to transition Americans out of poverty \u2013 not trap them in it. Media plays a role, as does academic and other research. These are realities that U.S. Senator Tim Scott from South Carolina, along with all other federal lawmakers, know quite well.<\/p>\n<p>Much of Senator Scott\u2019s message is about optimism and opportunities. Scott\u2019s faith is stressed, and certainly the Hebrew (Old Testament) and explicitly Christian (New Testament) biblical books are numerous references to fighting for justice, to defend the rights of the poor from being defrauded or harmed, and prohibitions against lying and deception. Scott\u2019s foundational positions on faith, optimism and opportunity are to be commended.<\/p>\n<p>Indeed, the ROAD to Housing Act includes an acronym that builds on that theme: \u201cRenewing Opportunity in the American Dream (ROAD) to Housing Act.\u201d Implicit in the proposal is a suggestion that millions are effectively barred from affordable home ownership. As the bill draft states as the aim of the legislation: \u201cTo increase access to affordable housing, reduce regulatory barriers, increase oversight, and assist the most vulnerable.\u201d Hold those thoughts, as we will return to them.<\/p>\n<p>There are different kinds of legislation. Some pieces of legislation are announced <em>knowing<\/em> that a bill will never be enacted into law, at least, not during a time when an opposing party holds power. Other legislation legitimately aims to gain bipartisan support, which for years has been a key to getting a bill through a closely divided Congress and onto a presidential desk to be signed into law.<\/p>\n<p>What may be useful, or even imperative, in his ROAD to Housing Act &#8211; and for his campaign &#8211; are a demonstration of his willingness to do what Ohanian, Schmitz, Samuel \u201cSam\u201d Strommen, and others have said is necessary. Namely, a clearly declared willingness to take on the monopolistic forces that are \u201csabotaging\u201d the U.S. Housing market.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>The Bureaucracy<\/strong><\/p>\n<p>Equally important is a willingness to take on what has been called \u201cthe permanent bureaucracy,\u201d \u201cthe Deep State\u201d and other less generous terms, such as \u201cthe Washington, D.C. Swamp.\u201d It isn\u2019t that there is no evidence that Scott has tackled those topics. But the evidence may not rise to the level one might think necessary to successfully fight what Schmitz, Strommen, and others indicate is necessary. Time will tell.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>The Iron Triangle and the Revolving Door<\/strong><\/p>\n<p>For those who hope and pray for authentic progress on serious problems facing America, there may be good news from a political and policy standpoint. Polling seems to suggest that a growing number of citizens have become aware of the problems of the permanent and unelected bureaucracy.<\/p>\n<p>For example, a <a href=\"https:\/\/www.manufacturedhomepronews.com\/wp-content\/uploads\/2020\/01\/LeftRightMediaBiasChartInfographicManufacturedHomeProNewsSharylAttkisson.jpg\" target=\"_blank\" rel=\"noopener\">left-<\/a>leaning <em><a href=\"https:\/\/abcnews.go.com\/Politics\/lies-damn-lies-deep-state-plenty-americans-poll\/story?id=47032061\">ABC News\/Washington Post<\/a><\/em> poll in 4.27.2017 said: \u201cNearly half of Americans think there&#8217;s a &#8216;deep state.&#8217;\u201d<\/p>\n<p>Less than a year later 3.19.2018), an article on <a href=\"https:\/\/www.manufacturedhomepronews.com\/wp-content\/uploads\/2020\/01\/LeftRightMediaBiasChartInfographicManufacturedHomeProNewsSharylAttkisson.jpg\" target=\"_blank\" rel=\"noopener\">left-<\/a>leaning <a href=\"https:\/\/www.vox.com\/2018\/3\/19\/17139910\/deep-state-poll-trump\"><em>Vox<\/em> said<\/a> the following.