The apparent failure of the Manufactured Housing Institute (MHI) in keeping their word on behalf of independents, much less consumers, is once more arguably being manifest. These plans ostensibly address DTS initiatives in relation to the three statutorily-prescribed underserved markets \u2013 manufactured housing, rural housing and affordable housing preservation \u2013 for the next incremental period following the Enterprises\u2019 initial 2018-2020 DTS Plans and the 2021 Plan supplements filed and approved by FHFA last year.<\/p>\n<p>The most striking aspect of <u>both<\/u> proposed plans in relation to federally-regulated manufactured housing, is their <u>complete<\/u> <u>omission<\/u> of <u>any<\/u> programs, initiatives, or activities <u>of any kind<\/u> designed to provide or advance either securitization and\/or secondary market support for the manufactured housing personal property (<u>i.e.<\/u>, chattel) loans that constitute nearly <u>80%<\/u> of the HUD Code manufactured housing consumer lending market for new home purchases. The latest proposed plans thus include \u2013 <u>for their entire coverage period<\/u> \u2013 absolutely <u>no<\/u> proposed chattel loan purchases, <u>no<\/u> chattel loan \u201cpilot programs,\u201d <u>no<\/u> chattel loan data or information gathering, <u>no<\/u> \u201ceducation,\u201d <u>no<\/u> \u201cengagement,\u201d or any other activity <u>of any kind<\/u>.\u00a0 This will leave the vast majority of mainstream manufactured housing consumers completely <u>unserved<\/u>, in direct violation of the DTS mandate.<\/p>\n<p>Consequently, after more than a decade (2008-2021) of peddling a <u>complete fiction<\/u> and <u>phony narrative<\/u> to FHFA, Congress, consumers and the industry regarding their supposed interest in ultimately serving the manufactured housing personal property market \u2013 which is <u>specifically<\/u> targeted for support by the DTS provision \u2013 the 2022-2024 proposed DTS Plans finally expose <u>both<\/u> Enterprises\u2019 baseless <u>rejection<\/u> of DTS in relation to the overwhelming majority of the manufactured housing market and manufactured housing consumers.<\/p>\n<p>Indeed, the phenomenal arrogance underlying the Enterprises\u2019 rejection of a <u>direct congressional mandate<\/u>, is on full display in the Freddie Mac 2022-2024 Plan. In part, that Plan states: \u201cFor the 2022-2024 Plan cycle, Freddie Mac will devote our resources to supporting the real property manufactured housing market\u2026. We will not pursue the purchase and securitization of personal property loans on MH. <u>With nearly two-thirds of personal property MH borrowers owning both the land and the home, our focus will continue to be on increasing the industry\u2019s understanding of the beneficial financing and liquidity offered in the real-property space<\/u>.\u201d (<u>see<\/u>, Proposed Freddie Mac 2022-024 DTS Plan at p. MH6) (Emphasis added).<\/p>\n<p>As MHARR has explained in previous DTS comments, DTS was designed by Congress to fundamentally change <u>Fannie Mae<\/u> and <u>Freddie Mac\u2019s<\/u> approach to mainstream manufactured housing. Put differently, it was adopted to change <u>them<\/u> \u2013 the Enterprises \u2013 and their view of, approach to, and policies regarding market-significant support for traditional manufactured housing. Instead, though, Fannie Mae and Freddie Mac (with the blessing of FHFA, which presents yet another issue in itself) have sought to turn DTS on its head, misusing their DTS Plans in an indefensible and inexcusable effort to change the fundamental character of manufactured housing and its use by consumers. This first took the form of providing preferential treatment for \u201cMH Advantage\u201d and \u201cChoiceHome\u201d manufactured