So there is an obvious<em> potential<\/em> for a fine ethical development of investing successfully in affordable housing.\u00a0 There is always a need for affordable homes too.<\/p>\n<p>That begs the question, what&#8217;s the most proven form of affordable housing?<\/p>\n<p>The most proven form of affordable shelters aren\u2019t tiny houses, apartments, or any of the emerging technologies in shelter. The most proven form of affordable housing are HUD Code manufactured housing, and the millions of mobile homes and trailer houses that came before them.<\/p>\n<p>Yes, the terminology matters, because the terminology determines what code a home was built to meet. Hold tight to those thoughts. Indeed, Zell\u2019s Equity LifeStyle Properties (ELS) routinely out-performs other REITs or equities.<\/p>\n<p>Ponder Zell and those factoids, but don\u2019t get locked into what others are doing &#8211; yet &#8211; until you have a more complete picture.\u00a0 The problem for too many is that they don&#8217;t research carefully enough.\u00a0 Too many presume they know something, when in fact what they &#8216;know&#8217; are outdated or mistaken claims.<\/p>\n<p>Warren Buffett has said that he only wants to be in industries that make sense. His Berkshire Hathaway is the largest player in manufactured housing production, retail, and finance today.<\/p>\n<p>Buffett also believes in long-term investing in good companies, that he prefers to own.\u00a0 He&#8217;s also known for so-called &#8216;value acquisitions.&#8217; To Buffett and his partner Charlie Munger, an acquisition is a value if it\u2019s &#8216;<span style=\"color: #800000;\"><strong>intrinsic value<\/strong><\/span>&#8216; is less than he paid for it.<\/p>\n<p>Clayton Homes, 21st Mortgage Corporation, and Vanderbilt Mortgage and Finance (VMF) \u00a0are just 3 of many investments Warren Buffett led Berkshire Hathaway has made in manufactured housing starting in 2003. Berkshire has invested billions into manufactured housing since. Those actions by Zell or Buffett &#8211; <a href=\"https:\/\/www.manufacturedhomelivingnews.com\/hbos-john-oliver-on-last-week-tonight-mobile-homes-video-manufactured-home-communities-fact-check\/\" target=\"_blank\" rel=\"noopener noreferrer\">their ongoing investments, despite negative headlines<\/a> &#8211;\u00a0 speak louder than words.<\/p>\n<p>Hang onto all of those points as we explore why manufactured homes are so misunderstood, and why the industry is underperforming. Because crisis spells danger, as well as opportunities in disguise. Before Buffett invests, he reads a lot. Oliver\u2019s video obliquely spotlighted that each firm shown was a <a href=\"https:\/\/www.jacksonville.com\/opinion\/20190420\/letter-affordable-mobile-homes-are-desperately-needed\"><strong>member of\/connected to MHI, Berkshire Hathaway owned Clayton Homes, or 21st Mortgage Corporation<\/strong><\/a>.<\/p>\n<p>Hindsight can be 20\/20.<\/p>\n<p>In retrospect, it made no sense for MHI, Clayton, and 21st to pursue<em> Preserving Access<\/em>. <a href=\"https:\/\/www.manufacturedhomepronews.com\/industryvoices\/2012-election-results-and-coming-lame-duck-session\/\" target=\"_blank\" rel=\"noopener noreferrer\">MHI\u2019s own SVP said as much<\/a>.<\/p>\n<p><a href=\"https:\/\/www.mhmarketingsalesmanagement.com\/blogs\/industryvoices\/2012-election-results-and-coming-lame-duck-session\/\" target=\"_blank\" rel=\"noopener noreferrer\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-15661\" src=\"http:\/\/mhmarketingsalesmanagement.com\/blogs\/tonykovach\/wp-content\/uploads\/2019\/05\/JasonBoehlertPhotoManufacturedHousingInstituteLogoMHISVPGovtAffairsQuotePreservingAccess.jpg\" alt=\"JasonBoehlertPhotoManufacturedHousingInstituteLogoMHISVPGovtAffairsQuotePreservingAccess\" width=\"731\" height=\"269\" \/><\/a><\/p>\n<p>Before proceeding, some of what follows might appear partisan. MHAction previously protested controversial MHI member Frank Rolfe, and other MHI member MHCommunity operators.<\/p>\n<p>The Golden State Manufactured-Homeowner League\u2019s (GSMOL) president informed <a href=\"https:\/\/www.manufacturedhomelivingnews.com\/manufactured-home-resident-group-president-cautions-against-mhaction-surprising-background-reveal-to-manufactured-housing-action\/\"><strong><em>MHLivingNews<\/em><\/strong> that MHAction was funded by the Tides nonprofit<\/a>. Double-checking, the GSMOL claim proved correct.