<\/p>\n<p>\u201cIs the government secretly being controlled by an unelected group of officials \u2014 a so-called \u201cdeep state\u201d? The majority of the country seems to think so, according to a\u00a0<a style=\"font-style: inherit;\" href=\"https:\/\/www.politico.com\/story\/2018\/03\/19\/poll-deep-state-470282\"><strong>Monmouth University<\/strong><\/a>\u00a0poll released Monday.<\/p>\n<p>Once thought of as the domain of\u00a0<a style=\"font-style: inherit;\" href=\"https:\/\/www.theguardian.com\/us-news\/2018\/feb\/21\/crisis-actors-deep-state-false-flag-the-rise-of-conspiracy-theory-code-words\"><strong>conspiracy theorists<\/strong><\/a>\u00a0(and, later, the president of the United States), the perception of unelected officials having undue influence has gone mainstream. Seventy-four percent of poll respondents said the deep state, \u201ca group of unelected government and military officials who secretly manipulate or direct national policy,\u201d \u201cdefinitely\u201d or \u201cprobably\u201d exists.<\/p>\n<p>Only 37 percent of Americans said they were at least \u201csomewhat familiar\u201d with the term \u201cdeep state.\u201d However, given the description, 27 percent said the deep state definitely exists and 47 percent said it probably exists.\u201d<\/p>\n<p>&nbsp;<\/p>\n<p>The arguably related terms \u201c<strong><a href=\"https:\/\/www.manufacturedhomepronews.com\/wp-content\/uploads\/2021\/03\/IronTriangleIssueNetworksQUOTES-KhanAcademyLOGO-MHProNewsLogoLesliGoochPhotoManufacturedHousingInstituteLogoJimGrayFHFALincolnLandPhotoLOGO.jpg\" target=\"_blank\" rel=\"noopener\">Iron Triangle<\/a><\/strong>\u201d and \u201c<strong><a href=\"http:\/\/RevolvingDoorDefinitionExamplesImpactingManufacturedHousingFederalHousingFinancePolicyJimGrayDavidDworkinNHC-FHFA-LincolnInstManufacturedHomeProNews.jpg\" target=\"_blank\" rel=\"noopener\">Revolving Door<\/a><\/strong>\u201d may not have yet achieved household discussion status. That said, the polling cited suggests that the intellectual foundation for a <a href=\"https:\/\/www.manufacturedhomepronews.com\/wp-content\/uploads\/2021\/08\/DeepStateMeaningWikipedia.png\" target=\"_blank\" rel=\"noopener\">\u2018deep state<\/a>\u2019 style of casual collusion \u2013 i.e.: the Iron Triangle and Revolving Door &#8211; that has long existed between advocates, lobbyists, public officials, and lawmakers could be broached by bold candidates. Hold those thoughts.<\/p>\n<p>For those not yet in that terminology loop, left-leaning Wikipedia describes the Iron Triangle like this.<\/p>\n<p><a href=\"https:\/\/www.manufacturedhomepronews.com\/masthead\/wp-content\/uploads\/2022\/09\/QuoteMarksLeftSide.png\"><img decoding=\"async\" class=\"size-full wp-image-20771 alignleft\" src=\"https:\/\/www.manufacturedhomepronews.com\/masthead\/wp-content\/uploads\/2022\/09\/QuoteMarksLeftSide.png\" alt=\"QuoteMarksLeftSide\" width=\"102\" height=\"73\" \/><\/a>In <a href=\"https:\/\/en.wikipedia.org\/wiki\/Politics_of_the_United_States\">United States politics<\/a>, the\u00a0<strong>&#8220;iron triangle&#8221;<\/strong>\u00a0comprises the\u00a0<a href=\"https:\/\/en.wikipedia.org\/wiki\/Policy\">policy<\/a>-making relationship among the\u00a0<a href=\"https:\/\/en.wikipedia.org\/wiki\/Congressional_committee\">congressional committees<\/a>, the\u00a0<a href=\"https:\/\/en.wikipedia.org\/wiki\/Bureaucracy\">bureaucracy<\/a>, and\u00a0<a href=\"https:\/\/en.wikipedia.org\/wiki\/Interest_group\">interest groups<\/a>,<sup><a href=\"https:\/\/en.wikipedia.org\/wiki\/Iron_triangle_(US_politics)#cite_note-2\">[2]<\/a><\/sup>\u00a0as described in 1981 by\u00a0<a href=\"https:\/\/en.wikipedia.org\/w\/index.php?title=Gordon_Adams&amp;action=edit&amp;redlink=1\">Gordon Adams<\/a>.