homes which, according to Fannie and Freddie, were \u201cmore like\u201d the site-built homes they prefer to deal with. Given the failure of that sop to the industry\u2019s largest corporate conglomerates, which has been \u2013 and continues to be \u2013 a conspicuous marketplace fiasco, the 2022-2024 proposed DTS plans have simply devolved into an unvarnished campaign to <u>force<\/u> the industry \u2013 and more importantly, the supposedly misinformed and misunderstanding 80% of manufactured housing consumers \u2013 into the \u201creal-property space\u201d where Fannie and Freddie would prefer them to be.<\/p>\n<p>This \u201clet them eat cake\u201d approach is not \u201cserving\u201d an existing \u2013 and crucial \u2013 affordable housing market, so much as it is a bad faith effort to <u>avoid<\/u> serving that market <u>as it currently exists<\/u>, while simultaneously seeking to transform it into something entirely different, that consumers have consistently demonstrated they do not want.<\/p>\n<p>As such, this bad faith action should and <u>must<\/u> be rejected by FHFA, as MHARR will assert in the comments that it will file in this matter.\u00a0 Those comments, as per MHARR\u2019s usual practice, will be filed in advance of the comment deadline so that they can be referenced by other interested parties.\u00a0 For those who wish to submit written comments in this matter, those comments must be filed by July 16, 2021.\u00a0 In addition, FHFA has announced a further \u201clistening session\u201d with regard to the proposed 2022-2024 DTS Plans, which is currently scheduled for July 14, 2021. There is perhaps no publication in all media, not just manufactured housing trade media, that has done anything close to the type of insights and analysis that MHProNews and our MHLivingNews sister site have.\u00a0 That noted, want proof that is arguably embarrassing to FHFA et al?<\/p>\n<p>Some<em> 2 months before<\/em> this report, L. A. \u201cTony\u201d Kovach provided the FHFA with the following experts comments. These comments below are also found on the FHFA website at this <a href=\"https:\/\/www.fhfa.gov\/Media\/Documents\/Kovach-statement.pdf\">link here<\/a>. The comments that follow &#8211; weeks before Fannie and Freddie published their so-called DTS plans that MHARR reported on above <strong>still fit<\/strong> the facts <em>now<\/em> as much as they did the DTS issue two months ago. That is either an amazing bit of better than Nostradamus-like insight; <em>OR<\/em> it is a sobering example of just how predictably corrupt this process appears to be.<\/p>\n<p>Here are the comments from 3.25.2021. Compare what follows to what MHARR stated and reported, as shown above.<\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: center;\"><strong>Enterprise Housing Goals FHFA Listening Session Address<br \/>\nRemarks as Prepared by <a href=\"http:\/\/latonykovach.com\/\" target=\"_blank\" rel=\"noopener\">L. A. &#8220;Tony&#8221; Kovach<\/a><br \/>\n3.25.2021<\/strong><\/p>\n<p><strong>\u201c<\/strong><strong><a href=\"https:\/\/www.manufacturedhomepronews.com\/an-elephant-ass-understanding-gses-duty-to-serve-manufactured-home-lending\/\">A Pimple on an Elephant\u2019s Ass<\/a><\/strong><strong>.\u201d<\/strong><\/p>\n<p>That\u2019s how a Manufactured Housing Executives Council (MHEC) member described to\u00a0<em><a href=\"https:\/\/www.manufacturedhomepronews.com\/an-elephant-ass-understanding-gses-duty-to-serve-manufactured-home-lending\/\">MHProNews<\/a><\/em><em>\u00a0<\/em>the comparative losses on manufactured homes to losses incurred in conventional housing during the 2008 housing-financial crisis. He compared those trillions in losses on houses to the far more modest losses experienced by lenders operating in HUD Code Manufactured Homes in the late 1990s into the early 2000s.