<\/p>\n<p>Who\u2019s funded the Tides? Buffett-funded <a href=\"https:\/\/www.manufacturedhomepronews.com\/prosperity-now-nonprofits-sustain-john-olivers-mobile-homes-video-in-their-reports\/\" target=\"_blank\" rel=\"noopener noreferrer\">NoVo Foundation was the Tides\u2019 top donor for years<\/a>.<\/p>\n<p>Millions of Buffett\u2019s bucks &#8211; via so-called &#8216;dark money&#8217;\u00a0channels &#8211; funded attacks by MHAction, <a href=\"https:\/\/www.manufacturedhomepronews.com\/prosperity-now-nonprofits-sustain-john-olivers-mobile-homes-video-in-their-reports\/\" target=\"_blank\" rel=\"noopener noreferrer\">plus other nonprofits on MHI and Berkshire\u2019s manufactured home<\/a> (MH) industry\u2019s brands.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>What\u2019s Going On?<\/strong><\/p>\n<p>Let\u2019s be clear. Several business practices alleged by Oliver, <em>WaPo,<\/em> and MHAction are troubling.<\/p>\n<p>But why does MHI &#8211; the national trade group supported by Berkshire &#8211; tolerate members engaged in embarrassing business practices?<\/p>\n<p>Meanwhile, <a href=\"https:\/\/mhaction.org\/wp-content\/uploads\/2019\/02\/PrivateEquityGiantsFinal.pdf\">Buffett-Tides-supported nonprofit MHAction<\/a> attack MHI members for irksome practices?<\/p>\n<p>Investigators use basic questions and principles. Cui bono? Who benefits? Plus \u2018follow the money\u2019 and evidence.<\/p>\n<p>&nbsp;<\/p>\n<p>The Society of Professional Journalists (SPJ) <a href=\"https:\/\/www.manufacturedhomepronews.com\/wp-content\/uploads\/2019\/04\/SPJSocietyProfessionalJournalistsCodeofConductMHProNews.png\" target=\"_blank\" rel=\"noopener noreferrer\">code of ethical conduct encourages calling out the powerful<\/a>. SPJ encourages public corrections as needed. This writer was technically correct in supporting <em>Preserving Access<\/em>. Odd? Is Rolfe &#8211; who has his own vexing image issues &#8211; correct?<\/p>\n<p>As noted above, Minnesota lawmakers decided in a <a href=\"https:\/\/www.manufacturedhomelivingnews.com\/democrats-republicans-agree-manufactured-homes-can-play-a-vital-role-in-easing-the-affordable-housing-shortage\/\">bipartisan report that affordable housing and manufactured homes go hand-in-glove<\/a>.\u00a0 Secretary <a href=\"https:\/\/www.manufacturedhomelivingnews.com\/hud-secretary-ben-carson-speech-on-manufactured-homes-manufactured-housingactive-ingredientmedicationfor-a-stronger-america\/\">Carson and former HUD Secretary Julio Castro both praised manufactured homes<\/a> too. Why aren\u2019t those items on the MHI website?<\/p>\n<p>Why are there numerous third-party, university level, nonprofits, or federal research that praise manufactured homes missing also missing from the MHI website? The screen captures are collages from MHI\u2019s search tool. They seem to support Rolfe\u2019s claim.<\/p>\n<p>Buffett gets into businesses he believes make sense. An arguably <a href=\"https:\/\/www.gurufocus.com\/news\/682660\/warren-buffett-cant-escape-unethical-strategic-moats\">Machiavellian ploy<\/a> is coming into focus.<\/p>\n<p>It includes a \u2018Rope-a-Dope\u2019 ploy with respect to <em>Preserving Access<\/em>.<\/p>\n<p>Berkshire machinations arguably includes <a href=\"https:\/\/www.thenation.com\/article\/special-investigation-the-dirty-secret-behind-warren-buffetts-billions\/\">Buffett\u2019s minions<\/a> deploying \u2018<a href=\"https:\/\/www.manufacturedhomepronews.com\/wp-content\/uploads\/2019\/03\/UnderstandingWarrenBuffettCastleMoatMetaphorsQuotesDailyBusinessNewsMHProNews.png\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>Castle and Moat<\/strong><\/a>\u2019 \u2018sharks in the waters\u2019 tactics in manufactured housing.<\/p>\n<p>Complex:<\/p>\n<ul>\n<li>tax codes,<\/li>\n<li>regulations, or<\/li>\n<li>cutting off or <a href=\"https:\/\/manufacturedhousingassociationregulatoryreform.org\/hud-code-manufactured-home-production-decline-continues-may-updates\/\">limiting capital access,https:\/\/www.manufacturedhomepronews.com\/masthead\/rope-a-dope-preserving-access-to-manufactured-housing-act-mom-dad-you\/ <\/a><\/li>\n<li><a href=\"https:\/\/manufacturedhousingassociationregulatoryreform.org\/hud-code-manufactured-home-production-decline-continues-may-updates\/\"> zoning\/placement issues<\/a>, and<\/li>\n<li>stirring up negative media,<\/li>\n<\/ul>\n<p>are all more difficult for smaller firms to navigate than a larger one with deeper pockets.