The gist of those comments are found below.<\/p>\n<p>During the run-up and fall out of the 2008 financial and housing crisis we heard the expression \u201c<span style=\"color: #800000;\"><strong>too big to fai<\/strong><\/span>l\u201d often. But what some have noted, some appear to be \u2018too big to jail.\u2019 When partisans say that \u2018<span style=\"color: #800000;\"><strong>no one is above the law<\/strong><\/span>,&#8217; that notion should in fact be the standard applied to the often powerful personalities and organizations that will be the focus of this fact-evidence and \u2018follow the money\u2019 methodology used by investigators. These are issues we\u2019ve as our industry\u2019s largest and most read trade media have researched, studied, and reported on for several years, so they should be given the appropriate attention.<\/p>\n<p>The issues are both simple and complex. The proper enforcement of a few federal laws would make significant and positive changes beneficial to those who desire and need affordable housing. Why those federal laws are not being properly enforced is often due to a web of private special interests that at times work with public officials to bend the enforcement\/non-enforcement of certain laws to their own benefit. That office and other federal officials on both sides of the political divide have found what follows to be compelling. The amount in question would be over $1,000,000,000.<\/p>\n<p><a href=\"https:\/\/www.manufacturedhomepronews.com\/masthead\/deceptive-trade-practices-rico-antitrust-affordable-housing-manufactured-home-owners-and-small-businesses\/\">https:\/\/www.manufacturedhomepronews.com\/masthead\/deceptive-trade-practices-rico-antitrust-affordable-housing-manufactured-home-owners-and-small-businesses\/<\/a><\/p>\n<p>Preface.<\/p>\n<p>&nbsp;<\/p>\n<ul>\n<li>A Florida congressional legislative director, after reviewing much of what follows below, who recommended that the FL AG\u2019s office have a complaint like this filed. While there are federal investigations on related issues known to be underway, this impacts our state.<\/li>\n<li>While the organizations mentioned are out-of-state, they have local outlets and impacts are felt here in Florida. The allegations have impacted affordable housing in general and manufactured housing specifically in Florida and dozens of other states. Just as Florida has joined other states in probing big tech for antitrust and other problematic behavior &#8211; an investigation that based on the evidence and trends already known we as trade publishers applaud &#8211; Florida unilaterally and\/or in conjunction with other states is hereby being asked to formally investigate information that alleges several civil and possibly criminal activities that has already been developed by us as pro-consumer and pro-ethical business practices trade news media. But we don\u2019t have subpoena powers, Florida and other states can obtain subpoenas needed to dig deeper and understand the problematic business practices that harms consumers and independent businesses, as well as taxpayers, investors, and others.<\/li>\n<li>Let me begin by stating <a href=\"https:\/\/www.manufacturedhomepronews.com\/masthead\/expose-darren-krolewski-datacomp-mhvillage-mhinsider-marketing-claims-fact-check-infographic-and-analysis\/\">that third-party information reflects that we publish the runaway #1 largest and most-read trade media in our industry<\/a>. Those public officials found the information to be compelling, as have attorneys who have reviewed this data.<\/li>\n<li>Given the importance of the affordable housing crisis, the social, economic, public policy, and taxpayer impacts of it is important that this be given proper attention. It involves manufactured homes, which is a misunderstood topic as HUD Secretary Ben Carson has often made in the last two years. It should be noted that on each of these topics, we as trade media repeatedly invited officers and attorneys for the parties involved to respond to, debunk, or otherwise disprove the claims. They have repeatedly declined. It should also be noted that some of these organizations in several cases praised our trade media for years, until we began homing in on the reasons why the manufactured home industry has been underperforming for so many years. In many cases, those causes have internal causes, within manufactured housing.<\/li>\n<li>As an industry expert, I am prepared to testify or add additional information on these topics. The information presented is affirmed as being true, based upon evidence and patterns of behavior that are discernable by years of action\/inactions, to the best of my knowledge and belief.<\/li>\n<li>We have transparently brought these allegations to the attention of our industry\u2019s readers. Third party data and site metrics tell us that these are among the most-read articles. Industry professionals may not all agree, based in part upon if their own interest are threatened by a potential legal challenge to these allegations, but they have followed these topics as we have developed and reported on them literally for years.<\/li>\n<li>Before sharing more links, let\u2019s make clear that on antitrust and other issues, several mainstream media outlets have reported similar concerns. That op-ed was first fact-checked by an editor, before it was published not only in the one newspaper it was submitted, but at least in 5 Florida newspapers.