{"id":2609,"date":"2016-08-25T03:51:22","date_gmt":"2016-08-25T08:51:22","guid":{"rendered":"http:\/\/www.manufacturedhomepronews.com\/industryvoices\/?p=2609"},"modified":"2016-08-25T04:15:59","modified_gmt":"2016-08-25T09:15:59","slug":"discrimination-zoning-and-disparate-impact-on-manufactured-homes-owners-prospects","status":"publish","type":"post","link":"https:\/\/www.manufacturedhomepronews.com\/industryvoices\/discrimination-zoning-and-disparate-impact-on-manufactured-homes-owners-prospects\/","title":{"rendered":"Discrimination, Zoning and Disparate Impact on Manufactured Homes, Owners, Prospects"},"content":{"rendered":"<p>The discriminatory exclusion of manufactured homes by local governments is a major problem for the industry and consumers.\u00a0 It artificially stunts industry growth, while it unfairly deprives Americans of access to the nation&#8217;s most affordable housing &#8212; effectively excluding\u00a0lower and moderate-income\u00a0citizens from entire communities.<\/p>\n<p>While this phenomenon is dressed-up as &#8220;zoning&#8221; by those on the other side of the issue &#8212; in part because the federal government has historically been reluctant to interfere in local &#8220;zoning&#8221; matters &#8212;\u00a0<u>we<\/u>\u00a0need to be clear about what is\u00a0<u>actually<\/u>\u00a0going on,\u00a0in the language we use to refer to it, and how we address\u00a0it.<\/p>\n<p>The reality &#8212;\u00a0in many, if not most cases &#8212; is that &#8220;zoning&#8221; is simply a fig leaf for what amounts to discrimination; discrimination against our homes to be sure, but, more importantly, discrimination against the people who buy them, own them and live in them.<\/p>\n<p><img fetchpriority=\"high\" class=\"aligncenter size-medium wp-image-2612\" src=\"http:\/\/www.manufacturedhomepronews.com\/industryvoices\/wp-content\/uploads\/2016\/08\/MMarkWeissJDMHARRCEOPresident-ManufacturedHousingAssociationRegulatoryReform-500x343.png\" alt=\"MMarkWeissJDMHARRCEOPresident-ManufacturedHousingAssociationRegulatoryReform\" width=\"500\" height=\"343\" \/><\/p>\n<p>As\u00a0MHARR has stressed before, there have never been more\u00a0tools available to the industry and consumers to address this issue at &#8212; and beyond &#8212; HUD.\u00a0 These include not only the enhanced preemption of the Manufactured Housing Improvement Act of 2000, but HUD&#8217;s new rules on affirmatively furthering fair housing and\u00a0the recent Supreme Court decision allowing discrimination claims to be pursued based on evidence of &#8220;disparate impact.&#8221; \u00a0##<\/p>\n<p>(<strong><em><span style=\"color: #993300;\">Editor&#8217;s note<\/span>:<\/em><\/strong> This was the first for publication commentary sent in the wake of the <strong><em>Daily Business News<\/em><\/strong> report on a discriminatory zoning case, <a href=\"http:\/\/mhmarketingsalesmanagement.com\/blogs\/tonykovach\/zoning-regulation-and-manufactured-housing\/\" target=\"_blank\">linked here<\/a>.