<sup><a href=\"https:\/\/en.wikipedia.org\/wiki\/Iron_triangle_(US_politics)#cite_note-3\">[3]<\/a><a href=\"https:\/\/en.wikipedia.org\/wiki\/Iron_triangle_(US_politics)#cite_note-4\">[4]<\/a><\/sup>\u00a0Earlier mentions of this \u2018iron triangle\u2019 concept are in a 1956\u00a0<em>Congressional Quarterly Weekly Report<\/em>\u00a0as, \u201cIron triangle: Clout, background, and outlook\u201d and \u201cChinks in the Iron Triangle?\u201d<sup><a href=\"https:\/\/en.wikipedia.org\/wiki\/Iron_triangle_(US_politics)#cite_note-5\">[5]<\/a><\/sup>\u201d<\/p>\n<p>Open Secrets, the National Conference of State Legislatures, and <em>Investopedia <\/em>are among the top results on Google for: revolving door in government. Per <em>Investopedia<\/em>: \u201cA\u00a0<em><strong>revolving door<\/strong><\/em>\u00a0is the movement of high-level employees from\u00a0<em><strong>public-sector<\/strong><\/em>\u00a0jobs to private sector jobs and vice versa.\u201d Once more, hold those thoughts for later.<\/p>\n<p>Pivoting back to Blumenthal and Gray\u2019s research on barriers to more affordable housing: \u201cNumerous <a href=\"https:\/\/faculty.wharton.upenn.edu\/wp-content\/uploads\/2017\/05\/Regulation-and-Housing-Supply-1.pdf\">studies<\/a>\u00a0find land use regulations that limit the number of new units that can be built or impose significant costs on development through fees and long approval processes drive up housing costs.\u00a0<a href=\"https:\/\/papers.ssrn.com\/sol3\/papers.cfm?abstract_id=3907645\">Research<\/a>\u00a0indicates higher housing costs also drive up program costs for federal assistance, reducing the funds available to serve additional households.\u201d While the two colleagues never explicitly mentioned manufactured housing, their including the \u201c<a href=\"https:\/\/www.manufacturedhomepronews.com\/wp-content\/uploads\/2022\/10\/NotInMyBackyardRemovingBarriersToAffordableHousingHUDuserResearch1991-Downloaded10.13.2022fromHUDforManufacturedHomeLivingNewsMHProNews.pdf\" target=\"_blank\" rel=\"noopener\">Not in My Back Yard: Removing Barriers to Affordable Housing<\/a>\u201d research which cited manufactured homes numerous times suggests they appear to be at least aware of the importance of manufactured housing. The irony is that HUD is the primary federal regulator of HUD Code manufactured homes. Yet Blumenthal and Gray, working for HUD, did not specifically mention manufactured housing?<\/p>\n<p>Prior HUD Secretary Ben Carson, M.D., was an apparent proponent of manufactured housing. While HUD Secretaries, past and present, have mentioned manufactured housing \u2013 perhaps out of politeness or good politics \u2013 <em>when<\/em> the topic is raised or <em>when<\/em> those in the audience tend to need to hear those words. In contrast to that, former Sec. Carson spoke about <a href=\"https:\/\/www.manufacturedhomepronews.com\/wp-content\/uploads\/2019\/05\/HUDSecretaryBenCarsonAffordableHousingSupplyDemandCostSavingsFHFAAppreciationSustainableOwnership5000renters200000OwnersQuotesMHProNews-1.jpg\" target=\"_blank\" rel=\"noopener\">manufactured homes when it was<\/a>, and <a href=\"https:\/\/www.manufacturedhomepronews.com\/wp-content\/uploads\/2020\/02\/HUDSecretaryBenCarsonQuoteExtraordinaryInnovativeManufacturedHousingBarriersEagleRightWingLeftWingManufacturedHomeProNews.png\" target=\"_blank\" rel=\"noopener\">when it wasn\u2019t expected<\/a>, as the linked examples reflect.<\/p>\n<p>Dr. Carson\u2019s remarks posted on the HUD website on 5.7.2019 said: \u201cHUD&#8217;s mission is to ensure all Americans have access to safe, quality, and affordable housing. And we believe that manufactured housing has a promising role to play &#8211; especially in the area of quality affordable housing. For that reason, one year ago, I announced that HUD was in position to usher in a &#8220;new era of cooperation and collaboration between our Department and the manufactured housing industry.