In their own words, they both argue that what the Biden White House claimed was support for manufactured housing in their recently announced plan to ease housing costs is contradicted by the DOE manufactured housing energy rule. But once objective reality minded manufactured housing professionals or affordable advocates get beyond that similar starting point, the distinctions between the MHI approach and that from MHARR begin to emerge.<\/p><div id=\"manuf-4136831774\" class=\"manuf-content manuf-entity-placement\"><script async src=\"\/\/pagead2.googlesyndication.com\/pagead\/js\/adsbygoogle.js?client=ca-pub-3870480136270376\" crossorigin=\"anonymous\"><\/script><ins class=\"adsbygoogle\" style=\"display:block;\" data-ad-client=\"ca-pub-3870480136270376\" \ndata-ad-slot=\"\" \ndata-ad-format=\"auto\"><\/ins>\n<script> \n(adsbygoogle = window.adsbygoogle || []).push({}); \n<\/script>\n<\/div>\n<p>Mark Weiss, as a result of an emailed inquiry from<em> MHProNews<\/em> said the following. \u201cThe Fifth Circuit [Court], in staying the SCC [Social Costs of Carbon] injunction, stated, in part: &#8220;And because the claimed injury, increased regulatory burdens\u00a0<u>has yet to occur<\/u>, the continued use of the Interim Estimates [<u>i.e.<\/u>, SCC] will not harm the Plaintiff states\u00a0<u>until a regulation or agency action is promulgated from the\u00a0<em>actual<\/em>\u00a0use of the Interim Estimates<\/u>&#8221; (Emphasis added).\u201d<\/p>\n<p>Weiss added, \u201cWell, now we have a final regulation &#8212; the DOE manufactured housing energy standards rule &#8212; that uses the Interim Estimates as part of its justification. And because of that [SCC] standard, we will now have specific increased &#8220;regulatory burdens&#8221; which will increase homelessness and resulting costs that will be imposed on the states. While any Supreme Court move is \u2018a long shot,\u2019 nevertheless the MHARR Amicus Brief, previously report by <em>MHProNews<\/em> at the link above, could prove to be critical for the industry to thwart the DOE\u2019s damaging plan.<\/p>\n<p>A periodic source connected with MHI provided the following to <em>MHProNews,<\/em> out of apparent concern for the ongoing \u2018head fake\u2019 by that group, which will be explained and explored further below. It will be followed by the parallel report by MHARR. The final rule is still not cost-effective and will hurt the affordability of today\u2019s manufactured homes. Because it does not take into consideration current manufactured home construction methods and transportation requirements, as well as potential testing and compliance costs, the final rule continues to underestimate price increases and annual mortgage cost increases, as well as the number of potential manufactured homebuyers who will no longer qualify for a mortgage. MHI CEO Lesli Gooch issued the following statement in response to the rule:<\/p>\n<p>\u201cThe final manufactured housing energy rule that DOE released on Wednesday undermines the Administration\u2019s Plan announced on Monday to \u2018<a href=\"https:\/\/r20.rs6.net\/tn.jsp?f=001OImbnWd8k7eGf5wsQpBKe3CtMSyHpStg9mwxqRHEFLgHKuwYaRGDH_anAzRtqu6hrbSiuug1xhV-AOZlo2QkSREBKGKTV-TQURdGXk12TrBAM2pLUqxz7gpk4sR2jDBH84HSVaVQazj5U7RgfU93WcNxOYPAmjHkMIFJEApiNGJZBeXzCMOnCwiyv-f4O4Xl1ZwipBtMlRSBYuWQRgYFlHzXp36PXzyzhGgT9jzbo8iHClYvldNskux8VJks72hP5aodqWCnmn5VgWoSWjkQoh1G8jxZGMBOnFqNNBCbIaSXcUKR_Gf8R6Pu3l27d1LI&amp;c=PhoBk_rYBP2oMDTfdufIpsmX0SyHl-L9F0fQnIOMMdZPo8f3Rkk1qQ==&amp;ch=4HlAXuFxu5kkQoownAd78XZS7AnMid_NLT-zYUeO1pHAJH-D-Y50mA==\">Ease the Burden of Housing Costs<\/a>.\u2019\u00a0Manufactured housing is by far THE most affordable homeownership option in America \u2013 and the industry is currently building quality affordable homes that are already energy efficient and resilient.\u00a0Instead, the significant cost increases to actual manufactured homebuyers far exceed the speculative energy savings the rule claims will take place.<\/p>\n<p>Under the 2000 Manufactured Housing Act, these standards should not become effective until approved by HUD and incorporated into the HUD CODE.\u00a0MHI\u2019s top priority now is to persuade HUD to instead adopt MHI\u2019s more balanced proposal, which improves energy efficiency without causing great harm to manufactured housing affordability.