<\/p>\n<p>In hindsight, MHI\u2019s \u201cbig boys\u201d led-the-charge for a<em> Preserving Access<\/em> bill that was doomed to fail. The bill created the <strong>\u201c<a href=\"https:\/\/manufacturedhousingassociationregulatoryreform.org\/the-illusion-of-motion-versus-real-world-challenges\/\" target=\"_blank\" rel=\"noopener noreferrer\">Illusion of Motion<\/a>.\u201d<\/strong> But Buffett\u2019s bucks funded both the pro-and-con sides of that effort. Meaning, Smith, Rolfe, Clayton, Williams\/21st and others are going to be who they are. If so, that&#8217;s a short term tactic.\u00a0 Once they&#8217;ve obtained their own perceived ideal combination of political and economic scenarios, they will take their foot off artificial breaks.\u00a0 At that point, the industry&#8217;s production could soar.\u00a0 Why?\u00a0 Because as the National Association of Realtor&#8217;s (NAR) Chief Economist Lawrence Yun told Forbes, there is a need for some 8.3 million housing units.<\/p>\n<p>Only factory building can logically close that gap. For the reason, Yun asked Scholastica &#8216;Gay&#8217; Cororaton &#8211; Certified Business Economist (CBE) &#8211; to research manufactured housing. She did.\u00a0 That <a href=\"https:\/\/www.manufacturedhomepronews.com\/wp-content\/uploads\/2018\/07\/NAR_RU_JournalRealEstateStudiesVol6May2018TheMarketforManufacturedHoumesP48ScholasticaGayDCorroatonCBEDailyBusinessNewsMHProNEws.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">expert NAR\u00a0research, is linked here<\/a>.\u00a0 In her first footnote, on page 48, she kindly named this writer in her acknowledgements.<\/p>\n<p>The evidence for that is subtle, but real. Or why doesn&#8217;t Buffett allocate money for a real image campaign for Clayton, <a href=\"https:\/\/www.manufacturedhomepronews.com\/clayton-homes-21st-mortgage-corp-vanderbilt-mortgage-and-finance-investor-lessons-learned\/\" target=\"_blank\" rel=\"noopener noreferrer\">instead of fig leaf efforts or a continuing stream of controversies<\/a>? The cost per square foot for a manufactured home is routinely lower.<\/em><\/figcaption><\/figure>\n<p>Each of these factoids paint a picture of an industry <strong>that should be roaring instead of snoring<\/strong>. The<em> dark mone<\/em>y trail of\u00a0Buffett <a href=\"https:\/\/www.manufacturedhomepronews.com\/prosperity-now-nonprofits-sustain-john-olivers-mobile-homes-video-in-their-reports\/\" target=\"_blank\" rel=\"noopener noreferrer\">bucks fueling both sides of various fights<\/a> &#8211; like <em>Preserving Access<\/em> &#8211;\u00a0should tell the savvy that there must be something huge here, or why bother going to all that trouble?<\/p>\n<p>Indeed, housing is a multi-trillion dollar field. How high might manufactured housing go? Consider what Harvard\u2019s Joint Center for Housing Studies (JCHS) Eric Belsky said not long before Buffett entered the industry that manufactured housing was poised to surpass conventional building.<\/p>\n<p>&nbsp;<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-14297\" src=\"http:\/\/mhmarketingsalesmanagement.com\/blogs\/tonykovach\/wp-content\/uploads\/2017\/12\/MultipleReasonsExpectManufacturedHousingDoBetterThanSiteBuiltHousingEricBelskyEecDirJointCenterHousingStudiesHarvardUnivDailyBusinessNewsMHProNews.jpg\" alt=\"MultipleReasonsExpectManufacturedHousingDoBetterThanSiteBuiltHousingEricBelskyEecDirJointCenterHousingStudiesHarvardUnivDailyBusinessNewsMHProNews\" width=\"598\" height=\"251\" \/><\/p>\n<p>Was Belsky wrong? Or how about the <a href=\"https:\/\/www.manufacturedhomelivingnews.com\/ultimate-reporters-researchers-affordable-housing-advocates-or-shoppers-3rd-party-research-reports-on-mobile-homes-manufactured-homes-and-modular-housing\/\" target=\"_blank\" rel=\"noopener noreferrer\">numerous other third-party studies that came to similar observations<\/a>?\u00a0 Isn&#8217;t the better argument that Belsky and others never imagined Buffett reversing growth, so they could consolidate the industry at a discount?<\/p>\n<p>Why has HUD Secretary Ben Carson said it is time to take manufactured housing out of the darkness of limestone into the brightness of the limelight? But they\u2019ve never filed suit. Why not?<\/p>\n<p>We\u2019ve given the Omaha-Knoxville-Arlington axis, their attorneys, and their allies numerous, documented offers to refute, explain away, or disprove any of those linked allegations.