<\/p>\n<p>Despite that comparative pimple, Fannie Mae, Freddie Mac, and others periodically point back to that problematic so-called \u201c<strong><a href=\"https:\/\/www.manufacturedhomepronews.com\/witchs-brew-of-predatory-practices-longtime-mhi-member-attorney-marty-lavin-rips-manufactured-housing-institute-exposes-duty-to-serve-financing-stonewall\/\">GreenSeco era<\/a><\/strong>.\u201d That\u2019s 2 decades in the rearview mirror. How can that be an excuse for treating manufactured homes so differently than conventional housing in access to lending?<\/p>\n<p>The FHFA website says that Enterprise Housing Goals are supposed to \u201c<strong>FOSTER competitive, liquid, efficient, and resilient (CLEAR) national\u00a0housing\u00a0finance markets that support sustainable homeownership and affordable rental\u00a0housing<\/strong>\u2026\u201d<\/p>\n<p>Before and after passage\u00a0of the Housing and Economic Recovery Act (HERA) of 2008 and the Congressional mandate of Duty to Serve (or DTS) for manufactured housing by Fannie Mae, Freddie Mac &#8211; FHFA and other regulators have paid <em>lip service<\/em> to supporting manufactured homes.<\/p>\n<p>That negatively impacts millions. Who says?<\/p>\n<p><a href=\"https:\/\/www.manufacturedhomepronews.com\/hud-reports-homelessness-rising-housing-should-be-a-right-says-hud-secretary-marcia-fudge-praising-biden-initiatives-manufactured-home-factor-missing\/\">HUD Secretary Marcia Fudge<\/a> spoke recently about the tragedy of increased homelessness in America.<\/p>\n<p>HUD\u2019s sad <a href=\"https:\/\/www.manufacturedhomepronews.com\/hud-reports-homelessness-rising-housing-should-be-a-right-says-hud-secretary-marcia-fudge-praising-biden-initiatives-manufactured-home-factor-missing\/\">report<\/a> is fascinating because <a href=\"https:\/\/www.manufacturedhomepronews.com\/monopolies-silent-spreaders-of-poverty-and-economic-inequality-insights-from-henry-simons-thurman-arnold-applied-by-schmitz-and-fettig-to-hud-manufactured-housing-economic-inequality-and-poverty\/\">James Schmitz Jr. &#8211; a researcher for the Minneapolis Fed<\/a>, and <a href=\"https:\/\/www.manufacturedhomepronews.com\/sabotaging-monopolies-minneapolis-fed-researchers-charge-hud-collusion-w-builders-to-sabotage-manufactured-housing-independents-created-u-s-housing-crisis\/\">three colleagues<\/a> &#8211; published reports accusing HUD and builders of collusion in\u00a0deliberately\u00a0undermining manufactured housing.<\/p>\n<p>Schmitz and those researchers argued that collusion between HUD and builders is a case of \u201c<a href=\"https:\/\/www.manufacturedhomepronews.com\/monopolies-silent-spreaders-of-poverty-and-economic-inequality-insights-from-henry-simons-thurman-arnold-applied-by-schmitz-and-fettig-to-hud-manufactured-housing-economic-inequality-and-poverty\/\">sabotage monopoly<\/a>.\u201d<\/p>\n<p>They said that sabotaging collusion between HUD and builders increased homelessness, harmed minorities, and cut off the lower income class of all backgrounds from the benefits of affordable manufactured home ownership.<\/p>\n<p>Schmitz and his colleagues wrote positively about the manufactured home option.<\/p>\n<p><a href=\"https:\/\/www.manufacturedhomepronews.com\/affordable-manufactured-housings-puzzling-contemporary-condition-revealed-by-quotable-quotes-from-residents-professionals-expert-researchers-advocates-public-officials-graphics-and-repo\/\">Scholastica \u201cGay\u201d Cororaton\u2019s research for the National Association of Realtors<\/a> also praised modern manufactured homes.