&#8221;\u201d<\/p>\n<p>Having read several times how Schmitz and his colleagues\u2019 assert with evidence that HUD and the National Association of Home Builders (NAHB) were part of the problem of \u201csabotaging monopolies,\u201d Dr. Carson\u2019s remarks take on a fascinating light. The primary regulator \u2013 HUD \u2013 had its prior secretary \u2013 Dr. Ben Carson \u2013 during the more pro-business, pro-housing Trump Administration take a stance that seemed to acknowledge that HUD in the past been less than supportive of manufactured housing. Why else would Carson have said: \u201cthat HUD was in position to usher in a &#8220;new era of cooperation and collaboration between our Department and the manufactured housing industry.&#8221;&#8221; Regardless of party labels, thoughtful individuals who care about <em>solutions<\/em> more than partisanship should lean in and want to learn more.\u00a0 That is a role that Senator Scott could champion. More on that shortly.<\/p>\n<p>If the Manufactured Housing Association for Regulatory Reform (MHARR) is known for a certain thing, they could be summed up something like this.<\/p>\n<ul>\n<li>MHARR wants to see existing federal laws that on paper are supportive of manufactured housing to be fully and properly implemented. On paper, MHI does too, as the example <a href=\"https:\/\/www.manufacturedhomepronews.com\/wp-content\/uploads\/2023\/05\/EnhancedPreemptionQuoteLesliGoochManufacturedHousingInstiBillMatchneerHUDOfficeManufacturedHousingProgramsOMHPAdminMarkWeissManufacturedHousingAssocMHARRMembersCongressMHProNews.jpg\" target=\"_blank\" rel=\"noopener\"><strong>linked here<\/strong><\/a> Note that this goes to the heart of what the <a href=\"https:\/\/www.manufacturedhomepronews.com\/trojan-horse-looming-impact-troubling-questions-history-raised-on-potentially-deceptive-bait-and-switch-housing-legislation-poised-to-harm-manufactured-home-industry-facts-and-ana\/\" target=\"_blank\" rel=\"noopener\">ROAD to Housing Act, Senator Scott<\/a> and others say they hope the act would achieve; quoting the draft\u2019s goal for the ROAD again: \u201cTo increase access to affordable housing, reduce regulatory barriers, increase oversight, and assist the most vulnerable.\u201d<\/li>\n<li>MHARR has <a href=\"https:\/\/manufacturedhousingassociationregulatoryreform.org\/ending-the-string-of-self-inflicted-manufactured-housing-industry-wounds-january-2023-mharr-issues-and-perspectives\/\" target=\"_blank\" rel=\"noopener\">challenged MHI<\/a> with <a href=\"https:\/\/manufacturedhousingassociationregulatoryreform.org\/mharr-white-paper-exposes-public-relations-exploitation-notwithstanding-continuing-industry-failures\/\" target=\"_blank\" rel=\"noopener\">posturing support for existing federal laws<\/a>, but then failing to do what is necessary and logical for supposed benefits to &#8220;<a href=\"https:\/\/manufacturedhousingassociationregulatoryreform.org\/mharr-white-paper-exposes-public-relations-exploitation-notwithstanding-continuing-industry-failures\/\" target=\"_blank\" rel=\"noopener\">reach the ground<\/a>&#8221; (be of practical use) for manufactured housing consumers and professionals if they actually want that support to advance.