<\/li>\n<li>The\u00a0<em><a href=\"https:\/\/www.nytimes.com\/2018\/11\/25\/opinion\/monopolies-in-the-us.html\">New York Times had an interesting article<\/a><\/em>\u00a0on the historic trends, and named several industries being monopolized.<\/li>\n<\/ul>\n<p>It is also worth noting that several 2020 Democratic contenders for their party\u2019s nomination for the presidency have signed onto a letter that raises some related issues. See that report, <a href=\"https:\/\/www.manufacturedhomepronews.com\/senate-democrats-including-2020-presidential-contenders-ask-cfpb-protect-consumers-against-predatory-lenders-point-finger-at-clayton-homes-berkshire-hathaway-lending\/\">linked here.<\/a><\/p>\n<p>&nbsp;<\/p>\n<p>Having set the table, let me begin, in no specific order of importance, a few key elements of the concerns that this writer is asking the State of Florida, and possibly other states, to investigate.<\/p>\n<p>&nbsp;<\/p>\n<ol>\n<li>Financing has been <a href=\"https:\/\/www.manufacturedhomelivingnews.com\/manufactured-home-financing-prosperity-now-following-the-money\/\">arguably manipulated in documentable ways that costs millions of Americans<\/a>, tens of thousands of whom live in Florida, to pay more for manufactured home lending than would be the case if existing federal laws were properly enforced.<\/li>\n<li>That manipulation of financing impacts minorities, as well as all others, <a href=\"https:\/\/www.manufacturedhomepronews.com\/native-american-racial-minorities-in-housing-and-manufactured-homes-per-fed-harmed-by-lending-practices-clayton-homes-berkshire-hathaway-affiliated-lenders-cited\/\">as a recent regional Federal Reserve report indicates<\/a>. Related to A &amp; B are comments made by <a href=\"https:\/\/www.manufacturedhomelivingnews.com\/senator-tina-smith-urges-republican-democratic-senators-to-provide-greater-financing-access-to-affordable-manufactured-homes\/\">Senator Tina Smith (MN-D), which applies to Florida, not just her state<\/a>.<\/li>\n<li>There are numerous examples of past or current public officials that seem to be connected to a manipulation of the finance system, one <a href=\"https:\/\/www.manufacturedhomepronews.com\/paul-barretto-sr-manager-fannie-mae-manufactured-housing-initiatives-fhfa-lobbying-regulations-duty-to-serve-and-manufactured-housing-institute\/\">example is linked here<\/a>. Note that this is related to concerns that former House Financial Services Chairman Jeb Hensarling (TX-R) raised during the prior Congress.<\/li>\n<li>While antitrust concerns are more commonly heard from Democrats, a growing number of <a href=\"https:\/\/www.manufacturedhomepronews.com\/washington-leak-justice-department-prepares-major-antitrust-investigation\/\">Republicans and the Trump Administration have taken up concerns over that issue.<\/a> That said, while antitrust focused on the tech giants is important, it is no less important to <a href=\"https:\/\/www.manufacturedhomelivingnews.com\/monopolization-of-american-dream-telling-the-inside-story-of-home-ownership-gone-awry\/\">investigate how alleged violations of antitrust, RICO, and deceptive trade practices impacts affordable housing by the apparent harm inflicted on millions of current and potential manufactured home owners<\/a>.<\/li>\n<li>A 600 word overview of these issues, which includes extensive links to related reports, is <a href=\"https:\/\/www.manufacturedhomepronews.com\/masthead\/manufactured-housing-industrys-opportunities-and-obstacles-executive-summary\/\">found at the report linked here<\/a>.<\/li>\n<li>There are resident groups in dozens of states that are keenly interested in these issues, examples of two are <a href=\"https:\/\/www.manufacturedhomelivingnews.com\/manufactured-home-community-leader-discusses-manufactured-housing-insanity\/\">linked here<\/a> and <a href=\"https:\/\/www.manufacturedhomelivingnews.com\/manufactured-home-resident-leader-asks-for-federal-investigations\/\">here<\/a>. While those two links are out-of-state comments, they apply equally to Floridians and are used because that resident laid them out systematically and comprehensively. That said, examples of Florida comments found in Florida mainstream news reports, are linked <a href=\"https:\/\/www.pressreader.com\/usa\/the-bradenton-herald\/20190312\/281500752569182\">here<\/a>, <a href=\"https:\/\/www.jacksonville.com\/opinion\/20190926\/letter-renting-costs-more-than-owning-manufactured-home\">here<\/a>, and <a href=\"https:\/\/www.lawnstarter.com\/blog\/city-rankings\/top-places-for-mobile-homes\/\">here<\/a>.<\/li>\n<li>The Manufactured Housing Institute (MHI), which has member firms in FL, and claims the Florida Manufactured Housing Association (FMHA) as an \u2018affiliate,\u2019 <a href=\"https:\/\/www.manufacturedhomepronews.com\/lanham-act-monopolistic-housing-institute-err-manufactured-housing-institute-legal-bullies-and-you\/\">hired an outside attorney that asserted written threats against us that in our mind violated state and federal laws, delivered via the U.S. mail and email<\/a>, thus they used \u201cthe wires\u201d and postal service, and fall under potential RICO claims. When a complaint was sent to that attorney\u2019s state agency, they have remained mute since, which may confirm that their threat was a form of extortion, and not based upon the law. As that impacted us in several ways, that makes us logically a victim of their attempt to silence our voice contrary to the U.S. Constitution.<\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<p>Several links will follow that relate to reports that are cross linked to additional information.