<\/p>\n<p>What makes Schmitz and his colleagues\u2019 charge of HUD\u2019s role in <strong>\u201c<span style=\"color: #800000;\">sabotage monopoly<\/span><\/strong>\u201d more compelling are comments from <a href=\"https:\/\/www.manufacturedhomelivingnews.com\/the-solution-to-the-affordable-housing-crisis-is-hiding-in-plain-sight\/\">Bill Matchneer. Attorney Matchneer is the former HUD administrator<\/a> for the Office of Manufactured Housing Programs (OMHP).<\/p>\n<p><a href=\"https:\/\/www.manufacturedhomepronews.com\/bombshells-former-hud-manufactured-housing-program-administrator-bill-matchneer-cavcos-manuel-santana-statements\/\">Matchneer said HUD\u2019s Office of General Counsel consistently failed to enforce the enhanced preemption clause made law when the Manufactured Housing Improvement Act of 2000<\/a> (MHIA or 2000 Reform law) was enacted.<\/p>\n<p><a href=\"https:\/\/www.manufacturedhomelivingnews.com\/how-the-manufactured-housing-institute-mhi-and-their-corporate-masters-painted-themselves-into-a-corner-consumer-alert-news-analysis\/\">Jim Gray<\/a>, formerly with the FHFA Duty to Serve program, said in his exit message that FHFA and GSEs &#8211; \u201c[W]<span style=\"color: #800000;\"><strong>e have not made as much progress<\/strong><\/span>\u00a0[toward meeting the Duty to Serve mandates]\u00a0<span style=\"color: #800000;\"><strong>as many of us would have liked; so much remains to be done to reach these<\/strong>\u00a0<\/span>[DTS]<span style=\"color: #800000;\">\u00a0<strong>markets<\/strong><\/span>.\u201d<\/p>\n<p>In December 2019, I made two different listening session presentations on the DTS mandates; one virtual and another live in Washington, D.C.<\/p>\n<p><a href=\"https:\/\/www.manufacturedhomelivingnews.com\/fhfa-gses-high-cost-to-minorities-all-americans-due-to-asserted-failures-to-follow-duty-to-serve-affordable-housing-existing-federal-laws\/\">In both presentations<\/a>, I made the evidence-based case how disgraceful it was that the FHFA and GSEs have ignored the law to the harm of millions.<\/p>\n<p>GSEs and FHFA failures arguably included key corporate members of the Manufactured Housing Institute or MHI.<\/p>\n<p>Several scheduled to present today are aware of the issues I\u2019m raising. Because some worked for HUD, FHFA, GSEs, or are otherwise connected to the manufactured housing industry.<\/p>\n<p>For instance. Lesli Gooch, Ph.D., with the Manufactured Housing Institute (MHI) made statements in her filed EHG comments letter that sound supportive of manufactured homes.<\/p>\n<p>But upon closer examination, Ms. Gooch focused on an unproven plan that Berkshire Hathaway (BRK) owned Clayton Homes &#8211; which supports MHI &#8211; in their push for their branded <a href=\"https:\/\/www.manufacturedhomelivingnews.com\/manufactured-homeowners-interests-threatened-by-manufactured-housing-institute-deceptive-scheme-per-modular-home-builders-associations-tom-hardiman\/\">CrossMod<sup>TM<\/sup>\u00a0homes scheme<\/a>.<\/p>\n<p>Where was Gooch\u2019s similarly robust support for <u>all other mainstream manufactured homes<\/u>?<\/p>\n<ul>\n<li>Fannie calls CrossMod<sup>TM<\/sup>MH Advantage\u00ae.<\/li>\n<li>Freddie calls their version of CrossMod<sup>TM<\/sup>CHOICEHome\u00ae.<\/li>\n<li>The known data reveals that these programs are market failures.<\/li>\n<\/ul>\n<p>Supposedly there have been double-digit sales nationally of CrossMod<sup>TM<\/sup>\u00a0&#8211; under whatever name &#8211; in the last few years. That\u2019s in a market producing some 95,000 HUD Code manufactured homes annually.<\/p>\n<p>Attorney and manufactured home finance veteran Marty Lavin &#8211; an MHI award winner &#8211; did consulting for Fannie Mae. <a href=\"https:\/\/www.manufacturedhomelivingnews.com\/award-winning-attorney-marty-lavin-sounds-alert-about-manufactured-housing-institute-backed-loan-program-home-values-supply-demand-case-for-manufactured-housing-sabotage\/\">Lavin told\u00a0<em>MHLivingNews\u00a0<\/em><\/a>that\u00a0MHAdvantage\u00a0\u00ae was likely to be as successful as MH Select\u00ae.