<\/li>\n<li>By name and implication, <a href=\"https:\/\/manufacturedhousingassociationregulatoryreform.org\/mharr-releases-study-recommending-independent-collective-representation-for-post-production-sector\/\" target=\"_blank\" rel=\"noopener\">MHARR has repeatedly said that MHI is failing<\/a> to get the job done in <a href=\"https:\/\/www.manufacturedhomepronews.com\/masthead\/shell-game-affordable-manufactured-home-threats-on-steriods-exclusive-probe-into-manufactured-housing-industrys-twin-crises-a-one-on-one-interview-with-mharr\/\" target=\"_blank\" rel=\"noopener\">the post-production sector of the industry<\/a>. Note that MHI is an umbrella-style trade group that has both manufactured home <em>production<\/em> and <em>post-production <\/em>firms as members. MHARR is made up of independent producers of manufactured homes along with some affiliates who support their mission.<\/li>\n<li>MHI is several times larger than MHARR. But MHARR has used facts, evidence, the law and information to spotlight what is and is not occurring in Washington, D.C. With information, they have at times caused MHI to do what they ought to want to do if they actually meant what they said about representing \u201call segments\u201d of the manufactured home industry.<\/li>\n<\/ul>\n<p>If MHARR were alone in those concerns about MHI and federal regulators, they might be easily dismissed as an outlier. But MHARR\u2019s decades in the trenches of Washington are directly and indirectly supported by researchers such a Schmitz, his colleagues, Strommen, and others. Furthermore, some <a href=\"https:\/\/www.manufacturedhomepronews.com\/wp-content\/uploads\/2023\/06\/ManufacturedHousingInstituteLOGO-MHI-RepresentsAllSegmentsFactoryBuiltManufacturedHousingQuotesCounterclaimsSamuelStrommenMartyLavinDanny-GhorbaniNealHaneyMHProNewsFactsAnalysis-scaled.jpg\" target=\"_blank\" rel=\"noopener\">past and current MHI members have expressed concerns that align with MHARR\u2019s, Strommen&#8217;s and others&#8217; allegations against MHI<\/a>. Let&#8217;s briefly look more closely at what Ohanian said. The bold in the title of Schmitz&#8217;s research is added by the <em>Masthead<\/em> on <em>MHProNews<\/em>.<\/p>\n<ul>\n<li>&#8220;America\u2019s housing crisis is nearly 100 years old, dating back to the 1920s when the average home price in Manhattan was over $1.2 million in inflation-adjusted dollars<sup>2<\/sup>. In the last century, dozens, and perhaps hundreds of federal, state, and local agencies have been created to deliver affordable housing, but affordability remains elusive, particularly for low and middle-income households.&#8221;<\/li>\n<li>&#8220;Increasing housing affordability requires addressing two related issues. We must expand housing supply and we must build new housing at a much lower cost.&#8221;<\/li>\n<li>&#8220;I focus on two areas for policy responses: (1) increasing the use of manufactured housing, which is much more cost efficient than traditionally built housing&#8230;&#8221;<\/li>\n<li><em>&#8220;Summary: Manufactured housing is 60 percent less expensive to build per square than traditionally built housing, but regulations and financing difficulties have significantly hampered adoption of these homes. &#8230;&#8221;<\/em><\/li>\n<li>&#8220;But modern production methods are notably absent from our residential construction industry, which builds homes in much the same way as they have always been built, as described in an important recent study of manufactured housing by James A. Schmitz, his colleagues, Samuel Strommen, and others who have studied these issues for some time. Ironically, several MHI brands that <a href=\"https:\/\/www.manufacturedhomelivingnews.com\/reflections-on-death-of-sam-zell-and-late-equity-lifestyle-properties-els-chairman-zells-impact-on-manufactured-home-living-and-the-affordable-manufactured-home-profession\/\" target=\"_blank\" rel=\"noopener\">publish investor relations information flatly admit that they are focused on consolidating the manufactured home industry<\/a>.\u00a0 As the late Sam Zell said over a decade ago, he likes the oligopoly nature of the manufactured home industry. That&#8217;s akin to an in your face challenge for antitrust enforcement to occur.