\u00a0This approach would better support the Administration\u2019s goal of \u201cclosing the housing supply gap in five years.\u201d<\/p>\n<p>MHI has been extensively engaging with the White House, the Department of Energy, HUD, and Congress about the DOE proposal, and MHI submitted a detailed proposal that achieves the statutory objectives of EISA of properly balancing energy efficiency and homeownership affordability. Due to these efforts, Representative David Kustoff (R-TN) has introduced H.R. 7651, the \u201cManufactured Housing Affordability and Energy Efficiency Act,\u201d which requires that before any new DOE energy standards can become effective or be enforced: (1) DOE must fully consult with HUD, (2) DOE must document that the rule is cost-effective based on the impact of homebuyer price and cost increases (3) the standards must fully take into consideration manufactured housing construction methods and transportation requirements, and (4) the standards must be adopted by HUD as part of the HUD Code. MHI has demonstrated that they are posturing, because if it those 1300 emails were effective, then this latest MHI \u201chousing alert\u201d would have been unnecessary. Based on the 2021 version of the International Energy Conservation Code (IECC), the DOE final standard will discriminatorily subject HUD Code manufactured homes and the lower and moderate-income Americans who rely on them, to energy standards more stringent and more costly than those applied to million-dollar site-built homes.<\/p>\n<p>The 362-page rule released today by DOE will apparently retain elements of the \u201ctiered\u201d structure initially outlined in the Department\u2019s August 26, 2022 proposed rule, notwithstanding DOE\u2019s stated intent, as set forth in its final April 2022 Environmental Impact Statement (EIS), to switch to an \u201cuntiered\u201d approach as the \u201cprimary\u201d scenario for the final rule. Industry members will recall that in a May 4, 2022 communication to DOE Secretary Jennifer Granholm, MHARR had vehemently objected to such a \u201cbait and switch\u201d tactic after the conclusion of any opportunity for public comment.<\/p>\n<p>As published, the compliance date for the new standards will nominally be one year after the date of publication of the final rule in the Federal Register. This, along with multiple other aspects of the new rule, represents a direct rebuke of HUD\u2019s Manufactured Housing Consensus Committee (MHCC), which had, among other things, recommended a much longer phase-in of the new standards over a five-year period.<\/p>\n<p>Put simply, the publication of this discriminatory and unnecessary edict \u2013 which MHARR has opposed and has been fighting since day-one \u2013 should be a\u00a0<u>call to arms<\/u>\u00a0for the entire industry. As MHARR has consistently demonstrated, the direct cost impacts of this standard and its related regulatory and compliance-related costs, will drive\u00a0<u>millions<\/u>\u00a0of Americans out of the manufactured housing market and deprive them of the opportunity to achieve the American Dream of homeownership altogether. This despite the fact, again as demonstrated by MHARR, that manufactured housing energy operating costs are already\u00a0<u>lower<\/u>\u00a0than those for site-built homes left untouched by the 2021 IECC.<\/p>\n<p>Most fundamentally, with the publication of the final energy standard, the industry finds itself at a\u00a0<u>cross-roads<\/u>. While MHARR has attempted to get ahead of this issue by supporting a group of states in a court challenge to the use of the Social Cost of Carbon (SCC) metric in connection with this and other federal regulations, and while a favorable decision in that case\u00a0<u>could<\/u>\u00a0still potentially impact the DOE rule, the industry now faces a\u00a0<u>direct<\/u>\u00a0and arguably existential challenge. Put simply, a discriminatory imposition on the industry and its consumers, such as the final DOE rule,\u00a0<u>cannot stand<\/u>\u00a0and must not be allowed to take effect without a specific, focused, and concerted challenge. Step by step, MHI\u2019s actions have revealed that they are not to be trusted.