<\/p>\n<p>Lavin said MH Select\u00ae was also a virtual goose egg.<\/p>\n<p><a href=\"https:\/\/www.manufacturedhomepronews.com\/david-dworkin-national-housing-conference-compared-and-contrasted-with-lesli-gooch-manufactured-housing-institute-on-fannie-mae-freddie-mac-proposed-modifications-to-fhfa-on-duty-to-serve-finance\/\"><strong>David Dworkin<\/strong>, CEO of the National Housing Conference in federal comments said that manufactured housing was necessary<\/a> for affordable housing.<\/p>\n<p>Dworkin was fully confident that the GSEs could successful do manufactured home loans.<\/p>\n<p>Dworkin previously worked for a GSE as a Vice President.<\/p>\n<p><a href=\"https:\/\/www.manufacturedhomelivingnews.com\/huds-urban-institutes-edward-golding-knew-because-manufactured-housing-institutes-lesli-gooch-told-him\/\">Edward Golding<\/a> worked for HUD and the FHA.<\/p>\n<p>In 2018, Golding and 3 colleagues did a post for the Urban Institute. It was a entitled <a href=\"https:\/\/www.urban.org\/urban-wire\/manufactured-homes-could-ease-affordable-housing-crisis-so-why-are-so-few-being-made\">\u201cManufactured homes could ease the affordable housing crisis. So why are so few being made<\/a>?\u201d<\/p>\n<p>Citing <a href=\"https:\/\/www.manufacturedhomelivingnews.com\/former-manufactured-housing-institute-president-manufactured-home-owners-urban-institute-and-you\/\">FHFA data, Golding and his co-authors in that Urban Institute report said manufactured homes appreciated in value<\/a>. They said manufactured homes could appreciate even more given access to affordable sustainable GSE loans.<\/p>\n<p>What that Urban Institute post <a href=\"https:\/\/www.manufacturedhomepronews.com\/challenges-to-obtaining-manufactured-home-financing-urban-institute-report-fact-check-analysis\/\">didn\u2019t disclose on that specific page is that Berkshire chairman Warren Buffett is a lifetime trustee of the Urban Institute<\/a>.<\/p>\n<p>The applied logic of Golding, Dworkin, <a href=\"https:\/\/manufacturedhousingassociationregulatoryreform.org\/mharr-calls-for-mainstream-manufactured-home-loans-to-be-included-in-enterprise-housing-goals\/\">MHARR\u2019s Mark Weiss<\/a>, and others should make it plain that the GSEs could and should be doing robust lending in manufactured housing.<\/p>\n<p>Oxford Bank has made personal property loans on manufactured homes for some 2 decades. Oxford reportedly loans with credit scores that mirror those of Berkshire owned 21<sup>st<\/sup>\u00a0Mortgage.<\/p>\n<p>Oxford purportedly does so profitably and sustainably and at\u00a0lower interest rates than 21st.<\/p>\n<p>Given those facts and legal mandates, what possible excuse can FHFA and the GSEs give for not robustly making mainstream manufactured home loans for both personal property as well as mortgage lending?<\/p>\n<ul>\n<li>Why did the <a href=\"https:\/\/www.manufacturedhomepronews.com\/expose-manufactured-housing-institute-ceo-lesli-gooch-fhfa-gses-mhec-mharr-and-mhi-award-winner-marty-lavin-on-duty-to-serve-manufactured-home-loan-controversies\/\">GSEs and MHI hold closed door meetings some years ago and never released those meeting minutes<\/a>?<\/li>\n<li>How did the\u00a0MHAdvantage\u00a0\u00ae CHOICEHome\u00ae and CrossMod<sup>TM\u00a0<\/sup>magically come to be so similar?<\/li>\n<li>Why is it that MHI postures support, but has backed or tolerated plans that leave Berkshire owned 21<sup>st<\/sup>and Vanderbilt Mortgage and Finance as the 2 runaway largest lenders in manufactured housing?<\/li>\n<\/ul>\n<p>I am consultant <a href=\"http:\/\/latonykovach.com\/\">L.A. \u201cTony\u201d Kovach<\/a>.
